RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST CHURCH BARN LLC, C/O RICHARD MONTERA FOR VIOLATION
OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Church Barn LLC, do Richard Montera, VI #0500175, is allegedly in violation
of the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 13th day of September, 2005, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,and
WHEREAS,Church Barn LLC, do Richard Montera was not present or represented at said
hearing,although all parties were notified of said hearing by Department of Planning Services staff,
and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until November 13, 2005, to allow adequate time for the property owners to submit
a Use by Special Review application to bring the subject property into compliance and for an
inspection of the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that VI #0500175 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Church Barn LLC, do Richard Montera to remedy the violation of the
Weld County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties, with
an instruction for delay of action upon such referral until November 13, 2005, to allow adequate
time for the property owners to submit a Use by Special Review application to bring the subject
property into compliance.

To bring the property into compliance:
A Use by Special Review (USR) application shall be submitted to the Department of
Planning Services or a letter stating that the current activity taking place on the site will
cease until proper permits are obtained. Should this application be submitted before
September 9, 2005, violation hearings will be canceled.
This hearing will take place in our Hearing Room, located at 918 10th Street, Greeley, Colorado. It is
recommended that you or a representative be in attendance to answer any questions the Board of
County Commissioners might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent properties
the business day before or as soon as possible to the above mentioned Violation Hearing date.

This letter is regarding the property of Mr. Richard Montera, located at 34283 CR 33, The Church Barn:
It has been brought to my attention that a two day Roping Clinic is being held at the above property address.
Although it is free, it is in violation of the uses allowed by right on the property where the number of people
gathering is concerned. I have already granted 60 days to submit an application for a USR that would permit this
type of use, but until then any public activity shall not take place on the property pending the approval of the
USR. I have made an exception for the bible studies to continue, but I am not able to make any others. The
Roping Clinic can continue, this time, but should anything else come up I will have no discretion in the matter and
will be forced to take the case before the Board of County Commissioners. Thanks so much for your cooperation
regarding this matter.

Ann,
In response to your question concerning attendance at the arena, I have come up with some approximations.
"Regular" attendance is a bit of a misnomer. They have people who come and go, some who just want to see
the facility, and others who are "regular"attendees. With that in mind, the total attendance on Tuesday
evenings has grown in the last month from about 20 people to about 50 people. A Sunday morning gathering
has also started. It also grown and now has about 70 people who attend. About 30—40 people attend at
both times. I hope this information is helpful. If you have other questions about this matter, please contact
me.

I received a phone message and an email from your attorney, Joe Hoff, clarifying the uses on
the property. Mr. Hoff stated that the intent began as a small bible study which gradually grew
over time. In my response back to him I stated that the issue was presented to staff and based
upon his email indicating that a Use by Special Review application was already being completed
for an incorporated Christian ministry, it was determined that 60 days should be sufficient time to
submit your application. Staff did not ask that you stop operating in the mean time,but only that
the signs would not be put up again. For questions I would suggest that you speak to one of our
"On —Call" Planners. We have two locations open to the public. Our main office is located at
918 10`h Street, Greeley, Colorado. Where, we have an "On-Call" Planner, Monday or
Wednesday from 8:00 a.m.-4:00 p.m. or Friday from 12:00-4:00 pm. Our other office (the
Southwest Weld Office) is located at 4209 CR 24.5, Longmont, Colorado. At our Southwest
office, a Planner is available Tuesday or Thursday from 8:00 a.m.-4:00 p.m., excluding 12:30-
1:30. You do not need to call to schedule an appointment, because individuals are seen on a
sign in basis. To better serve you, please bring this letter with you.
It is the intention of this office to assist and cooperate with you without imposing undue hardships; however,
we have no discretion in this matter if you fail to correct this violation. You have 60 (sixty) days from

Ann,
I received your letter dated April 29th to Rick Montera late Wed. afternoon. Rick is out of town until next week, but
let me explain the situation and the series of events leading to this point.
There is currently a group of people who meet at the arena for a bible study. Originally, this group was small and
could meet in a home. The group grew to a point where Rick said they could use the arena. Keep in mind, this is
not a "church", but a group of cowboys who can use the roping facility and also conduct bible studies. The people
who use the facility are friends of Rick and there is no charge to use the roping facilities. The individuals are not a
"church entity", but do meet on a regular basis.
The size of the group has continued to grow and now needs a more functionally suited facility. They also wish to
become an incorporated Christian ministry. Mr. Montera has suggested that a building be constructed south of
the existing arena specifically designed to house this group and their meetings, In Motion Ministries, a local
mission training organization, and provide facilities for other Christian based ministries and activities. I am now
preparing the application for a USR for this specific parcel. The people who currently conduct their bible studies
at the arena got a little excited about the news of being able to have a new building, and started promoting their
new organization by putting up signs. These signs have been removed and the proper channels of pursuing this
endeavor are being followed. Mr. Montera envisions this parcel of land to become a campus for Christian
ministries and community events. The buildings would be available to church plants, special events, 4-H groups,
and other community services.
