HomeMy WebLinkAbout20050758.tiff HEARING CERTIFICATION RE: VIOLATIONS OF THE WELD COUNTY CODE -ZONING AND BUILDING INSPECTION A public hearing was conducted on March 8, 2005, at 10:00 a.m., with the following present: Commissioner William H. Jerke, Chair Commissioner M. J. Geile, Pro-Tem Commissioner David E. Long Commissioner Robert D. Masden - EXCUSED Commissioner Glenn Vaad - EXCUSED Also present: Acting Clerk to the Board, Sharon Kahl County Attorney, Bruce Barker Planning Department representative, Bethany Salzman Planning Department representative, Peggy Gregory Planning Department representative, Ann Siron Building Inspections Department representative, David Williamson The following business was transacted: I hereby certify that a public hearing was conducted to consider whether to authorize the County Attorney to proceed with legal action against the individuals named for violations of the Weld County Zoning Ordinance. Cases were heard as follows: VI #0400299 - GRINDE: Peggy Gregory, Department of Planning Services, presented the case report for the record and pursuant to the case file,this property is in violation of Sections 29-3-280, and 29-8-40 of the Weld County Code. To bring the property into compliance, all inspections must be completed and a Certificate of Occupancy issued. Ms. Gregory stated there has been work completed on the exterior of the home; however, no interior work has been noted and the mobile home has been removed from the site. Homer Grinde, property owner, submitted pictures to the Board, marked Exhibit B, and stated that he has continued to work on this project as time allows, and the interior of the home will be done this summer when he can schedule around farming duties. Mr. Grinde stated he does have the drywall purchased and it is inside the building. Responding to Commissioner Jerke, Mr. Grinde stated he should have this project completed in November, 2005. Responding to Commissioner Jerke, David Williamson, Building Inspections Department, stated there are two concerns with extending the permit for six months. There has been progress on the exterior of the building; however,the interior has had no work done, and the rough inspections for plumbing, electrical and any mechanical has not been scheduled. Mr. Grinde is living in the basement without a Temporary or Certificate of Occupancy issued. Responding to Commissioner Jerke, Mr. Williamson stated there has been substantial improvement. Responding to Commissioner Geile, Mr. Grinde stated he should be able to schedule a rough-in inspection in the near future. 2005-0758 PL0824 co , /p L, Q3 �1aS Commissioner Geile moved to refer VI #0400299 against Homer Grinde to the County Attorney for legal action, with the instruction to delay action upon such referral until September 13, 2005, to allow adequate time for all inspections to be completed and a Certificate of Occupancy issued. The motion was seconded by Commissioner Long, and it carried unanimously. VI #0400333 -CASTRUITA: Bethany Salzman, Department of Planning Services, presented the case report for the record and pursuant to the case file, this property is in violation of Sections 23-3-20, 23-3-30, 23-3-30.1, 23-3-40, 23-3-40.B, 23-3-40.B.16, 23-3-50, 23-3-50.D, and 29-3-10 of the Weld County Code. To bring the property into compliance, the number of animals must be reduced to four horses and/or cows or three horses and/or cows and fifty chickens, and all structures over 120 square feet require Building Permits, and the noncommercial junkyard must be restored, removed, or screened from all adjacent properties and public rights-of-way. Ms. Salzman stated the certified mail was returned unclaimed from both the property owner and the tenant.The Weld County Sheriff's Office posted the notice on February 23, 2005, and also another notice was sent to the post office box on that date. Neither the property owner nor a representative was present, and there was no public testimony given. Commissioner Geile moved to refer VI#0400333 against Jose and Nadine Castruita to the County Attorney for immediate legal action. The motion was seconded by Commissioner Long, and it carried unanimously. VI #0400053 - MORALES: Ms. Gregory presented the case report for the record and pursuant to the case file, this property is in violation of Section 29-8-40 of the Weld County Code. To bring the property into compliance, all inspections must be completed on the arena. Ms. Gregory stated the certified mail has been returned unclaimed and a copy of the notification was hand delivered to the handyman. The property owners have made no effort to contact the Planning Department. Responding to Commissioner Geile, Ms. Gregory stated this property came into violation when no inspections were completed on the Building Permit for the arena. Neither the property owner nor a representative was present, and there was no public testimony given. Commissioner Long moved to refer VI#0400053 against Jose Morales to the County Attorney for immediate legal action. The motion was seconded by Commissioner Geile, and it carried unanimously. VI #0400090 - PRESTON RANCH MINISTRIES INC: Ms. Gregory presented the case report for the record and pursuant to the case file, this property is in violation of Sections 29-7-130, and 29-8-40 of the Weld County Code. To bring the property into compliance, the mobile home must be removed, or all inspections completed and a Certificate of Occupancy issued. Ms. Gregory stated the mobile home was brought in as a temporary structure while eight houses were being built on this site; however, only two homes have been built and no inspections have been completed on the mobile home. Bob Corelius, property owner, stated the mobile home is used for the kitchen and bedrooms while the utility building is being completed. Mr. Corelius stated the mobile home would cost $3,500.00 to bring into compliance, and he would rather put that money toward finishing the utility building which is next to the trailer. Responding to Commissioner Geile, Mr. Corelius stated the utility building will be used for schooling and recreation and will have a kitchen area. The building measures 40 x 60 feet with a tall roof. Mr. Corelius stated they have been out of state for a year and were unaware of the permits needed. Mr. Corelius stated he will work with the Department of Planning Services to complete what is needed. Responding to Commissioner Jerke, Ellen Corelius, property owner, stated they need the mobile home for lodging groups that come in from out of state, and will need it through the summer. Commissioner Jerke suggested that the utility building could meet that need if a kitchen and the plumbing were put in, rather than fixing up the mobile home. Responding to Commissioner Geile, Ms. Gregory stated the main issue in this violation is that no inspections have been done and there has been no response to notifications. The mobile home is being used other then a temporary occupancy until construction is complete, and the health and safety issues need to be addressed by the Building Inspections Department. Mr. Williamson stated he has not been able to inspect the mobile home or the utility building, and his concern is the sanitation, electrical safety, and whether the structure is secure to the ground. There have been no inspections done on that site. Commissioner Long moved to continue VI #0400090 against Preston Ranch Ministries Inc. until September 13, 2005, to allow adequate time for the mobile home to be removed, all inspections completed, and a Certificate of Occupancy issued. The motion was seconded by Commissioner Geile, and it carried unanimously. VI #0400005 - FERRY/HAISLIP: Ms. Salzman presented the case report for the record and pursuant to the case file, this property is in violation of Sections 23-3-20, 23-3-30, and 23-3-30.1 of the Weld County Code. To bring the property into compliance, the noncommercial junkyard must be restored, removed, or screened from all adjacent properties and public rights-of-way. Ms. Salzman stated Mr. Haislip contacted her and asked that this case be continued for thirty days to complete the work needed. Neither the property owner nor a representative was present,and there was no public testimony given. Commissioner Geile moved to refer VI #0400005 against Edna Ferry and Roberta Haislip to the County Attorney for legal action, with the instruction to delay action upon such referral until April 8, 2005, to allow adequate time for the noncommercial junkyard to be restored, removed, or screened from all adjacent properties and public rights-of-way. The motion was seconded by Commissioner Long, and it carried unanimously. VI #0400300 - BYRD: Ms. Salzman presented the case report for the record and pursuant to the case file, this property is in violation of Sections 23-3-20, 23-3-30, 23-3-30.1, 23-3-40, 23-3-40.O, and 23-3-40.R of the Weld County Code. To bring the property into compliance, the noncommercial junkyard must be restored, removed, or screened from all adjacent properties and public rights-of-way, and the commercial vehicle must be removed or permitted through a zoning process. Responding to Commissioner Jerke, Ms. Salzman stated the property is being used for a business, Bill's Towing, and the Byrd's have been owners since April, 2005. Neither the property owner nor a representative was present, and there was no public testimony given. Hearing Certification, Zoning Violations March 8, 2005 2005-0758 Page 3 PL0824 Commissioner Long moved to refer VI #0400300 against William and Lisa Byrd to the County Attorney for immediate legal action. The motion was seconded by Commissioner Geile, and it carried unanimously. VI#0400335-BURRY: Ms. Salzman presented the case report for the record and pursuant to the case file, this property is in violation of Sections 23-3-20, 23-3-30, 23-3-30.F, 23-4-130, 23-4-140, 23-3-170, and 23-4-170.D of the Weld County Code. To bring the property into compliance, the mobile home must be removed or permitted. Ms. Salzman stated she received a Zoning Permit for a mobile home application on March 4, 2005, and is requesting that this case be referred back to the Department of Planning Services. Commissioner Geile moved to refer VI #0400335 against Rhonda Burry back to the Department of Planning Services. The motion was seconded by Commissioner Long, and it carried unanimously. VI #0400292 - STEPHENS: Ann Siron, Department of Planning Services, presented the case report for the record and pursuant to the case file, this property is in violation of Sections 23-3-20, 23-3-30, and 23-3-30.1 of the Weld County Code. To bring the property into compliance, the noncommercial junkyard must be restored, removed, or screened from all adjacent properties and public rights-of-way. Ms. Siron stated she was unable to contact the property owners of the violation hearing date and is requesting that this case be continued for thirty days. Neither the property owner nor a representative was present, and there was no public testimony given. Commissioner Long moved to continue VI #0400292 against Patsy Stephens until April 12, 2005, to allow adequate time for the property owner to be notified of the violation hearing date. The motion was seconded by Commissioner Geile, and it carried unanimously. VI#0400341 -KLINE: Ms. Siron presented the case report for the record and pursuant to the case file, this property is in violation of Sections 23-3-150, 23-3-150.B, 23-3-150.C, and 23-3-150.D of the Weld County Code. To bring the property into compliance, the noncommercial junkyard must be restored, removed, or screened from all adjacent properties and public rights-of-way, and the recreational vehicle must be disconnected from all utilities and maintain current license plates at all times. Neither the property owner nor a representative was present, and there was no public testimony given. Commissioner Geile moved to refer VI #0400341 against Richard and Janet Kline to the County Attorney for immediate legal action. The motion was seconded by Commissioner Long, and it carried unanimously. VI #0300227 - WROBLEWSKI: Ms. Salzman presented the case report for the record and pursuant to the case file, this property is in violation of Sections 23-3-20, 23-3-30, 23-3-30.D, 23-3-40, 23-3-40.0, and 23-3-40.R of the Weld County Code. To bring the property into compliance, the number of semi trailers must be reduced to one, and the conditions prior to approval of the Home Occupation must be completed. Ms. Salzman stated she spoke with Mr. Wroblewski on March 7, 2005, and he is requesting this case be continued for thirty days. Neither the property owner nor a representative was present, and there was no public testimony given. Hearing Certification, Zoning Violations March 8, 2005 2005-0758 Page 4 PL0824 Commissioner Long moved to continue VI #0300227 against Donald and Joe Wroblewski until April 12, 2005, to allow the property owners to be present at said hearing. The motion was seconded by Commissioner Geile, and it carried unanimously. VI #0400325 - WROBLEWSKI: Ms. Salzman presented the case report for the record and pursuant to the case file, this property is in violation of Sections 23-3-20, 23-3-30, 23-3-30.D, 23-3-40, and 23-3-40.R of the Weld County Code. To bring the property into compliance, the commercial vehicles must be removed or appropriately permitted. Ms. Salzman stated this property is connected with VI #0300227 and requests that it also be continued for thirty days. Neither the property owner nor a representative was present, and there was no public testimony given. Commissioner Long moved to continue VI #0400325 against Donald Wroblewski until April 12, 2005, to allow the property owner to be present at said hearing.
