If you wish to be heard by the Board of County Commissioners,
it will be necessary for you to indicate your request by sign-

Regular hearing procedures will then be followed. This includes
publishing a Notice of Hearing in the legal newspaper, an expense
to be paid by you.
In order to proceed as quickly as possible, we must receive your

THE DEPARTMENT OF PLANNING SERVICE'S STAFF RECOMMENDS THAT THIS REQUEST BE
APPROVED FOR THE FOLLOWING REASONS:
1. It is the opinion of the Department of Planning Services staff that this
—' request is in agreement with the Weld County Comprehensive Plan in that
the Plan states that the expansion and--development of agribusiness and
agriculturally oriented industry will be encouraged, provided these
enterprises do not adversely affect the totaleconomy or environment.
It is the opinion of the Department of Planning Services staff that the
proposed use would not appear to have any adverse impacts on the
agricultural interests of the County, the total economy or the
environment.
2. It is the opinion of the Department of Planning Services staff that the
applicant has shown compliance with Section 24.3.1.1 of the Weld County
Zoning Ordinance as follows:
The proposal is consistent with the Comprehensive Plan in
that the policies of the Plan promote agribusiness so long
as they do not create negative impacts on the environment
or the County. The proposal is consistent with the
intent of the Agricultural._Zone District. - The use is
both compatible with existing agricultural activity and
with land use which is contemplated_to be agricultural in
the Comprehensive Plan.
3. No overlay districts affect the site. Operation and Design Standards
provide adequate protection of the health,- safety and welfare of the
immediate area and' the County.
4. The submitted materials are in compliance with the application requirements
of Section 24.7 of the Weld County Zoning Ordinance.
The Department of Planning Services staff's recommendation for approval is
conditional-and -based upon the following: -
1. The attached Operation Standards being recommended and
approved for this operation.
2. The approved Operation Standards shall be placed on the Use by
Special Review Permit plat. The Use by Special Review Permit
plat shall be delivered to the Department of Planning Services.

1. The uses permitted as described in the application materials on file
• with the Department .of Planning Services shall .be an egg production
facility consisting of one million C1,000,000) laying hens in addition
to replacement pullets. Facilities shall be limited to those shown hereon
and all other'uses permitted by right in the Agricultural Zone District.
2. No runoff associated with the subject operation as allowed by the Use
by Special Review Permit shall be-allowed to flow off the property of
the owner and/or operator onto the land of surrounding property owners
without their written consent.
3. Design'Standards _for Uses by Special Review, Section 24.5 et seq. of
the Weld County Zoning Ordinance shall be complied with.
4. Operation Standards for Uses by Special Review, Section 24.6 et seq.
of the Weld County Zoning Ordinance shall be complied with.
5. All phases of the operation shall comply with all County and State
Health Standards and Regulations pertaining to air quality, water
quality, noise emission and sanitary disposal systems. The facility must
comply with the Air Quality .Control Commission Regulation No. 2, which
deals with odors:- .odors must not exceed the 7:1 .Dilution.:to_Threshold
ratio measured off the property. Flies and fly breeding shall be controlled
year-round. Burial of dead birds is permissible on the subject site
provided the proper `disposition adheres to, CRS 25-1-612. The septic
system-shall-be -engineer.designed._and_a,_site approved process shall
. be''required;
6. A revised mylar plat shall show only one access point on Weld County
Road 13. .'The one access shall, have'.the approval of the Weld County
Engineering Department. ,':The ,one access shall be constructed in accordance
with the recommendations and/or requirements of the Weld County
Engineering Department.
7. A revised mylar plat shall show a dedicated seventy-five.:(75) foot
right-of-way north of the centerline of State Highway 66.
8. Prior to the development of the site, the applicant shall submit a detailed .
set of- drawings to the Longmont Fire Protection District as requested in
the Fire District's letter dated: August 31, 1983.
9. The Use by Special Review shall be limited to the plans shown hereon
and governed by: the Operation Standards stated above, and all applicable
Weld County Regulations. . Any-material deviations from the plansand/or
Operation Standards as shown or stated above shall require the approval
of an amendment of the Use by Special Review permit by the Weld County
Planning Commission and the Board of County Commissioners before such
-changes from the plans and/or Operation Standards are permitted. Any
_ other changes shall be filed in the office of the Department of Planning
Services'.
10. The property owner and/or operator of this operation shall be responsible
for complying with all of the above stated Operation Standards. Non-
compliance with any of the above stated Standards may be reason for
revocation of' the Use by Special Review Permit by the Board of County
Commissioners.

Possible Issues Summarized from Application Materials:
Two major criteria for review in this case will be compatibility with
existing surrounding land uses and compatibility with the future develop-
ment of the area. However, this agribusiness activity would be properly
zoned in the Agricultural Zone District, if a Use by Special Review Permit
is approved. Two referrals have raised concerns, in regard to the potential
of one million chickens on this site. In a memo from Ron Stow, Director
of Environmental Health, the issues of severe odor and proper waste disposal
were mentioned. A letter from the Little Thompson Water District addressed
the potential impact on water demand and the possibility of cost-sharing
between the district and the applicant. (See referrals in information
packet.)
The applicant has been notified of these concerns, and has been instructed
by the Department of Planning Services to submit further information.
The Department of Planning Services has not received any objections
regarding this application.

COMMENTS:
The subject site is irrigated cropland (corn and hay) , serviced by ditches running
from Foster Reservoir. An irrigation ditch serves as the northern and as a portion
of the western boundary of this parcel. The land slopes the east-southeast, and is
conducive to irrigation. Improvements on the property include a residence, garage,
several outbuildings barn and silo. The improvements are located in the northeastern
corner of the 102 acre parcel. Access is to Weld County Road 13, a paved road.
The Sekich Industrial Park and the Sekich Equipment Company are located 1.75 miles
west of the proposed poultry farm. This area has the potential for heavy truck
traffic and other industrial/commercial activities.

Dear Sirs:
Boulder Valley Poultry Farms, Inc. has been in business for 20 years. We
started on Valmont Road when our area was in the country and the laying hen
business was part of the scene. We are now practically in the city and the
time has come for us to move. We have picked.a site that we feel is appro-
priate and is located on the Northwest corner of county highway #13 and
highway I-66. We wish to secure your approval of this site. We understand
that manure management 18 of concern to you. We have never had any trouble
with the city of Boulder or the county of Boulder because we have always
worked with them. We intend to work with the neighbors and Weld County in
the same way.
We have two end dump Semi Trailers and Tractors with which we are prepared
to distribute the manure to local farmers if necessary, however, the type
of chicken houses that we intend to build are the latest in the state of
the art and will be a high rise type with the manure inside the house, on
the ground floor, that will be cement. The chickens will be eight feet
above the floor containing the manure. The ventilation will be such that
air brought in at the eaves will be forced downward across the chickens,
taking up the heat from the birds and channeled across the manure on the
lower floor and expelled by fans in the sides of the chicken house. The
watering system that feeds the birds is also the latest in the state of
the art and leaks have virtually been eliminated. All of this should
produce a dry manure without any smell and without any flies. The opera-
tion should be able to contain the manure for at least a year or at a time
that will coincide with the demand from the farmers for fertilizer for
their fields.
If for any reason this does not work, we are prepared to remove it daily
with our turcks like we have for years here on Valmont Road. We have
never been a nuisance here and have no intention of being one where we
would like to move.
We hope that you will look with approval on our request and thank you
very much for your time on this matter. If there is any other way we can
be of assistance please call on us.

Dear Sirs:
Enclosed please find the application for the non-conforming zoning for
the Boulder Valley Poultry Farms on 102 acres located at the corner of
State Highway 66 and Weld County Road 13.
Pertaining to Paragraph #1 items a-d; our application is consistant with
the Weld County Comprehensive Plan, the current use of the land and the
projected future use. Items f and g; every effort will be made to conserve
productive agricultural land in the locational decision for the proposed
use and consistant protection of the health, safety and welfare of the neigh-
borhood and the County.
Paragraphs 2, 3 & 4 are attached hereto.
Paragraph 5;
a. Egg production
b. 500 feet or greater
c. One shift, 30 employees
d. 30-40 within 24 hour period
f. 400,000 initially to 1,000,000 birds at capacity
g. Four structures (chicken houses) 56 ' x 535' initially to a total
of 12, one production facility (prdcessing plant) and feed mill
130' x 300' and initially two replacement pullet houses 56' x 300' .

plus an occasional feed truck. Access off Highway 66 to County Road

Waste to be trucked away daily.

then remove.
1. Operation to be phased (see g) which initially will require 12
months. Balance of construction over 36 months thereafter, beginning
after initial 12 months.

The Boulder Valley poultry farm currently operates a conforming
industry on the north side of Valmont Road between 47th and 55th
Street just east of the city of Boulder in Boulder County. The
industry has existed at that site since its beginning and has operated
in conformance with applicable zoning and health laws in an urban
setting.
Boulder County has had an excellent working relationship with the
current owner Mr. Bruce Vaughn who in our opinion makes every attempt
possible to ensure that his business is a good neighbor by efficient E.=.
operation such as removal of wastes , etc. The industry is an important
one in Boulder County and we would welcome the opportunity to continue
that relationship in Boulder County for the future.

Our comments are:
1. Our information indicates that the company's present operation
in Boulder County has and is experiencing severe odor
problems because of wet chicken manure caused by enteritis _
in the flock. Our county has been impacted greatly by
mal-odor sources in the past. We cannot tolerate others.
What steps does the company plan to deal with this problem?
2. Our information indicates that the company has experienced
problems with illegal discharge and odors from their waste-
water ponds at the Boulder plant. No information was
presented regarding such a pond. Will such facilities
exist at the proposed site?
3. How will dead chickens be disposed of?
4. A septic permit will be required. It must be applied
for through this office, An engineer disigned septic
system may be required due to potential loading.

Our staff has reviewed the referral and the plan deals with the
utilization of the site and the disposal of waste, but there is
no plan presented for the control of erosion during construction
or what measures are to be taken to revegetate the area after
construction.
Our staff would be happy to work with the landowners in the
development of an erosion control and revegetation plan for
the site.

water service to the proposed development of the SE 1/4 Section 24, T.3N,
R 68W by Boulder Valley Poultry Farms.
We have not been advised as to the total demand when all phases of
development is complete. If a large amount of water is required, the
developer may be required to participate in the cost of providing such
service.

We have reviewed the Boulder Valley Poultry Farms Use by Special Review
• Application and have the following comments.
Projected traffic on State Highway 66 indicates the need for a 150-foot
total right of way, 75 feet each side of the highway centerline. Since the
existing right of way is 40 feet north of the centerline, an additional 35
feet should be protected by reservation or, preferably, dedication as per-
mitted by local regulations.
Based upon a telephone conversation with the applicant, we have been
informed that daily traffic generation at this site would consist of five
semi-trailer trucks and ten autos per day. This amount of traffic would not
warrant turn lanes at the intersection of County Road 13 and S.H. 66.

My comments to the letter from Bruce Vaughn, Secretary/Treasurer
of Boulder Valley Poultry Farms, Inc. are as follows:
1. Burial of dead birds is permissible. They must
be covered with at least two (2) feet of soil.
Dead animals can also be burned (cremated) but
this usually involves -the proper construction,
with_air pollution and building.permits, of an
approved incinerator. The proper disposition of
dead animals is covered in Colorado Revised Statues
25-1-612 (copy enclosed) .
2. Odors from any source in excess of those permitted
by the Air Quality Control Commission's Regulation
#2 will not be tolerated (copy enclosed) .
3. The septic- system, if it is to deal with process_
waste water, will be required to be engineer-designed.
If the gallonage on a daily basis exceeds 2,000, a
site approved process will also be required.

Dear Mr. Mullen:-
We are in possession of your memorandum of Aug. 16,1983 containing four comments
tiat we wish to address.
Relating to your comment number one, we do have some wet manure in one of our
high rise houses that was caused by malfunctioning of the individual watering cups
located in the cages housing the chicken. By the -time-we were able to fix this system,
we had a-basement full of water which was mixed with manure. Any enteritis that we
had with the chickens was caused by hot weather and has long since -been.cleared up.
The removal of the wet manure has :been a problem and every time that we work in the
house with loaders and trucks, we disturb the mixture and create an odor. We are
working on removal of this material now and should have it cleaned up in the near
future. I might point out that in removing it, we are going to create andodor, a
situation which will terminate when we finish the job. Some of the complaints we
had were from delivery to farm's in the vicinity of this wet material: We assumed
that the farmer had means of spreading' or disking that- would have alleviated any odor.
When we were appraised of the situation that they were not••equiped to handle it we
ceased delivery to them. We now have a place north of Lyons that-Can take it and
it will not pose a problem because there are no neighbors within a great ,distance.
I would like to point out to you that we have had chickens here for twenty years and

we have always cooperated with the health dept. We always take care of any problem
like this immediately. Where we are located now, we are within five hundred feet
of high density housing, and we stand to receive complaints from the slightest odor.
Where we would like to locate in Weld County we shall be very much more isolated space-
wise and I do not believe we could have this kind of trouble. In the first place
our proposed complex will have the latest in equipment and the waterers will be a
nipple type that do not leak. The manure will be dry and dryer still because the fans

in the houses will bring warm air across the manure and expel it outside the house.
There will be no odor at all. If we should have trouble,- we will be on top of it
immediately and it shall be taken care of. We have always been good neighbors and we
intend to be good neighbor where we locate. We are enclosing a photocopy of a letter
from the City of Boulder which is self explanitory. You will notice that there are
no complaints about flies. This is because we have practically no flies due to dry
manure in the rest of the houses we operate. We will be the same in Weld County.
In regard to your comment number two, we do have a lagoon located at the rear
of the property on a small hill. Three years ago we did-have a break in the side of
the lagoon and affluent water did run down the side of the hill. When we became aware
of this problem, we fixed it, and we have had no complaints for over two years in
regard to illegal discharge or odors from this installation. This morning I talked
to George Mathews of the Boulder County Health Dept. and he agreed with me that the
above is a true statement of fact. You might contact him about it if you wish, His
telephone number is 441-1182. As far as the proposed site is concerned, hopefully,
the soil in that area will absorb from a leeching field and we will not need one.
If we do need one, we shall take care of it and not let it become a nuisance. The
waste water that we have to dispose of is from wash water that we process eggs with,
and approximately four toilets.
Regarding your third comment, we can go either one of two ways in disposal of

dead chickens. We can grind them up and mix them with the manure which is being done
many places back east, or we can utilize a burner and creamate them. Burners like
this have after burners on them and create little or no problems, and Boulder County
Health Dept. suggested that we creamate here offering to help us obtain the necessary
permits to operate a facility of this type. We would be inclined to follow your suggest-
ion if you care to give them. At the present time we are disposing o4 them in earth
covered excavations, in the ground, several miles east of Lafayette. The elevation
is higher_-here, and we feel that we are not contaminating the underground water supply.
Finally regarding comment number four, we would like to apply for the septic
permit which we require, please inform us as to what proceedure that you wish us to
follow.
Any other way that we can be of service or that you can help us, please contact
us as soon as possible.

Dear Commissioners ,
We , the undersigned , being all the property owners
within 500 feet of the proposed Boulder Valley Egg Farm
facility to be located at Colorado 66 and W . C . R . 13 in
rural Weld County , do wish to make our protest known with
one voice to your Commission .
We are opposing the proposed egg farm for the
following reasons :
1 ) The oppressive odor and dust problems associated
with other chicken farms in the area would be
extremely critical in this rather high residential
rural setting .
2 ) There has historically been a water pressure
and water shortage problem in this area . We
do not feel the developers have proven they wil
have adequate water for the normal operation
watering 1 , 000 , 000 chickens as well as having
sufficient pressure in case of a fire . We also
feel the residents in the area will suffer from
a lack of water and pressure as a result of this
development .
3) The intersection of Cblar.ado :66add_.WcC . R .. 13 . is
a dangerous one with fatality accidents having
occurred there in the past , and with a nearly
weekly occurance of accidents at the present time .
The added burden of 5 to 10 semi -trucks as
well as 35 to 50 passenger cars using this
intersection daily with no plans for upgrading
the intersection will place we residents in
an unacceptably dangerous situation .
4) We also reject this planned development from
an aesthetic standpoint. We would rather not have
the chicken barns and dust and odor in place of
the beautiful and productive farm that is there
at the present time .

5 ) We also feel that the owner of the farm ,
The Morman Church , is showing a great lack
of concern with the community in which it ' s
property is located . We feel that any decision
that is made out of Salt Lake City , Utah ,
as this decision to sell this farm to the
Boulder Valley Egg people was made , cannot
possibly have the concerns of the neighborhood
at heart.
In conclusion , we feel that another buyer will come along
for the Morman Church , and we also feel that the Boulder
Valley Farm people will find a more suitable piece of property
and that no financial harm will come to either party if you
see fit to honor our wishes and deny this petition for
a special use permit .
