RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST THOMAS AND SHERYL SEVCIK FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,Thomas and Sheryl Sevcik,VI#0500027, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 10th day of May, 2005, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Sheryl Sevcik, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until July 10, 2005, to allow adequate time for the property owners to remove the mobile home or a Use by Special Review application be submitted, and to restore, remove, or screen the noncommercial junkyard to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that VI #0500027 be, and hereby is, referred to the Weld County Attorney's Office for legal action against Thomas and Sheryl Sevcik to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, with an instruction for delay of action upon such referral until July 10, 2005, to allow adequate time for the property owners to remove the mobile home or a Use by Special Review application be submitted, and to restore, remove, or screen the noncommercial junkyard from all adjacent properties and public rights-of-way to bring the subject property into compliance. 2005-1393 PL0824 CO : et, vWve-. I understood that it would need to be gone this year. At the beginning of Sept. My husband and I were told his mother has cancer for the second time. She currently has one lung and the second one has a tumor on it. Our family has been and will be going to see her every other weekend. She lives in Oklahoma. We need the person currently living in the trailer to take care of the animals on the property. We have 4 horses, about 80 chickens, geese, turkeys, cows, goats and a dog. I do not know what else we can do right now to take care of everyone and still help mom. I want to remove the trailer as well but I am stuck. If you need me to prove this situation I will ask her Doctor to write a letter. I apologize for asking for an extension. Please understand the situation we are in. Thank you for help. I understand your intent is to have such premises removed if they are not in line with the use originally intended. I am a mother of three and have been building a home for the past year. We have three children that are transported 50 miles a day to and from school. We participate in competitive soccer for 2 of my children 6 days a week. My husband is an engineer and works 50 hours a week and has a part time commitment with kid's competitive soccer. We have been utilizing our residents in the trailer to fill all of the gaps. They have to feed and maintain the property 6 days a week. In the near future I am going to be able to restructure my life in order to be home enough to take care of responsibilities required on a farm. I will be able to work at home. We have a lot of plans for our property and are at the beginning stages of improving all parts of it. We are working on a fence to cover the entire 75 acres, and replace a dilapidated barn with a new and functional barn. We also plan to improve the main residence and the overall appearance of the farm. I would appreciate a little more time on my permit. I believe that we can be prepared for the loss of help in a year. I hope you can help us with a temporary reprieve on your decision.
