THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE
APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 23-2-260
of the Weld County Code.
2. It is the opinion of the Department of Planning Services' staff that the applicant has shown
compliance with Section 23-2-220 of the Weld County Code as follows:
a. Section 23-2-220.A.1 -- The proposed use is consistent with Chapter 22 and any other
applicable code provisions or ordinance in effect. Section 22-2-60.D A.Goal 4 states:
"Conversion of agricultural land to urban scale residential, commercial and industrial uses
will be considered when the subject site is in an area that can support such development.
Such development shall attempt to be compatible with the region. This goal is intended to
address conversion of agricultural land to non-urban uses. Once converted, this land is
less conducive to agricultural production." The site consists of eighty (80) acres and the
U.S.D.A. Soils Maps of Prime Farmlands of Weld County dated 1997 indicate that the
soils on this property as"other". The surrounding properties are primarily agricultural with
single family homes. The applicant is proposing an on-site septic system and the water
will be provided by an individual well (#62749-F).
b. Section 23-2-220.A.2 -- The proposed use is consistent with the intent of the A
(Agricultural) Zone District. Section 23-3-40.B.17 and Section 23-3-40.6.18 of the Weld
County Code provides for agricultural service establishments primarily engaged in
performing agricultural animal husbandry or horticultural services on a fee on contract
basis including Commercial Rodeo Arenas and Commercial Roping Arenas, to include

both indoor and outdoor arenas as a Use by Special Review in the A (Agricultural) Zone
District. Section 23-3-40.C.1 of the Weld County Code provides for recreational facilities
and uses including race tracks and race courses as a Use by Special Review in the A
(Agricultural)Zone District. A violation was initiated due to the operation of a 'horse track'
located on the property without the proper zoning permits.
c. Section 23-2-220.A.3 -- The uses which will be permitted will be compatible with the
existing surrounding land uses. The site is bordered by agricultural uses. Single family
residences are located on properties to the north and southeast of the site. Development
standards and conditions of approval will ensure that this use will be compatible with
surrounding land uses. No comments have been received from surrounding property
owners but testimony was given at the violation hearings.
d. Section 23-2-220.A.4 -- The uses which will be permitted will be compatible with future
development of the surrounding area as permitted by the existing zoning and with the
future development as projected by Chapter 22 of the Weld County Code and any other
applicable code provisions or ordinances in effect, or the adopted Master Plans of
affected municipalities. The site is not located within three miles of a municipality. The
applicant is requesting a sign that complies with the Commercial Zone District of the
Weld County Code. The applicant is proposing to have a twenty-one square foot sign to
be located in the north west corner of the intersection of County Road 39 and County
Road 28, section line road.
e. Section 23-2-220.A.5--The site does not lie within any Overlay Districts.
Effective January 1, 2003, Building Permits issued on the subject site will be required to
adhere to the fee structure of the County Road Impact Program. (Ordinance 2002-11)
Effective August 1, 2005, Building permits issued on the subject site will be required to
adhere to the fee structure of the Capital Expansion Impact Fee and the
Stormwater/Drainage Impact Fee. (Ordinance 2005-8 Section 5-8-40)
f. Section 23-2-220.A.6 -- The applicant has demonstrated a diligent effort to conserve
prime agricultural land in the locational decision for the proposed use. The U.S.D.A. Soils
Maps of Prime Farmlands of Weld County dated 1979 designated the soils on this
property as"other".
g. Section 23-2-220.A.7 -- The Design Standards (Section 23-2-240, Weld County Code),
Operation Standards (Section 23-2-250, Weld County Code), Conditions of Approval and
Development Standards ensure that there are adequate provisions for the protection of
health, safety, and welfare of the inhabitants of the neighborhood and County.
This recommendation is based, in part, upon a review of the application materials submitted by the
applicant, other relevant information regarding the request, and responses from referral entities.
The site is currently in violation (VI-0500198) if this Use by Special Review application is approved the
property will be in compliance. If denied, all commercial equipment shall be removed from the property,
otherwise, the violation case will proceed accordingly.
The Department of Planning Services' staff recommendation for approval is conditional upon the
following:
1. Prior to scheduling a Board of County Commissioners hearing:
A. The applicant shall either submit a copy of an agreement with the property's mineral
owner/operators stipulating that the oil and gas activities have been adequately

incorporated into the design of the site or show evidence that an adequate attempt has
been made to mitigate the concerns of the mineral owner/operators. Drill envelopes can
be delineated on the plat in accordance with the State requirements as an attempt to
mitigate concerns. The plat shall be amended to include any possible future drilling sites.

B. The applicant shall provide the Department of Planning Services with a
Landscape/Screening Plan for review. (Department of Planning Services)
C. The applicant shall provide a Lighting Plan. Should exterior lighting be a part of this
facility, all light standards shall be delineated on the plat and be in accordance with
Section 23-3-250.6.6 of the Weld County Code. (Department of Planning Services)
2. Prior to recording the plat:
A. Each plat sheet shall be labeled USR-1522. (Department of Planning Services)
B. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment. Evidence of Health Department approval shall be submitted to the
Department of Planning Services. (Department of Public Health & Environment)
C. The potable water system shall comply with the Colorado Primary Drinking Water
Regulations (5 CCR 1003-1). The applicant shall submit evidence to the Weld County
Department of Public Health and Environment of compliance from the Water Quality
Control Division (WQCD), Colorado Department of Public Health and Environment.
Evidence of approval from the Department of Public Health and Environment shall be
submitted to the Department of Planning Services. (Department of Planning Services)
D. The applicant shall submit a waste and manure handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public Health
& Environment. The plan shall include at a minimum, the following:
1. A list of wastes which are expected to be generated on site (this should include
expected volumes and types of waste generated).
2. A list of the type and volume of chemicals expected to be stored on site.
3. The waste handler and facility where the waste will be disposed (including the
facility name, address, and phone number).
Evidence of Health Department approval shall be submitted to the Department of

E. The applicant shall complete a Nonexclusive License Agreement for the upgrade and
maintenance of Weld County Right-of-Way, for CR 28. Evidence of approval shall be
submitted to the Department of Planning Services. (Department of Public Works)
F. The applicant shall submit to the Department of Public Works a detailed drawing of the
intersection of CR 39 and CR 28 (section line access) shown either by realignment or
matching the grade, type of surface, width and depth of base an asphalt, how this
intersection will function to accommodate adequate turning radiuses, stop conditions,
drainage, and adequate sight distance in all directions. Evidence of approval shall be
submitted to the Department of Planning Services. (Department of Public Works)
G. The applicant shall attempt to address the requirements of the Platte Valley Soil

Conservation District as stated in the referral response dated July 21, 2005. Evidence of
such shall be submitted in writing to the Weld County Department of Planning Services.

H. The applicant shall attempt to address the requirements of the Weld County Sheriffs
Office as stated in the referral response dated August 17, 2005. Evidence of such shall
be submitted in writing to the Weld County Department of Planning Services.

The applicant shall attempt to address the requirements of the Platteville/Gilcrest Fire
Protection District as stated in the referral response dated August 8, 2005. Evidence of
such shall be submitted in writing to the Weld County Department of Planning Services.

J. The plat shall be amended to delineate the following:
1. The attached Development Standards. (Department of Planning Services)
2. The approved Landscape/Screening Plan. (Department of Planning Services)
3. The approved Lighting Plan. (Department of Planning Services)
4. County Road 28 is designated as a section line road. The Department of Public
Works has researched the right-of-way and has determined that there is only
thirty (30) feet of County right-of-way in Section 30. The access road should be
built within Section 30 on your property and delineated on the plat. County Road
28 shall be upgraded to accommodate two-way traffic. The section line road or
driveway must be constructed and maintained at a minimum as graded and
drained all-weather surface. Consideration must be given to the width of two-
way traffic and weight of emergency service equipment, fire trucks, ambulances,
etc., which may need to access the property. (Department of Public Works)
5. County Road 39 is designated on the Weld County Road Classification Plan as a
collector road, which requires 80 feet of right-of-way at full build out. A total of 40
feet from the centerline of County Road 39 shall be delineated right-of-way on
the plat. This road is maintained by Weld County. The applicant shall verify the
existing right-of-way and the documents creating the right-of-way. If the right-of-
way cannot be verified, it shall be dedicated. (Department of Public Works)
6. The plat shall delineate the location of the blue and white cross road sign at the
intersection of CR 39 and CR 28, section line and the location of the stop sign as
approved by the Department of Public Works. (Department of Public Works)
7. The applicant shall delineate on the plat the drill envelopes
K. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the
Weld County Department of Planning Services. (Department of Planning Services)
3. Upon completion of 1. and 2. above the applicant shall submit a Mylar plat along with all other
documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office
of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall
be prepared in accordance with the requirements of Section 23-2-260.D of the Weld County
Code. The Mylar plat and additional requirements shall be submitted within thirty (30) days from
the date of the Board of County Commissioners resolution. The applicant shall be responsible for

4. In accordance with Weld County Code Ordinance 2005-7 approved June 1, 2005, should the plat
not be recorded within the required thirty (30) days from the date the Board of County
Commissioners resolution a $50.00 recording continuance charge shall added for each additional
3 month period.
5. The Department of Planning Services respectively requests the surveyor provide a digital copy of
this Use by Special Review. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation);
acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files
format type is .e00. The preferred format for Images is .tif(Group 4). (Group 6 is not acceptable).

6. Prior to the release of Building Permits:
A. A building permit shall be obtained prior to the construction of any new building.

B. A plan review is required for each building for which a building permit is required. Plans
shall include a floor plan. Plans shall bear the wet stamp of a Colorado registered
architect or engineer. Two complete sets of plans are required when applying for each
permit. Provide a Code Analysis Data sheet provided by the Weld County Building
Department with each building permit application. (Department of Building Inspection)
C. Each building will require an engineered foundation based on a site-specific geotechnical
report or an open hole performed by a Colorado registered engineer. Engineered
foundations shall be designed by a Colorado registered engineer. (Department of

D. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2003
International Building Code; 2003 International Mechanical Code; 2003 International
Plumbing Code; 2003 International Fuel Gas Code; and the 2002 National Electrical
Code and Chapter 29 of the Weld County Code. (Department of Building Inspection)
E. Building height shall be measured in accordance with the 2003 International Building
Code for the purpose of determining the maximum building size and height of various
uses and types of construction and to determine compliance with the Bulk Requirements
from Chapter 23 of the Weld County Code. Building height shall be measured in
accordance with Chapter 23 of the Weld County Code in order to determine compliance
with offset and setback requirements. Offset and setback requirements are to the
farthest projection from the building. (Department of Building Inspection)
F. Fire resistance of walls and openings, construction requirements, maximum building
height, automatic sprinkler requirements and allowable areas will be reviewed at the plan
review. Setbacks and offset distanced shall be determined by the Weld County Code.
Plans shall also be submitted to the Platteville Fire District for their approval.

G. The buildings may be classified as:
1. A-4 (Indoor Riding Arena). An automatic sprinkler system throughout will be
required.
2. A-3 (Outdoor Arena). An automatic sprinkler system will be required in
concession stands, retail areas, press boxes, and other accessory areas in
excess of 100 square feet.

3. Bathrooms are accessory to the arenas. For an occupant load of 1079.
Males: seven water closets, 67% may be urinals and two lavatories are required.
Females: thirteen water closets and four lavatories.
One drinking fountain for the facility will be required.
All buildings will need to be accessible to persons with disabilities. (Department

7. Prior to the issuance of the Certificate of Occupancy:
A. An individual sewage disposal system is required for the proposed facilities and shall be
installed according to the Weld County Individual Sewage Disposal Regulations.

B. The septic system is required to be designed by a Colorado Registered Professional
Engineer according to the Weld County Individual Sewage Disposal Regulations.

C. The applicant shall submit evidence of an Underground Injection Control (UIC) Class V
Injection Well permit from the Environmental Protection Agency (EPA) for any large-
capacity septic system (a septic system with the capacity to serve 20 or more persons a
day). Alternately, the applicant scan provide evidence from the EPA that they are not
subject to the EPA Class V requirements. (Department of Public Health and

D. A stormwater discharge permit may be required for a development / redevelopment /
construction site where contiguous or non-contiguous land disturbance is greater than or
equal to one acre in area. The applicant shall inquire with the Water Quality Control
Division (WQCD) of the Colorado Department of Public Health and Environment at
www.cdphe.state.co.us/wq/PermitsUnit if they are required to obtain a stormwater
discharge permit. Alternately, the applicant can provide evidence from WQCD that they
are not subject to these requirements. Evidence of approval from the Department of
Public Health and Environment shall be submitted to the Department of Planning

8. The Special Review activity shall not occur nor shall any building or electrical permits be issued
on the property until the Special Review plat is ready to be recorded in the office of the Weld

1. The Site Specific Development Plan and a Special Review Permit for Commercial Rodeo Arenas
and Commercial Roping Arenas, to included both indoor and outdoor arenas and race track/race
course in the A (Agricultural) Zone District as indicated in the application materials on file and
subject to the Development Standards stated hereon. (Department of Planning Services)
2. Approval of this plan may create a vested property right pursuant to Section 23-8-10 of the Weld
County Code. (Department of Planning Services)
3. A maximum of 1,079 persons will be allowed on site as outlined in the application materials and
dictated by the well permit on site (well permit number 62749-F). (Department of Planning

4. Both access gates along County Road 28 shall be opened one hour before racing events so as to
not back up, stage, or park overflow traffic on County Road 39. (Department of Public Works)
5. The off-street parking, including both access drives, shall be surfaced with gravel or the
equivalent and shall be graded to prevent any drainage problems. (Department of Public Works)
6. The pedestrian walkways shall be either crusher fines or recycled asphalt placed in the

7. There shall be no parking or staging of vehicles on County Road 39. (Department of Planning

8. Should noxious weeds exist on the property or become established as a result of the proposed
development the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Chapter 15, Articles I and II of the Weld County Code. (Department of Public Works)
9. The historical flow patterns and run-off amounts will be maintained on site in such a manner that
it will reasonably preserve the natural character of the area and prevent property damage of the
type generally attributed to run-off rate and velocity increases, diversions concentration and/or
unplanned ponding of storm run-off. The applicant must take into consideration stormwater
capture/quantity and provide accordingly for bet management practices. (Department of Public

10. The number of animal units on site shall not exceed the allowed numbers as in Section 23-1-90 of
the Weld County Code. (Department of Planning Services)
11. Two(2) persons trained in emergency medical technology for the first three hundred fifty(350)
persons and one (1) for every three hundred fifty (350) persons after that, together with at least
one (1) emergency ambulance available for use at all times. An enclosed structure where
treatment may be rendered shall also be provided. (Department of Planning Services)
12. Adequate security to control any disturbances which might occur. As a minimum requirement, the
applicant shall provide security guards at the rate of two (2) for every three hundred fifty (350)
persons attending the event. For security within and among the assembled people, at least five
(5)security guards shall be provided, or in the alternative, an adequate plan of peer group control

may be used. All security guards shall be off-duty peace officers or private guards licensed in

13. Hours of operation shall be as outlined in the application materials.
Wednesdays: 3 p.m. to sundown
Saturdays: 9 a.m. to sundown
Sundays: Noon to sundown
Special Occasions: 9 a.m. to sundown - Special Occasions include the following: Memorial
day, 4'h of July, Labor Day, Thanksgiving, Christmas, and New Years Eve and New Years Day.
Employees are permitted to be on-site one hour after sundown. (Department of Planning

14. The access road shall be treated with magnesium or calcium chloride at a minimum of twice a
year or as required by Weld County personnel. (Department of Public Works)
15. Animal and feed wastes, bedding, debris and other organic wastes shall be disposed of so that
vermin infestation, odors, disease hazards, and nuisances are minimized. Such wastes shall be
removed at a minimum weekly from the facility and disposed of by a commercial hauler.

16. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-
20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against
surface and groundwater contamination. (Department of Public Health and Environment)
17. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those
wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal
Sites and Facilities Act, 30-20-100.5, C.R.S. (Department of Public Health and Environment)
18. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust,
blowing debris, and other potential nuisance conditions. (Department of Public Health and

19. The applicant shall operate in accordance with the approved "waste handling plan". (Department

20. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be
operated in accordance with the approved dust abatement plan at all times. (Department of

21. The applicant shall have sufficient equipment available to implement dust control as required by

22. The facility shall adhere to the maximum permissible noise levels allowed in Commercial Zone

23. Adequate handwashing and toilet facilities shall be provided for the volunteers and attendees.

24. Any septic system located on the property must comply with all provisions of the Weld County

37. Each building will require an engineered foundation based on a site-specific geotechnical report

purpose of determining the maximum building size and height of various uses and types of

42. The property owner shall allow any mineral owner the right of ingress or egress for the purposes
of exploration development, completion, recompletion, re-entry, production and maintenance

43. The property owner or operator shall be responsible for complying with the Design Standards of
Section 23-2-240, Weld County Code.
44. The property owner or operator shall be responsible for complying with the Operation Standards
of Section 23-2-250,Weld County Code.
45. This operation shall comply with all applicable rules and regulations of State and Federal

46. Personnel from the Weld County Government shall be granted access onto the property at any
reasonable time in order to ensure the activities carried out on the property comply with the
Development Standards stated herein and all applicable Weld County regulations.
47. The Special Review area shall be limited to the plans shown hereon and governed by the
foregoing standards and all applicable Weld County regulations. Substantial changes from the
plans or Development Standards as shown or stated shall require the approval of an amendment
of the Permit by the Weld County Board of County Commissioners before such changes from the
plans or Development Standards are permitted. Any other changes shall be filed in the office of
the Department of Planning Services.
48. The property owner or operator shall be responsible for complying with all of the foregoing
Development Standards. Noncompliance with any of the foregoing Development Standards may
be reason for revocation of the Permit by the Board of County Commissioners.
