RE: APPROVE MEMORANDUM OF UNDERSTANDING FOR THE SPECIAL EDUCATION
SERVICE AGREEMENT CONCERNING MIGRANT AND SEASONAL HEAD START
PROGRAM AND AUTHORIZE CHAIR TO SIGN - MESA COUNTY SCHOOL DISTRICT
51
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board has been presented with a Memorandum of Understanding for the
Special Education Service Agreement Concerning Migrant and Seasonal Head Start Program
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Human Services, Family
Educational Network of Weld County, and Mesa County School District 51,commencing June 30,
2005, and ending June 29, 2006, with further terms and conditions being as stated in said
memorandum, and
WHEREAS, after review, the Board deems it advisable to approve said memorandum, a
copy of which is attached hereto and incorporated herein by reference.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Memorandum of Understanding for the Special Education Service
Agreement Concerning Migrant and Seasonal Head Start Program between the County of Weld,
State of Colorado, by and through the Board of County Commissioners of Weld County,on behalf
of the Department of Human Services,Family Educational Network of Weld County,and the Mesa
County School District 51 be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said memorandum.
The above and foregoing Resolution was,on motion duly made and seconded,adopted by
the following vote on the 13th day of June, A.D., 2005.

COLORADO SUBJECT: Memorandum of Understanding for the Special
Education Service Agreement between Mesa County School District
51 and FENWC Migrant and Seasonal Head Start Program
Presented for approval before the Weld County Board of County Commissioners is the
Memorandum of Understanding for the Special Education Service Agreement between Mesa
County School District 51 and FENWC Migrant and Seasonal Head Start Program.
. Mesa County School District 51 is required to provide Special Education and related
services designated in a child's IEP.
. Mesa County School District and FENWC are required to provide ongoing training for
staff to increase their knowledge and ability to provide quality services to children with
disability.
. FENWC will refer children to Mesa County School District 51 or other community
resources to obtain appropriate diagnosis for children identified as "at risk."
. Coordinate the development of the IEP for children identified by Migrant Head Start with
diagnosed disabilities based on the evaluation information, IEP development to include
District 51 interdisciplinary team members.
. Work collaboratively with District 51 to develop cooperative staff training opportunities to
increase knowledge and ability to provide quality services to children with disabilities.

MEMORANDUM OF UNDERSTANDING
FOR THE SPECIAL EDUCATION SERVICE AGREEMENT
BETWEEN
MESA COUNTY SCHOOL DISTRICT 51
AND
FENWC MIGRANT AND SEASONAL HEAD START PROGRAM (2005)
This Agreement is between Mesa County School District 51 (hereinafter referred to as
LEA) and the Family Educational Network of Weld County Migrant and Seasonal Head
Start (hereinafter referred to as FENWC), for the period from June 30, 2005 to June 29,
2006.
I. PURPOSE STATEMENT
The purpose of this Agreement is to establish collaboration and working procedures
between the LEA and FENWC in the provision of services to Migrant and Seasonal Head
Start children eligible for special education services for 2005 in compliance with IDEA
(IDEIA 2005)(34 C.R.F. Part 300), Colorado Rules for the Administration of the
Exceptional Children's Education Act, and the Head Start Program Performance
Standards on Services for Children with Disabilities(45 C.F.R. 1308).
The intent of the Agreement is to:
1. Define which services will be provided by each Agency.
2. Ensure that migrant children eligible for special education services receive free
and appropriate public education, as required by law, in the least restrictive
environment.
3. Ensure that each Agency cooperatively maintains communication and shares
leadership responsibilities at the local level to ensure that available resources are
utilized in the most effective manner.
4. Ensure that cooperative arrangements between the LEA and FENWC are
developed, implemented, and persevered.
H. RESPONSIBILITIES OF FENWC
1. Recruit, enroll, and serve eligible Migrant and Seasonal Head Start children ages
6 weeks through 5 years. No less than 10 percent of the total number of
enrollment opportunities in the FENWC Migrant Head Start Program shall be
available for children with disabilities who are eligible to participate.
2. Screen all children within two weeks of enrollment for potential health problems
and/or developmental delays. FENWC will invite LEA staff to participate in
screenings. FENWC will participate in Child Find Activities under Part B, of
IDEIA, including but not limited to,participation in staffing/IEP development
meetings, annual reviews and transition planning.
3. Refer children to Mesa County School District 51 or other community resources
to obtain appropriate diagnosis for children identified as"at risk."
4. Coordinate the development of the IEP for children identified by Head Start with
diagnosed disabilities based on evaluation information, IEP development to
include District 51 interdisciplinary team members. IEP meetings will be held at
a location and time convenient for the parents and staff. Copies of the IEP will be
made available to District 51, FENWC and parents.
5. Place pre-school children with disabilities in the least restrictive environment.
6. Seek out additional resources in the community for children with disabilities as
needed.
7. Work collaboratively with District 51 to develop cooperative staff training
opportunities to increase knowledge and ability to provide quality services to
children with disabilities.
HI. RESPONSIBILITIES OF LEA
1. Locate, identify and evaluate children with suspected disabilities within the LEA's
jurisdiction who may be eligible for early intervention/special education and
related services, including highly mobile children, private school children and
homeless children.
2. Refer identified Head Start eligible children to FENWC for possible services.
3. Provide comprehensive evaluations of children with suspected disabilities by
appropriate personnel using appropriate instruments, and provide comprehensive
evaluations on children who may require special evaluations.
4. Coordinate the development of the IEP for children with diagnosed disabilities
based on evaluation information, IEP development to include Head Start families
and Head Start staff. IEP meetings will be held at a location and time convenient
for the parents and staff. Copies of the IEP will be made available to District 51,
FENWC and parents.
5. Provide special education services to identified Head Start children, including,but
not limited to school-readiness, audiology, assistive technology, family
training/counseling/home visits, health services, nursing services, nutrition
services, occupational therapy, physical therapy, psychological services, services
coordination, social work services, special instruction, speech-language pathology,
transportation and vision services.
6. Place pre-school children with disabilities in the least restrictive environment.
7. Place children in Head start if it is determined to be the least restrictive
environment by the IEP interdisciplinary team and the child meets Head Start
eligibility criteria.
8. Maintain documentation for in-kind purposes.
9. Work collaboratively with Head Start to implement needed specially designed
instruction to meet the unique needs of a child with a disability (content,
methodology and/or delivery of instruction).
IV. SPECIFIC PROGRAM SERVICE DELIVERY
1. Mesa County Valley School District 51 is required to provide Special Education
and related services designated in the child's IEP.
2. Documentation for in-kind purposes will be recorded.
3. The FENWC program is required to seek out related services in the community for
children with disabilities.
V. TRAINING AND TECHNICAL ASSISTANCE
1. Mesa County Valley School District 51 and FENWC are required to provide on-
going training for staff to increase their knowledge and ability to provide quality
services to children with disability.
2. Mesa County Valley School District 51 and FENWC may coordinate efforts by:
a. Developing a system for staff needs assessment in the area of training.
b. Coordinating training calendars.
c. Training staff regarding the regulations and program philosophy of each
agency.
d. Inviting staff from each agency to share training activities.
VI. COUNTING AND REPORTING
1. Mesa County Valley School District 51 and FENWC have systems for counting
and reporting children with disabilities.
a. Training staff regarding specific procedures and regulation for each
agency.
b. Developing a system so the time lines and persons responsible for
reporting are clear.
VII. TRANSITION PLANNING
In and effort to provide for a smooth transition from the preschool setting to a public
school setting the following will occur:
1. Prior to the child entering the public school setting,the pre-school staff and the
child's elementary teacher will meet to share strategies. Transition plans will be
developed jointly and at an IEP meeting or Annual Review,which takes place
prior to the transition meeting when the student exits from the FENWC to the
public school setting.
2. Information to parents regarding the differences in service delivery will be
provided jointly during the Transition Staffing of the child from FENWC to the
public school setting.
3. Placement alternative for students will be generated by the needs of the students as
indicated on their currant IEP and as presented and discussed jointly at the
Transition Meeting, with neither FENWC nor school personnel predisposing
parents to choices that have not been jointly discussed as possible alternatives.
XI CONFIDENTIALITY
1. Consent for Release of Information Forms that will assist FENWC and District 51
in providing optimal services will be generated and signed as each child is identified in
accordance with the Family Education Privacy Rights Act and the Health Insurance
Portability and Accountability Act.
XII MODIFICATION OF AGREEMENT
1. All modifications to this agreement shall be in writing and signed by both parties.
XIII. ASSIGNMENTS
1. This Agreement shall be binding upon the parties hereto,their successors,theirs,
and legal representatives.

Agreement to be duly executed as of the day and year first hereinabove set forth.
