Dear Fellow Planning Commissioners:
Thank you for the opportunity to review and comment upon the proposed change of
zoning. The Fort Lupton Planning Commission met on September 14, 2004 and
reviewed the application. As a result of that review, we offer the following comments
and concerns relative to the Coordinated Planning Agreement, and other applicable Plans
and Policies of the City.
1. Roadway Impacts -The Fort Lupton Transportation Plan shows Weld County Road
27 as an arterial with 120 feet for right-of-way. The proposal does not include any
dedication of right-of-way or construction of public improvements. If the development is
to be approved,the Commission recommends that 120 feet be dedicated now rather than
in the future, and expansion and improvement should occur concurrently with this
industrial development. WCR 27 is a narrow two-lane road without emergency lanes,
shoulders or turn lanes. If this type of development continues to be approved along the
WCR 27 corridor, as we have seen with recent Agricultural to I-3 re-zonings, the road
will soon become inadequate to serve the industry and the citizens of Weld County. It is
the position of the Commission that development should not precede necessary roadway
improvements and development should be held accountable for its impacts.
2. Coordinated Planning Agreement- The subject site is outside of the City's Urban
Growth Area but within the Municipal Referral Area as defined by the Coordinated
Planning Agreement between the City and County. Section 3.2 of the Agreement states:

" To the extent legally possible the County will disapprove proposals for Urban
Development in areas of the Municipal Referral Area outside the Urban Growth Area."
It is the opinion of the Planning Commission that a rezoning will open the door to
development by-right, that will be urban in nature. If the rezoning is approved, the
County will no longer have the ability to ensure that the property is developed in
conformance with the Coordinated Planning Agreement.
3. Centralized Sewer- It is the opinion of the Commission that all industrial
development should be required to hook into a centralized sewer system in this area. A
central sewer system is the only practical way to ensure adequate wastewater treatment
for the life of the development. A central system is also the only means to ensure that
commercial and industrial businesses are accountable for waste that is put into the
system, or in this case the surrounding groundwater. A central sewer system such as the
City's is continuously monitored. Sources of toxic or hazardous waste can be identified,
isolated, and steps taken to prevent further contamination. The Coordinated Planning
Agreement rightfully recognizes that development requiring central sewer should not
occur in rural areas.
4. Public Input-It is the understanding of the Commission that a construction company
under a Use by Special Review permit is already using the property. The Commission
recommends that the zoning remain agricultural and that the applicant be required to go
through the same special review process. This will allow for public input from affected
property owners and from municipalities. I-3 zoning will allow the proposed use without
any public hearings or public input.

Commission desires to continue working with the County to provide opportunities for

NOTICE

To Whom It May Concern:
This is to notify you that land in the vicinity of property that you own is proposed for
annexation to the City of Fort Lupton and for zoning. The land, to be known as the Lupton
Lakes Addition, includes 373.30 acres+1- of property between State Highway 85 and County
Road 27, south of the current City boundary and north of County Road 6. Contiguity with the
City for this annexation will be achieved by annexation of approximately 2.34 miles of County
Road 27 (Fort Lupton's Denver Avenue), extending from the current southern City boundary to a
point approximately 960 feet north of the centerline of County Road 6.
A copy of the legal notice for this proposed annexation and a sketch showing the general
location of the property proposed for annexation, including County Road 27, is attached. Two
public hearings at the Fort Lupton City Hall, 130 S. McKinley Avenue, Fort Lupton, are
scheduled for this annexation as follows:

Owners of land adjoining the portion of County Road 27 that is proposed for annexation
are advised that they have the right by Colorado law to petition for annexation of such land and
for that land to be annexed at the same time as Lupton Lakes Addition. Such petitions for
annexation of adjoining property must be submitted to the City prior to a deadline 45 days
before the City Council hearing for the Lupton Lakes Addition annexation, Monday, November
29, 2004. Owners petitioning for annexation after that deadline would be considered on a
different schedule.

Public hearings have been scheduled for Tuesday December 14, 2004 at 7:00 p.m. with the Fort
Lupton Planning Commission, and Thursday, January 13, 2004 with the Fort Lupton City
Council. The purpose of the public hearings is to consider a request for Annexation and Zoning
to A (Agricultural) with a Special Use Permit for land to be known as Lupton Lakes Addition.
The proposed use of the property is gravel mining. The parcel consists of approximately 373.30
acres+/-i located west of Weld County Road 27, and south of the current Fort Lupton City
Boundary. The property is generally described as:
The Weld County Road 27 right-of-way, extending from the north boundary of Fulton Drive to a
point approximately 960 feet north of the centerline of Weld County Road 6.

A parcel of land, comprised of a portion of the E1/2 of Sections 18 and 19, Township 1 North,
Range 66 West of the 61°P.M. Weld County, Colorado, containing 356.32 acres+/-.
The hearings for annexation will be for the purpose of determining whether the area proposed to
be annexed meets the applicable requirement of Sections 31-12-104 and 31-12-105 C.R.S. The
public hearings will be held at City Hall, 130 S. McKinley Street in Fort Lupton. For additional
