HomeMy WebLinkAbout20051603 HEARING CERTIFICATION DOCKET NO. 2005-44 RE: HEARING TO SHOW WHETHER GOOD CAUSE EXISTS FOR REVOCATION OF SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#494 FOR A PALLET CONSTRUCTION BUSINESS IN THE A(AGRICULTURAL)ZONE DISTRICT- NANCY KALLSEN AND MICHAEL SAGEL A public hearing was conducted on June 15, 2005, at 10:00 a.m., with the following present: Commissioner William H. Jerke, Chair Commissioner M. J. Geile, Pro-Tern Commissioner David E. Long Commissioner Robert D. Masden Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Jacqueline Hatch Health Department representative, Char Davis Public Works representative, Donald Carroll The following business was transacted: I hereby certify that pursuant to a notice dated May 27, 2005, and duly published June 1, 2005, in the Fort Lupton Press, a public hearing was conducted to show whether good cause exists for revocation of Site Specific Development Plan and Use by Special Review Permit#494 for a Pallet Construction Business in the A (Agricultural) Zone District issued to Warren and Gearlene Capehart and currently held by Nancy Kallsen and Michael Sagel. Lee Morrison,Assistant County Attorney,made this a matter of record. Jacqueline Hatch, Department of Planning Services,stated the original permit was approved by the Board of County Commissioners on June 2, 1982, and she gave a brief description of the location of the site. She stated the issue is whether the property owners are in compliance with Section 23-2-200.E, which she read for the record. Ms. Hatch stated staff has not received correspondence from Michael Sagel, owner of Lot A; however, Nancy Kallsen, owner of Lot B, has requested Use by Special Review Permit #494 be vacated. She stated because Mr. Sagel could not be contacted, she did not feel comfortable entering the property to take photographs; however, while inspecting the Kallsen property for a Recorded Exemption application, she did note that there is no pallet construction operating on Lot A. Responding to Chair Jerke, Mr. Morrison stated even if Mr. Sagel had responded, vacating the permit does require action of the Board. No public testimony was offered concerning this matter,and Chair Jerke noted Ms. Kallsen and Mr. Sagel were not in attendance. Commissioner Geile moved to revoke Site Specific Development Plan and Use by Special Review Permit #494 for a Pallet Construction Business in the A (Agricultural) Zone District issued to Warren and Gearlene Capehart and currently held by Nancy Kallsen and Michael Sagel, based on the recommendation of the Planning staff that the site is not in compliance with Section 23-2-200.E 2005-1603 1/ PL0498 HEARING CERTIFICATION - NANCY KALLSEN AND MICHAEL SAGEL (USR #494 SHOW CAUSE) PAGE 2 of the Weld County Code. The motion was seconded by Commissioner Vaad, and it carried unanimously. There being no further discussion, the hearing was completed at 12:00 p.m. This Certification was approved on the 20th day of June 2005.
