Allegation is False. Saturday, March 19, 2005 Absolutely false. Business implemented system to ensure that the stipulated order was followed to the letter. On this day semi tractor trailer rig was being washed, a six hour process. (Proof, see invoice from Truck Wash). Thursday, April 7, 2005 Absolutely false. Dump truck and Bobcat delivery, Hauled load of topsoil, took loader to spread and level the dirt on-site. Order was taken @11:27 A.M. Delivery took place at noon, Truck and Bobcat returned to the yard @ about 2:00 P.M. (Proof, see invoice and credit card slip) Also, only four total transactions entire day, business closed @ 4:45 P.M. Saturday, April 16, 2005 Absolutely false. After a thorough investigation of our invoices, records, calendars and sales activities we add further to our initial answer the following: On this day, semi truck driver Jim Speers previously arranged to take this day off. See notation on office calendar page. This is also noteworthy, only one delivery the entire day. This delivery took place in the early afternoon. Truck was back in the yard @ approximately 2:00 P.M., one hour before closing time. Business experienced a total of nine yard pick-ups. (Proof, see invoices, credit card slips and copy of office calendar). Wednesday, May 04, 2005 Absolutely false. Business implemented system to ensure that the stipulated order was followed to the letter. Truck driver's log indicated that his last load was hauled to Evans @ 2:30 P.M. Truck operates out of a Greeley Terminal. Thursday May 05, 2005 Not any load ordered from our stone broker by us. No further explanation, no violation. See John Schroeder letter. Not a company we deal with. Saturday, June 25, 2005 Absolutely false. Three deliveries took place on this day as follows: A.M., Ahlers, load of mulch delivered approximately 10 A.M. —Noon, truck returns to yard @ 12:15 P.M. A.M., Prine, 2 tons of pea gravel and 12 railroad ties delivered approximately 11:00 A.M. - 1:00 P.M. Truck returned to the yard @ about 1:15 P.M. P.M., Monique Lewis- Johnstown, compost 4 yards, load leaves yard at about 1:30 P.M. Truck returns, @ 2:00 P.M. Note: 14 yard pick-ups on the day. (Proof, see invoices and credit card slips for this day) ©(H11BIT Friday, July 01, 2005 Absolutely false. Three deliveries took place on this day as follows: A.M., Ann Lind, load of rock and Bobcat delivered @ approximately 10:00 A.M. Jess Aragon delivered load along with Bobcat machine and spent about two hours spreading the rock @ customer's residence. Note: Dump truck and Bobcat rig returned @ approximately 12:30 P.M. Also: Dean, load of decorative rock delivered about Noon— 12:30 P.M. Truck returned to the yard @ approximately 1:30 P.M. After examining sales records for this day it was noticed that a TimberRock employee got lost, ran out of time, could not return to the sales yard before 5:00 P.M. and subsequently had to leave the truck in an off-site location (Auto Mall site) until 9:00 A.M. the next morning. Of additional notice, Cindi Rubiano's birthday party Barbecue occurred at her home in Fort Collins of which four TimberRock employees attended @ 6:00 P.M. that evening. He has informed me that a hearing will be conducted, involving the operating of his business, in regards to delivery hours, and height of the piles of Wood Mulch. Before, Mr. Aragon placed and order with me, he told me that he had restrictions for hours of delivery, and the height of the piles. I informed him that I would comply with the hours of delivery, but the height of the piles, I could not control, and that would be his responsibility to lower the height of the piles to what ever his limits or restrictions are. Our loads are delivered with a Walking Floor Trailer. Each product unloads differently. Products such as Shredded Redwood, Shredded Cedar, Pole Peelings and others products that are stringy, fiberus, and entangled, tend to fall out of the trailer in large dumps, which can not be controlled. He Agreed, and placed an order. My Company, Loren Rutz has delivered 12 Loads of Wood Mulch this year to date, to Timberock Landscape Supply. I can assure you that each and every load was delivered after 9:00 am, and before 4:00 pm, Monday thru Friday.
