RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST SAM AND GENEVIEVE VIGIL FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Sam and Genevieve Vigil, VI #0500146, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 9th day of August, 2005, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Sam and Genevieve Vigil were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until September 9, 2005, to allow adequate time for the property owners to restore, remove, or screen the noncommercial junkyard from all adjacent properties and public rights-of-way, to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. An inspection was conducted on April 27, 2005. A permit to install the electrical in a safe condition to the water pump has not been applied for. The extension cords to the pump and to the shed that %EIS used as a single family dwelling has not been removed. Excel energy has been directed to remove the meter as allowed by the Weld County Code Sec. 29-11-60. The meter can be reset once the extension cords have been removed and a permit and approved inspection have been conducted on the electrical to the water pump. Authority to disconnect utilities. A. The Building Official shall have the authority to order disconnection of any utility supplied to a building, structure, system or equipment regulated by this Building Code, when it is determined that the system or equipment, or portion thereof, has become hazardous or unsafe. As per our phone conversation,im not sure how much authority I have with what would be called a residence in regards to the Fire Code. We have adopted the 2003 International Fire Code and have consent to enforce from both the Town of Milliken and Weld County.Below are the sections that outline the requirements of extension cords and general electrical hazards.
