In reference to all concerns of the Weld County Sheriffs Office: school pull off and
shelter. post office mail boxes, sign at entrance, maintenance of internal roadway, name
and copy of revised addresses (enclosed), have all been addressed and are all planed on
final proposal paper work. However. the one suggestion from the sheriff's office in
respect to fencing around the irrigation ditch and tank batteries may not be adopted at this
time due to the contractual agreements with the perspective companies. Neither the oil
company nor the respective ditch company \will allow any fencing within their respective
easements. The issues of liability have also been addressed within this, contract. Refer to
contracts submitted to Weld County planning. IIthere are any other concerns please call

80615.. The purpose of this correspondence is to obtain a letter from the Weld County
SheriThs Office indicating that all of their suggestions have been adopted and '. ill he

Recently an application for a proposed minor subdivision and change of zone was submitted to Weld County
Pf:inning. .\s of vet, RE.2 has not responded to %cld Comity in respect to any concerns they may have. One
criteria for recording the final plat is for me to provide written evidence from RE2 school district which
indicates that all district requirements have been met. Enclosed is a partial copy of the preliminary plat
indicating school bus pull off as well as location of proposed shelter. 1inir comments in letter form would he

It was a pleasure talking to you yesterday afternoon. I have attached copies of correspondence
from the North Weld County Water District (NWCWD) as we discussed. The letters explain that
they have"no objection" to the construction of a well to be used exclusively for fire-fighting
purposes on Mr. Harkless' property.
I understand that you also had questions regarding how Tracts A and B will be irrigated. These
tracts will not be irrigated. Rather, they will be planted with native grasses, which have low water
demands and blend into the natural surroundings. The applicant plans to maintain these tracts for
the first couple of growing seasons to help the native grass plantings become established. Once
the native grasses are established, Tracts A and B will not promote the growth of noxious weeds
and will not require irrigation or substantial maintenance.
As we discussed yesterday, I would appreciate it if you would update your referral letter to the
Weld County Planning Department in regard to these issues. Thank you, and please contact me if

Faith Estates Minor Subdivision

Dear Mr. Gesick:
The Weld County Planning Commission has recommended approval of the Faith Estates
Minor Subdivision change of zone plat. The Weld County Planning Department has
requested that, prior to recording the change of zone plat, we attempt to address the
concerns of the City of Greeley as stated in the referral comments dated December 22,
2004. While we appreciate your review and your comments and we have taken them under
advisement, we realize the County does not require their resolution and they do not
necessarily match the intention for a low-impact development. Below are our responses to
the referral comments:
1. The property is located outside of the City of Greeley's Long-Range Expected
Growth Area. The applicant is unable to dedicate a total of 60 feet of right-of-way
west of the existing centerline of WCR 37 without putting three of the lots in the
subdivision under the minimum lot acreage required for estate lots. Additionally,
we also appreciate the positive attributes of the previous layout; however, we were
unable to go further with that layout due to constraints presented by existing
utilities. The current layout has been accepted by Weld County's Planning and
Public Works Departments and is the most economical and functional option for
the applicant.
2. The layout has been adjusted to retain as many existing trees on the property as
possible.
3. Since the private access road will generate a very low traffic volume, the applicant
and the County Public Works Department do not feel pavement is warranted.
However, our client has expressed interest in a chip-seal or polymer admixture for
the gravel road to help reduce impacts to air quality. The decision to make this
type of improvement will be based on observation of the as-built condition and
coordination with the Homeowner Association.

4. Neither the applicant nor the County feels the traffic volume presented by this
development warrants sidewalks for pedestrian movements. Sidewalk and curbs
would also detract from the subdivision's low-impact approach to development.
5. The current layout shows the entrance to the subdivision located more than 1,600
feet north of the intersection of Highway 392 and WCR 37, and more than 1,000
feet south of the next parcel. The County has not expressed any concerns regarding
'the separation of access points to WCR 37. In addition, providing a stub-out street
would push two of the lots under the minimum total acreage required for Estate
lots.
