RESOLUTION
RE: APPROVAL OF SUBDIVISION EXEMPTION NO. 115 - BERNARD AND
MICHELE WAGY.
e WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
a Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado has reviewed the request of Bernard and Michele Wagy
for an exemption from the definitions of "subdivision" and "sub-
divided land" in Section 30-28-101 (10) , CRS 1973, as amended,

�,_ and Section 2-1 of the Weld County Subdivision Regulations , and

WHEREAS, the Board of County Commissioners finds that
Bernard and Michele Wagy are the owners of certain parcels of
land located in part of the Southwest Quarter of Section 15 ,
Township 2 North, Range 68 West of the 6th P.M. , Weld County,
Colorado. Mr. and Mrs. Wagy would like to increase the size
of one parcel by 21 feet and sell the smaller parcel. The
legal description of the resulting tract of land is as follows:
A parcel of land situated in the Northwest
Quarter of the Southwest Quarter of Section
15, Township 2 North, Range 68 West of the
6th P.M. , Weld County, Colorado, and more
particularly described as follows:
Beginning at the West Quarter corner of
said Section 15, and running along the
North line of the Southwest Quarter East
257 . 00 feet to the true point of beginning,
thence (1) along the North line of said
Southwest Quarter East 184. 00 feet, thence
(2) along the Westerly bank of Last Chance
Ditch South 34 13 ' West 252 . 75 feet, thence
(3) West 41. 87 feet, thence (4) North 209 . 00
feet to the true point of beginning, contain-
ing 23, 603 square feet of land more or less .
Excepting such portion of Weld County Road
#201 as is contained herein. Also subject
to easements and rights-of-way of record.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the abovedescribed par-
cel be, and hereby is , declared to be exempt from the definitions
of "subdivision" and "subdivided land" as set forth in Section
30-28-101 (10) , CRS 1973, as amended, and Section 2-1 of the Weld

County Subdivision Regulations and shall be considered to be a
single lot.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 14th day of
