RE: APPROVAL OF AMENDMENT TO RECORDED EXEMPTION NO. 335 - EAST
GREELEY LAND COMPANY AND TOM SCHEIRMAN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, East Greeley Land Company and Tom Scheirman have
requested that Recorded Exemption No. 335 be amended to correct
the legal description, said correct legal description is as
follows:
A tract of land located in the Southwest
Quarter (SWa) and a part of the Southeast
Quarter (SEa) of Section 3, Township 5
North, Range 66 West of the Sixth Principal
Meridian, Weld County, Colorado and being
more particularly described as follows :
Beginning at the Southwest Corner (SW Cor)
of said Section 3 and considering the West
line of said Section 3 to bear North 07°55 ' 11"
East with all other bearings contained herein
relative thereto;
Thence North 07°55 ' 11" East, 55 . 82 feet to the
True Point of Beginning;
Thence South 89°40 ' 22" East, 377. 71 feet;
Thence North 01°12 ' 00" East, 851. 63 feet;
Thence South 88°46 ' 00" East, 1095. 90 feet;
Thence South 01°12' 00" West, 294. 60 feet to
a point on the centerline of an existing ditch;
Thence along said centerline of existing ditch
by the following ten (10) courses and distances :
South 25°48 ' 24" West, 33. 10 feet;
South 13°49 ' 34" West, 114. 98 feet;
South 39°04 ' 58" West, 66. 44 feet;
South 58°27 ' 50" West, 63. 49 feet;
South 44°31 ' 48" West, 36. 10 feet;
South 00°17 ' 32" East, 71. 27 feet;

the True Point of Beginning.
Said described parcel of land contains 169. 644
acres, more or less, including road right-of-way

or other easements as granted or reserved by
instruments of record or as now existing on

WHEREAS, the Board of County Commissioners of Weld County,
Colorado deems it advisable and in the best interests of Weld
County to approve said amendment.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove amend-
ment to Recorded Exemption No. 335 for East Greeley Land Company
and Tom Scheirman be, and hereby is, approved.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 23rd day of

Re: Amendment to Recorded Exemption #335
Dear Commissioners:
The attached materials are in reference to a request from East Greeley
Land Company and Tom Scheirman for an amendment to Recorded Exemption
#335. The property is described as part of the SW1 and part of the
SE', Section 3, T5N, R66W of the 6th P.M. , Seld County, Colorado. This
property is located northeast of the intersection of 59th Avenue and U.S.
Highway 34 Business.
The request is to amend Recorded Exemption #335 by correcting two items
on the recorded exemption plat. The Northwest corner should read the
W1 Corner and the North-South Center Section Line should read the East-
West Center Section Line.
Based upon a review of the information submitted the Department of Plan-
ning Services Staff recommends approval of this requested amendment since
it will correct an incorrect legal description.

In accordance with a recent telephone conversation between your
offices and myself to establish the necessary procedure for filing
an Amended Recorded Exemption, enclosed herewith please find the
following:
1) Original Amended Exemption No. O959-3-3-RE 335 and four (4)
copies duly executed by East Greeley Land Company and Mr.
Tom Scheirman and notorized;
2) Copy of prior Recorded Exemption affecting the subject property
and disclosing the errors requiring correction; and
3) Copy of Commitment for Title Insurance issued by Stewart Title
under Order 4i26563CF, Page 3 of which sets forth the purpose
of the Amended Exemption.
We ask that you inspect the enclosures and give your acceptance and
approval for filing at your earliest possible convenience.
