HOHNER, 3398 WELD COUNTY ROAD 4 , ERIE, COLORADO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 20th day of May, 1981 at the hour of 2: 00 o ' clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the application of Kenneth D. Hohner, 3398 Weld County Road 4 , Erie, Colorado, for a Special Use Permit for a manure composting facility on the following described real estate, to-wit: Zot 3, Block 2 , Ranch Eggs Subdivision, 2nd filing, a subdivision located in the _Northwest Quarter of Section 34, Town- ship 1 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS, the petitioner was present, and WHEREAS, evidence was presented in support of the granting of the Special Use Permit for a manure composting facility on the above described real estate, and WHEREAS, Section 3. 3 (E) (2) of the Weld County Zoning Resolu- tion authorizes such a use in an Agricultural Zone District upon approval by the Board of County Commissioners , and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those pre- sent, has studied the request of the petitioner and the recom- mendations of the Weld County -Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Special Use Permit for a manure composting facility on the hereinabove described real estate conforms to the purposes of Section 3 . 3 (E) (2) of the Weld County Zoning Resolution. 81O175 NOW, WHEREFORE, BE IT RESOLVED by the Board of County Com- -missioners of Weld County, Colorado that the application of Kenneth -J. Lee Morrison reminded the Board that on May 6 , 1981, the Board, at their 2 : 00 PM hearing, had a heraing on a SUP request from Mr. Rohner for a man composing facility. Also, in conjunction with this facility, was an application by the same man for an egg laying facility on the same premis The Board approved the application for an egg laying facility, but contin the application for the manure composting facility because of a question of possible improper notice of the hearing. An attorney by the name of P Vranisie, appearing on behalf of a property owner by the name of Mihelich indicated that his client did not receive notice of the manure composing facility hearing and requested that the Board continue the hearing so that he would have an opportunity to present evidence in opposition, if his clients so desired. The Board then continued the hear to 2 : 00 PM on May 20, 1981. Mr. Vranisie was not present today nor has he communicated with any of the involved departments since the May 6 , 1981 hearing. Commissioner Kirby made a motion to approve the SUP for a manure composting facility for Kenneth Rohner with the development standards a recommended by the Planning Commission. Commissioner Carlson seconded the motion and it carried unanimously. The Planning Commission recommendations for approval is conditional upon the following: 1. The attached Development Standards being recommended and adopted for the Special Use Permit. 2. No building or electrical permits shall be issued on the Special Use Permit area until the attached Development Standards for the Special Use Permit have been placed on the Special Use Permit plat and said plat has been delivered to the office of the Department of Planning Services. JM:rg 4/14/81 DEVELOPMENT STANDARDS SUP 462:81:8 1. The use permitted on the hereon described parcel shall be an egg production facility with a Brill Digester and Duall Fume Scrubber to compost chicken manure. Facilities shall be limited to those shown hereon and all other uses permitted by right in the Agricultural Zone District of the Weld County Zoning Resolution. 2. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds,. 3. All accesses shall have the approval of the Weld County Engineering Department. All accesses shall be constructed in accordance with the recommendations and or requirements of the Weld County Engineering Department. 4. An opening shall be installed in the 8000 gallon underground storage tank for fire protection purposes. 5. All phases of the operation shall comply with all County and State Health Stand- ards and Regulations pertaining to air quality, water qualtiy, noise enission,- and sanitary disposal systems. The applicant must obtain an air emissions -. permit for the "Brill Digester" and Duall Scrubber Unit from the Air Pollution Control Division, Colorado Department of Health, 4210 E. 11th Avenue, Denver, CO 80220. The facility must comply with the Air Quality Control Regulation No. 2, which deals with odors. Odors must not exceed the 7: 1 Dilution to Threshold ratio measured off the property. The facility must comply with Colorado Noise Regulations (25-12-103) and specifically to the residential noise requirements. The contaminant scrubbed in the Duall unit must be contained in a structure, preferable enclosed, until it can be applied, as proposed, to fields or back to the final dried compost. Flies and fly breeding must be controlled year- round. 6. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Reg- ulations. Any material deviations from the plans and/or Development Standards, as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commis- sioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Deaprtment of Planning Services. 7. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Development Standards. Non-compliance with any of the above stated Development Standards may be reason for revocation of the Special Use Permit by the Board of County Commissioners. • COMMENTS Kenneth and Sherry Hohner SUP-462:81 :8 To date our office has not received any letters of objections from any surrounding property owners. The Brighton Soil Conservation District has not responded to the referral sent to them. Its effect on the immediate area and its effect on the future development of the area and its effect on the health, safety and welfare of the inhabitants of the area and the county, these items are addressed in the Conditions Planning Commission Summary April 7, 1981 Page 2, Tape 53 - Side 1 and in the Development Standards in the record. Added to the motion, the first sentence in the Development Standard number 8 be deleted. Motion passed with Ehrlich, Billings, Holman, Kiefer, Kountz, Wafel , and Otis voting for and none against. It is emphasized that this is a completely odorless process that converts the manure into compost entirely by bacterial action with- out the application of any external heat and is not related in any way to the drying and dehydration process that has been used in the County and State in the past, which operated through the application of heat driving off moisture and gasses which were emitted to the atmosphere. This process, entirely through bacterial action, will, within 48 hours, convert raw manure into an odorless, fluffy, dry organic compost-soil conditioner. The process takes place within a closed system with no odor or fumes what-so-ever being emitted to the atmosphere. Any fumes that may be produced within the composting chamber are vented through a closed duct to a "Duall Scrub Tank' that removes all fumes and odor, preventing any pollution of the air and making this an entirely odorless process. The "Brill Digester" was perfected about two years ago and has been put into use in other States during this period. It is presently meeting successfully the air quality standards in Minnesota, Wisconsin, Michigan, Indiana, Kentucky, North Carolina, Florida, Conneticut and California. The process and equipment further meets all guidelines established by the Environmental Protection Agency. The proposed operation would require one or two full time employees in addition to the family, and it would process manure from our own hen barns located on the property. In addition, as there would be excess capacity, I would plan on obtaining additional manure from other chicken operations in the area, until capacity of the equipment is reached. However, this would involve no outside storage of manure, and manure would only be accepted, as the composter is avaiable, directly from hen barns being cleaned. The final composted material would be disposed of by selling to greenhouses, farms and users of organic soil conditioners, within and outside the State. The bulk of the material would be sold to a firm with a nation wide outlet for organic compost. There would be no significant noise created as all equipment is operated by electrical motors. The facility would create no undue fire or safety hazzards as the building is of metal construction and the composted product is non combustable. There would be no significant increase in traffic in the area, with any anticipated increase not exceeding 2-3 vehicles per day. The proposed facility will consist of 6 units, being 4 digesters or composters and 2 drying units housed in a building approximately 50 feet by 150 feet. • • Supplement to Application For Special Use Permit Lot 3, Block 2, Ranch Eggs Subdivision Filing 2 Waste Disposal There would be no waste associated with the facility, for which application for a Special Use Permit is made, as the process itself converts animal waste into a usable product. The only by- product is relatively small quantities of water from the Duall Scrub Tank which can be applied to local fields as fertilizer or returned to the final dried compost. The solution from the scrub tank is saturated with Nitrogen, but no longer in the form of ammonia, but as another Nitrogen compound which is odorless . Therefore whether used as a liquid fertilizer or to increase the Nitrogen content of the compost no odor is created. . . Method of Supplying Water There is very little water required for the process as all water for the Scrub Tank is obtained from the composting process itself, being removed from the manure. However, the facility is located on property presently being supplied water through a tap meter by North Huron Water Company. The facility would be connected to the water system on the property for any minor water needed. Roads and Maintainance The property described in the application is served by Weld County Road 4, which is in good repair requiring no improvements or maintainance over that currently provided by Weld County. PROCESS SUMMARY The Brill Digester System employs a natural aerobic composting process' utillging the thermophilic range of 'bacterial action to decompose poultry or animal manure. In the composting process the waste material to be processed is mixed with a carbonaceous material which can be, among other things, sawdust, ground corn cobs, rice hulls, shredded paper, hay or straw as a filler. The filler material amounts to about 30% to 55% of the mixture, and is the governing factor in obtaining the. correct moisture content and carbon/nitrogen ratio on which the process is dependent. The system utilizes covered wood boxes having m►xing mechanisms to entrain air. The System consists of a two phase approach; a digesting phase and a drying phase. The digesting phase is about 48 hours in duration, during which the temperature will rise to 160°-180° F. During this phase, the air flow through the mechanical digestion unit provides 1 of 3 t ' _. • • •• oxygen to the aerobic bacteria and collects noxious gases and fumes which are removed by a scrubber prior to being vented into the atmosphere. The digesting phase is completed when the air temperature from the units decreases, indicating that the organics have been decomposed or stabilized. The drying phase is accomplished in a mechanical drying unit, similar to the digester, in which the warm, moist, digested mixture is turned at a relatively high rate into air passing over and through the mixture. The best product Is obtained by drying the material to a 15% to 20% moisture, a process that takes 4 to 12 hours. u POLLUTION ABATEMENT* , This Brill Digester System, as described, is in furtherance of the purpose of abating air and water pollution and solid waste disposal in the following ways: • r A 1 . Runoff - When rev manure is scattered or stockpiled, storm runoff from such areas can reach a stream and cause a pollution problem. The Brlll 'Process of composting of the manure stabilizes the organics, allowing the composted manure to be scattered or stockpiled without the fear of a runoff pollution problem. 2. Air Pollution - When raw manure is stockpiled, 1t decomposes anaerobically, creating noxious odors. These odors, often detectable from great distances, can create a nuisance. Composted manure does not give off noxious odors. There are odors given off during the composting process, however, since they are confined, they can easily be controlled. A gas scrubber can be used to control these odors, of which the major component is ammonia. The gas scrubber would utilize an acid solution for adsorption of ammonia. The spent solution can then be returned to the final composted and dried material . Odors are also given off when raw manure is applied .to fend. Since the composted material Is essentially odorless, the problem would be eliminated. • 2 o 3 • 3. Disease Vectors — When raw manure is scattered or stockpiled it attracts files and becomes a medium for pathogen survival . The thermophil lc composting process, add its associated high temperatures, destroys fly larvae and most pathogens. The final compost material is one free of harmful pathogens and also will not attract flies. The reduction of disease vectors also enhances the utilization of the protein value of the compost as a feed supplement. 4. Soil Conditioner - The composted manure and filler makes a . better soil conditioner than the raw manure alone. The high temperatures associated with the process destroys all weed seeds and the filler provides bulk to the end product, which is most beneficial in soil conditioning. The composted mixture .can be marketed in bags for use in gardening or in bulk for use on farm fields. • 5. I have made an administrative decision to allow conduct of a temporary test of a smaller scaled version of the permitted equipment for a specified brief duration. While it would be desirable if your test could be made on the permitted property, it would be unreasonable to expect you to construct a building just to conduct the test. I feel there are two primary reasons why the testing is accept- able: 1. The process (on a larger scale than the planned test) has been given a permit which recognizes that under specific standards the use is accept- able for the neighborhood. Because the test is within the same neighborhood and will only last 120 days at the proposed location, no unreason- able effects should result; and 2. The site to be utilized is part of a feed mill processing facility. While the "animal waste processing" use is recognized as a separate acti- vity from feed mills, similarities of equipment and processes do exist. Therefore, the "Brill Digester" test will not be dramatically dissimilar to facilities and processes which could occur on the site. • Kenneth D. I feel that the time can begin the first of Janu- ary and expire by the last day of April, 1982 . If the testing results in violation of the Colorado Department of Health Regulations, I would ask that the operation be stopped until modifications are made to correct the deficiencies; 3 . I have requested that DeKalb , the marketer and distributor of the equipment provide me with the use of one machine, for a period of four months, to operate and produce product for testing and study. As of today, DeKalb has approved my request and I will have a machine in the near future, possibly as early as the week od December 21. However, it is essential that, for the process to work properly, the equipment must be located within a closed building. At the present time I do not have such a building on the property for which the Special Use Permit was issued, and because of the large expense involved, I am reluctant to erect such a building before knowing that the equipment will perform as claimed by the manufacturer and the distributor. ! • Therefore I am requesting approval and permission of the Weld County Planning Board and the Weld County Commissioners to temporairly place, for a period not to exceed 120 days from the date of instillation, a "Brill Digested" Composting machine in an existing building on Lot 8 , Block 3 , Filing 2, Ranch Eggs Subdivision, Weld County, for the express purpose testing and study of the product and the equipment to determine if it will meet the State of Colorado specifications relating to licensing of the product as an animal feed, regulations pertaining to Air Pollution and conditions relating to the Special Use Permit issued by Weld County. The only consideration I would ask to have , would be that on the 8000 gallon underground water storage tank, there be an opening or connection or some method we could use to get the water to a pumper in case of fire on this property. This could be accomplished by merely installing a removable 8 or 10 inch lid, having a 3 inch pipe from the bottom of the tank to the top with a cap on it or any number of no cost meth- ods. This would be of great assistance to us in the event of a fire on this property and in the event of our using this water for emergency, we would be willing to assist the owners in refilling the storage by tanker so as not to leave them without sufficient water for their operations.
