RESOLUTION
RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT#1442 - JON MOSER
WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated February 4, 2004,the Board did approve Use by Special
Review Permit #1442 for a Use Permitted as a Use by Right, an Accessory Use, or a Use by
Special Review in the Commercial or Industrial Zone Districts (the selling, manufacturing, and
outdoor storage of metal products) in the A (Agricultural) Zone District, for Jon Moser on the
following described real estate, to-wit:
Lot B of Recorded Exemption #1566; being part of
Section 9, Township 6 North, Range 66 West of the
6th P.M., Weld County, Colorado
WHEREAS,the Board has received a request from Scott(Jon)Moser,34824 Weld County
Road 29, Greeley, Colorado 80631, to vacate said Use by Special Review Permit#1442, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present,studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said vacation.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit#1442 be, and hereby is, vacated.
The above and foregoing Resolution was,on motion duly made and seconded,adopted by

SUBJECT: Vacation of USR-1442
DATE: March 2, 2005
The Department of Planning Services has received the attached letter dated February 9, 2005
from Scott Moser. Mr. Moser is requesting that USR-1442 be vacated from his parcel, 0805 09
000059 since the use is no longer being performed on the property.

Legal Description: Lot B of RE-1566 Section 9, T6N, R66W of the 6th P.M., Weld County,
CO
Location: South of and adjacent to County Road 72 and East of and adjacent to 29
County Road
USR-1442: USR-1442 was approved by the BOCC on February 4, 2004, for a Site
Specific Development Plan and Special Review Permit for A Use
Permitted as a Use by Right, an Accessory Use, or a Use by Special
Review in the Commercial or Industrial zone districts, (the selling,
manufacturing and outdoor storage of metal products ) in the A
(Agricultural) Zone District.

I Scott Moser owner of Moser Metal Crafts Inc, I have been going through
the special use permit process for the last year, I just sold the business
February 1 s` so I will no longer need the permit to run the business at 34824

At this time I am withdrawing my application.
