The Sheriffs Office requests that builders and developers designate an area by the entrance of the sub-division in which to place a shelter for school children awaiting the school bus. This area should also include a pull off for the school bus which enables it to safely load and unload children out of the roadway. 2. Either mail distribution within the sub-division or a central drop off location within the sub-division should be developed so that residents do not have to cross a county road to obtain their mail. 3. A permanent sign should be placed at the entrance to the subdivision detailing the name of the sub-division,address,and a graphical presentation of the roadways within the subdivision. There should be a plan developed to maintain this sign. 4. If the roadways within this sub-division are not maintained or adopted by the county, individuals purchasing property in this sub-division should be notified that the Sheriffs Office will have limited traffic enforcement powers. 5. A plan should be developed to maintain roadways within the sub-division especially during inclement weather conditions for emergency vehicles. 6. The Sheriffs Office is very supportive of homeowner funded homeowner's associations. These associations provide a contact for the Sheriffs Office and a means of maintaining common areas. 7. If there are oil or gas production facilities within this sub-division,they need to be fenced off in order to mitigate the potential for tampering. These facilities are known to create an attractive nuisance for young people. Tampering not only creates a significant danger to safety but also of environmental damage with extensive mitigation and clean-up costs. 8. The names of all streets within the sub-division should be presented to the Sheriffs Office for approval. This will eliminate duplication of street names within the county. The street name for this sub-division is approved. The Sheriffs Office lacks the ability to absorb any additional service demand without the resources recommended in the multi-year plan provided to the Weld County Board of County Commissioners or as indicated by growth not considered at the time the plan was developed. I have no other comments on this proposal. Creek Estates. In the past we asked for the following: Request the development have a minimum of a 100-foot turn around point where the driveway to the subdivision connects to Hwy 392. This is necessary to safely pickup and drop off passengers in this area without backing up or stopping the bus on the Highway during inclement weather conditions. There is no door-to-door service for subdivisions and this area is to be maintained by the subdivision property owners in all weather conditions. We would ask that you provide a safe place off of Highway 392 that would be safe for all students while waiting for the bus. The bus will approach the stop from either the east or west depending on AM or PM routes. ft is my understanding that our requests have been rejected by CDOT and Weld County. l am disappointed that neither entity is willing to discuss the matter regarding school bus operations, especially in light of the fact that neither entity operates a pupil transportation system. Mr. Boyle of North Star designs presented us the most recent attached plan. The plan allows sufficient space for a school bus to turn around. The Platte Valley School District, Weld Re-7 will continue to operate our pupil transportation system according to current State laws and best practices regarding school bus operations and student pick up. This will be done in an effort to best serve the students and community of our district. Safety of students is our primary objective when considering school bus stops, student pick-ups, and drop-offs. Water Division 1, Water District 1 Dear Ms. Lockman: We have previously reviewed the above referenced proposal to subdivide a 75.34-acre parcel, into nine single-family residential lots by our letters dated June 18, 2004 and July 7, 2004. Information from this submittal indicates that this is the Final Plat for this subdivision and water is to be provided by the North Weld County Water District (District). In our letter dated July 7, 2004 (copy attached) this office already rendered an opinion on the proposed water supply indicating that contingent upon water service being provided by the District, the proposed water supply will not cause material injury to existing water rights and the supply is expected to be adequate. Since no changes in the water supply for the Owl Creek Estates Subdivision were identified in this new submittal, the comments from our letter dated July 7, 2004 still apply including the recommendation that the County obtain a signed copy of the Water Service Agreement from the District prior to the final approval of the subdivision. Water Division 1,Water District 1 Dear Ms. Lockman: We have reviewed additional information submitted to this office on June 28, 2004 on the above referenced proposal to subdivide a 75.34-acre parcel described as Lot B of the Recorded Exemption RE-_ 2016, into nine single-family residential lots. As mentioned in our previous letter dated June 18, 2004, the North Weld County Water District (District) was listed as the source of domestic water. Since a concern was raised regarding the District's commitment to the subdivision, a copy of a Water Service Agreement from the District was provided with this additional information, however the District did not sign the Agreement. The Agreement indicates that, the District will provide water to the subdivision per terms and conditions of the District. Based on current records on file in this office, the District currently has an adequate uncommitted water supply to provide the water associated with this project. Furthermore, a "Water Supply Information Summary" was also provided, however no estimates on the water requirement for the subdivision were indicated. According to the information in the Water Service Agreement the District will furnish 70% of an acre-foot [228,000 gallons (0.69 acre-feet per year per lot)] of water per tap per annual water year if the allotment for the Colorado-Big Thompson (CBT) project water, as determined by the Northern Colorado Water Conservancy District, is 50% or greater.The District will restrict the delivery as necessary when the CBT allotment is less than 50%. Pursuant to Section 30-28-136(1)(h)(II), C.R.S., the State Engineer's office offers the opinion, that contingent upon water service being provided by the District, the proposed water supply will not cause material injury to existing water rights and the supply is expected to be adequate.We recommend that the County obtain a signed copy of the Water Service Agreement from the District prior to the final approval of the subdivision. A building permit shall be obtained prior to the construction of any new building except those exempted by the Weld County Building Code. 2. A plan review is required for each building for which a building permit is required. Plans shall include a floor plan. Plans may be required to bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit _iplication. Current adopted codes include the 2003 International Building Code; 2003 International Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; 2002 National Electrical Code and Chapter 29 of the Weld County Code. 4. Each building will require an engineered foundation based on a site-specific geotechnical report or an open whole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance. 6. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. Offset and setback requirements are measured to the farthest projection from the building. The Weld County Health Department has reviewed this Final Plat application. It should be noted that the Department's copy of the Final Plat for review has a watermark stating that the verbiage is for reference only and is not applicable to this plat, however the Health Department notes are correct. The Change of Zone application was approved with the following as plat notes: 1. Water service shall be obtained from the North Weld County Water District. 2. A Weld County septic permit is required for each proposed septic system,which shall be installed in according to the Weld County individual sewage disposal system regulations. Each septic system shall be designed for site-specific conditions, including, but not limited to: maximum seasonal high groundwater, poor soils, and shallow bedrock. 3. If required, the applicant shall obtain a storm water discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and the Environment. Silt fences shall be maintained on the down gradient portion of the site during all parts of the construction phase of the project. 4. During development of the site, all land disturbances shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions,at the request of the Weld County Health Department, a fugitive dust control plan must be submitted. 5. In accordance with the Regulations of the Colorado Air Quality Control Commission any development that disturbs more than 5 acres of land must incorporate all available and practical methods which are technologically feasible and economically reasonable in order to minimize dust emissions. 6. If land development creates more than a 25-acre contiguous disturbance,or exceeds 6 months in duration, the responsible party shall prepare a fugitive dust control plan, submit an air pollution emissions notice, and apply for a permit from the Colorado Department of Public Health and Environment. 7. Comments ❑ The engineer shall seal the final plat drawings of roadway, drainage, utility / construction & grading plan drawings submitting them to Public Works for acceptance. ❑ The Final Drainage and Erosion Control Report for Owl Creek Estates, dated May 3, 2005, by North Star Design Inc. (Job Number 101-07) is acceptable to Public Works,but must be sealed by the engineer of record. o The final drainage report stamped, signed and dated by a professional engineer licensed in the State of Colorado must be submitted to Public Works. o The department will keep the sealed report in the case file for use during the construction phase. ❑ The applicant has submitted Improvements Agreement According to Policy Regarding Collateral For Improvements (Public Road Maintenance), which is acceptable to Public Works.
