Subject: USR-1502 and USR-1503 Referral
Upon review of my case files and computer, an open Violation (VI-0400244) and a new Building Permit
application (BCS-040255)were noted. The Building Permit is for a 2160 sq ft new single family dwelling, an
attached garage, a porch and a patio. My records indicate that the Building Permit has not been issued.
Furthermore, this violation was presented to the Board of County Commissioners, through the violation
process on January 11, 2005. At that time the Board referred the case to the County Attorney's Office, but
delayed legal action for 30 days to allow Mr. Lafferty adequate time to complete and submit this Use by
Special Review application.
This Use by Special Review application, if approved, will bring the property into compliance. If denied, the
number of animal units shall be reduced to no more than 4 (four) per acre; otherwise, the Violation case will
proceed accordingly in District Court.

Plans Examiner with the Building Inspection Department.

Environmental Health Services has reviewed this proposal for single family dwelling.
We have no objections to the proposal, however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to issuance of building permits:
1. A stormwater discharge permit may be required for a
-- development/redevelopment/construction site where a contiguous or non-
contiguous land disturbance is greater than or equal to one acre in area. Contact
the Water Quality Control Division of the Colorado Department of Public Health
and Environment at www.cdphe.state.co.us/wq/PermitsUnit for more information.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed home and
shall be installed according to the Weld County Individual Sewage Disposal
Regulations.
2. The septic system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2 No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3 Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4/. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
ffl This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S., as amended.
,VAdequate handwashing and toilet facilities shall be provided.
/7 Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
B. The facility shall utilize the existing public water supply. (Left Hand water District)
9. The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our
comments and requirements are as follows:
COMMENTS:
Scott's Acres is a rural subdivision located in the southwest corner of Weld County adjacent to WCR 12 and
WCR 7. The internal roads consist of Peak View and Bruce Road. The access to the proposed USR will be
from Peak View. It is designated on the Weld County Road Classification Plan (FHU) as a local gravel
subdivision road, which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-
'ay. The road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County
...,ode, Chapter 23, Article Ill, Section 23-3-50, the required setback is measured from the future right-of-way
line.
REQUIREMENTS:
The applicant shall utilize the existing residential access to the parcel as shown on the plat drawing.
The access drive shall be surfaced with gravel, asphalt, concrete, or the equivalent and shall be graded to
prevent drainage problems.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

Prime Farmland:
The soils are prime farmland if irrigated. The request is not to take the entire area out of agricultural
production, but to build a second home on the property.

The following letter address the concerns contained in your response to Weld County
planning Dept. in regards to USR-1502/1503. The recommendations by your depart-
ment will be accomplished with the following.
1. All grass and pasture area will be thoroughly searched to reduce the
disturbance of any ground nesting birds.
2. All equipment will be cleaned prior to leaving the area to reduce spread of
weeds, and areas disturbed due to construction will be reseeded to reduce erosion.
3. There are no black-tailed prairie dogs on the property.

Dear Ms. Martin:
I have reviewed the submitted material pertaining to the Site Specific Development Plan and Special
Review Permit for the addition of a second single family home on a single lot with an existing single family
home at 4702 Peak View (Case Number:USR-1502). The Fire District does not object to the request,but
does have the following comments and requirements for the new residence being installed or constructed
on the lot:
• All construction shall be in accordance with the provisions of the Fire Code, as ratified by the Weld
County Commissioners,and all other codes and ordinances,as enforced by Weld County.
• Water supply for fire protection may be required for a new dwelling. Water supply for fire protection
is not required for a single-family residence that is not larger than 3,600 gross square feet. If a
residence exceeds 3,600 gross square feet water supply for fire protection requirements apply. All
other structures may require water supply for fire protection depending on the use of the new structure.
• If the required water supply is not available from fire hydrants in the area, the installation of a
residential fire sprinkler will be accepted as an alternative to meeting the required fire flow. If a fire
sprinkler system is proposed, plans for the fire sprinkler system must be submitted to the Fire District
for review and approval prior to installation. At least two copies of plans must be submitted for
review. Submittals must include specifications on all devices to be installed.
• Approved address numbers shall be placed on the residence or a freestanding sign at the entrance to the
property in such a position to be plainly visible and legible from the street fronting the property.
Address numbers or letters shall contrast with their background.
Nothing in this review is intended to authorize or approve of any aspect of this project that does not comply
with all applicable codes and standards. We appreciate being involved in the planning process. Should you

Dear Ms. Martin,
Thank you for the opportunity to comment on a Development Plan and Special Review Permit that is proposed for
Lot 8 of Scott's Acres. The applicants are Chad and Angela Lease,and Michael Lafferty. The location of the
property is south of and adjacent to Bruce Road, and east of and adjacent to Peak View in Weld County.
The applicants are proposing to build a second home(2736 square feet)on the south half of their property,and to
increase the number of livestock allowed on the north half of the lot to approximately 150 calves. The property has
maintained residential and agricultural activities for the past 34 years, and these uses will continue under the
proposed plan. The total acreage impacted by this proposal is 7.42.
Pasture and grassland habitats often contain ground nesting birds, which can be disrupted by construction and
earth-moving activities. The Colorado Division of Wildlife recommends that earth-moving activities be suspended
between the months of April-August, unless no ground nests are found at the site after a thorough search.
The introduction and spread of weeds is a concern at construction sites. We recommend that equipment and
machinery used in this project be cleaned and inspected for weeds and seeds before entering the project area. The
equipment should also be cleaned and re-inspected before leaving the site. Re-vegetation of disturbed areas with
native plants will help control soil erosion and benefit wildlife.
If black-tailed prairie dogs are found at the proposed residence site,they should be live relocated or humanely
euthanized before earth-moving occurs. Further information about prairie dogs is available from the Colorado

USR-1502
1. A separate building permit shall be obtained prior to the construction of any building.
2. A plan review is required for each building for which a building permit is required. Two complete sets of
plans are required when applying for each permit. Residential building plans may be required to bear the wet
stamp of a Colorado registered architect or engineer. Provide plans to Mountain View Fire Protection District
for their review and approval.
3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit
application. Current adopted codes include the 2003 International Residential Code; 2003 International
Building Code; 2003 International Mechanical Code; 2003 International Plumbing Code; 2003 International
Fuel Gas Code; 2002 National Electrical Code and Chapter 29 of the Weld County Code.
4. Each residential structure will require an engineered foundation based on a site-specific geotechnical report
or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be
designed by a Colorado registered engineer.
5. Fire resistance of walls and openings, construction requirements, maximum building height and allowable
areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning
Ordinance.
6. Building height shall be measured in accordance with the 2003 International Building Code for the purpose
of determining the maximum building size and height for various uses and types of construction and to
determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height
shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance
with offset and setback requirements. When measuring buildings to determine offset and setback
requirements, buildings are measured to the farthest projection from the building. Property lines shall be
clearly identified and all property pins shall be staked prior to the first site inspection.
