HomeMy WebLinkAbout20052067.tiff HEARING CERTIFICATION DOCKET NO. 2005-58 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1511 FOR A HOME BUSINESS (STORAGE OF EXCAVATING/CONSTRUCTION EQUIPMENT)IN THE A(AGRICULTURAL)ZONE DISTRICT-ALAN AND CAROL DAVIS A public hearing was conducted on August 3, 2005, at 10:00 a.m., with the following present: Commissioner William H. Jerke, Chair Commissioner M. J. Geile, Pro-Tern Commissioner David E. Long Commissioner Robert D. Masden Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Jacqueline Hatch Health Department representative, Char Davis Public Works representative, Donald Carroll The following business was transacted: I hereby certify that pursuant to a notice dated July 15,2005,and duly published July20,2005,in the Fort Lupton Press,a public hearing was conducted to consider the request of Alan and Carol Davis for a Site Specific Development Plan and Use by Special Review Permit #1511 for a Home Business(storage of excavating/construction equipment)in the A(Agricultural)Zone District. Lee Morrison,Assistant County Attorney, made this a matter of record. Jacqueline Hatch, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Hatch gave a brief description of the location of the site and surrounding land uses,and stated the existing landscaping is compatible and will mitigate any impacts. She displayed photographs of the site and surrounding area,and stated the Vale View Homeowners'Association is supporting the project. She stated ten referral agencies reviewed this proposal,five indicated no comment,and five provided comments that have been addressed in the Conditions of Approval and Development Standards. Char Davis, Department of Public Health and Environment, stated the site is serviced by the Left Hand Water District and a septic system,there will be no employees,and the applicant will provide access to the restrooms in the residence. Donald Carroll, Department of Public Works, stated Weld County Road 36 is classified as a local road which was paved in last five to eight years. He stated when the Vale View Subdivision was developed,the Town of Mead indicated it would take the road once it was built; however, that has not occurred. Chair Jerke requested staff search for evidence of that understanding in the form of a written agreement or public testimony. 2005-2067 PL1(1g �L ne) fjiL: ?�3 v� HEARING CERTIFICATION - ALAN AND CAROL DAVIS (USR#1511) PAGE 2 Alan Davis, applicant, stated there will be no employees. No public testimony was offered concerning this matter. Responding to ChairJerke, Mr. Davis stated he has reviewed and concurs with the Conditions of Approval and Development Standards as proposed. Commissioner Geile moved to approve the request of Alan and Carol Davis for a Site Specific Development Plan and Use by Special Review Permit#1511 for a Home Business (storage of excavating/construction equipment) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Long, and it carried unanimously. There being no further discussion, the hearing was completed at 1:55 p.m. This Certification was approved on the 8th day of August, 2005.
