Other subjects of the service plan, such as, services in the area, compliance to master plan (comprehensive plan), etc I will leave for other referral agencies with more expertise: The financial portion of the service plan is adequate. Kirpatrick Pettis has prepared a pro-forma financial plan that is realistic and feasible, assuming the build out of the district takes place as projected. If the build out does not occur as proposed the district has a safeguard of not allowing anymore than a 20 mill levy, to protect property owners. Bondholders would be buying the bond to finance the district knowing there was a maximum mill levy limit of 20 mills. The only item in the financial projects that could be questioned is the assessment ratio of 7.98% for residential property remaining constant over the life of the bonds. With the Gallagher Amendment that ratio could drop, thus reducing the assessed value over time. The projected market value increases are conservative, and should offset any change, but it is not guaranteed. In fairness to the person making the projection, however, the 7.98% is the best available number. In conclusion from my review of the financial plan I recommend approval of the service plan. Morrison, Assistant Weld County Attorney W I iDe DATE: December 7, 2004 RE: Referral Regarding the East I-25 Sanitation District COLORADO Service Plan Case 2004-0158 Please note that as counsel to Planning Commission and Board, it is not appropriate to recommend for or against an application. These comments are intended to point out issues. The District Service Plan suggests an "ultimate" District boundary, but under provisions of Colorado Law regarding to amendments to Service Plans, a Special District is not required to Amend the Service Plan to expand beyond the initial described limits of the service area so long as the expansion stays within the unincorporated county in which it was originally formed. In order for the County to exercise any control as to future expansion of this District, I would suggest the need for express provisions in the Service Plan which would limit the ability of the District to expand beyond those described areas. The Financial Plan which is based on population projections which may be difficult to sustain. Some of the concerns regarding a lack of restraints on the district are mitigated by the fact that this District appears to be only for the purpose of sewage collection and not for treatment or for other purposes. Because it is a single use District, the Service Plan reserves less discretion to the board directors in how the District would function or what services it would provide. It should be further noted, however, that this District as described at its maximum extent, could still serve approximately twenty square miles even if there is a limit placed in the Service Plan on expansion. y , fz � _ : t Lee D. As you are aware, there has been some discussion between the applicants of this new district and the St. Vrain Sanitation District (SVSD). At a recent meeting of the SVSD Board of Directors, the question was posed to the Board asking if SVSD would be willing to provide treatment services to the new district. At that time, no motion was made, seconded or voted on to approve any such service agreement nor has an official vote been taken at any other time. However, the board did acknowledge that they would be very interested in and agreeable to working with the new district in order to contract for services. It has been made very clear to the proposed new district that although SVSD strongly supports regionalization of sanitation services in the area, we are not and will not go out and seek to acquire territory from other districts nor will SVSD interfere with or impose on the designated 208 boundaries of another district or municipality. Any changes in 208 boundaries will be must be initiated by the new district. In this case, it is recognized that part of the proposed territory of the East I-25 San District lies within the existing 208 boundary of the Town of Mead. However, the town does not appear to have the ability or the facilities to provide treatment services at this time to the proposed district territory. This is why the property owners want to form a new district and contract with SVSD for treatment services. In reviewing the Service Plan, following are some specific comments on selected sections within the plan: 1.2 Other Jurisdictions — This section mentions a sub-district. This has been discussed, and SVSD recognizes that the new district could request to be included as a sub-district to the existing SVSD, there appears to be advantages in doing so. Such action would occur only after formation and only after full agreement of the boards of each entity. SVSD currently has the policy that lift stations are not accepted. However, this policy is being reconsidered. It is the preference of the District that all lines flow to the treatment plant by gravity but it is recognized that in some cases this may not be totally possible and that an alternate solution may be appropriate. In summation, SVSD has no objection to the formation of this new district as it does not infringe on SVSD 208 boundaries. SVSD supports regionalization has the capacity and ability to treat wastewater that would be generated in this area. The City's comments suggest that the submission and approval of this service plan is premature since only about 160 acres of the proposed 13,000 acres are currently within the I.25 Mixed Use Development Area and planned for urban level development. The existing 1-25 Mixed Use Development Area encompasses about 15,000 acres. Staff comments also suggest that it is not timely for Weld County to consider such expansion until much more of that area is actually built out. Finally, the City is a member of the North Front Range Water Quality Planning Association (NFRWQPA). The proposal is for the development of a new sanitation district in three phases. This district could ultimately provide sanitation collection services for development in the general area between 1-25 and County Road 17 and Highway 66 and County Road 40. This collection service would then transport water to the existing St. Vrain Sanitation treatment facility. According to the application, all of the property within the initial proposed district lies within unincorporated Weld County. The proposed district boundaries overlaps two existing (Town of Mead and St. Vrain Sanitation District) service area boundaries as defined by the Areawide Water Quality Management Plan (AWQMP). The AWQMP is administered by the North Front Range Water Quality Planning Association and must approve of the service boundaries. The proposed district must also seek and receive approval from the CDPHE and your agency (in accordance with the Colorado Regulations for the Site Application Process 5 CCR 1002-222)). The approval of this district will likely spur growth and development in an unincorporated area of the County. To our knowledge, the applicant has not used County processes such as inclusion into the MUD, to address service and other utility issues. The lack of a municipal government may limit the development of certain services and amenities that contribute to the public health of a community, ie. integrated walking/biking trails, public transit, recreation centers/facilities, etc. Further, the lack of local services will cause residents to pursue those services in other areas increasing the number of vehicle miles driven contributing to poorer air quality within our air shed.
