RE: APPROVAL OF RECORDED EXEMPTION NO. 455 - OTTO AND ESTHER
EHRLICH
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado , and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held
on the 24th day of September, 1980 in the Chambers of the Board
of County Commissioners of Weld County, Colorado, that the divi-
sion into two parcels of land, as shown on the plat known as
Recorded Exemption No. 455, being the property of Otto and
Esther Ehrlich, described as the North Half of the Southeast
Quarter of Section 26 , Township 6 North, Range 67 West of the
6th P.M. , Weld County, Colorado, does not come within the
purview of the definition of the terms, "subdivision" and "sub-
divided land" , pursuant to its authority under Section 30-28-101
(10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of
land from the definitions of "subdivision" and "subdivided land"
pursuant to its authority under Section 30-28-101 (10) (d) , CRS
1973 , as amended and Section 2-1A (3) of the Weld County Subdi-
vision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Otto and Esther Ehrlich be, and hereby is ,
exempt from the definition of the terms , "subdivision" and "sub-
divided land" , pursuant to its authority under Section 30-28-101
(10) (d) , CRS 1973 , as amended .

Re: Recorded Exemption #455
Dear Commissioners:
The attached application, plat and related items are in reference to a
request from Otto and Esther Ehrlich for a Recorded Exemption. The
parcel of land on which this request has been made is described as N1/2 SE',
Section 26, T6N, R67W of the 6th P.M. , Weld County, Colorado. This pro-
perty is located 2 miles east and mile south of Windsor. The property
contains approximately 80 acres of Class I and II irrigated soils. The
request is to split the property into parcels of 1.345 acres and 79+ acres.
Mr. and Mrs. Ehrlich wish to sell the 1.345 acre improvements parcel to
increase the efficiency of their farming operations. They are presently
renting the improvements and no longer wish to maintain the structures.
They will continue to farm the remaining property.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the request
be approved for the following reasons:
1. The proposed request conforms with the intent clause of the
recorded exemption procedure (Section 9-2 of the Weld County
Subdivision Regulations) , the intent clause of the Agricultural
Zone District (Section 3.3.A. of the Weld County Zoning Resolu-
tion) , and the Weld County Comprehensive Plan in that the uses
will be compatible with the surrounding agricultural uses. The
request will allow agriculture and related uses to be the pre-
dominant land uses. There will be no reduction the the amount
of land currently being used for agricultural production based
upon the stated intent of the involved parties.
2. The town of Windsor has reviewed this request and has no objections
to the Recorded Exemption.

3. The request complies with the provisions of Section 9-4 A. of
the Weld County Subdivision Regulations.

Dear Ms. Traxler,
This is to inform you that we will apply for a domestic well permit for
the proposed Lot B should it be necessary to have domestic water for the
lot. We are told that we will have no difficulty in receiving the domestic
well permit because the farm is larger than 35 acres. However, we want to
emphasize that development of Lot B is not our intent, we want to farm it.

Dear Ms. Traxler:
Attached please find the application materials for a Recorded Exemption
for the Otto and Esther Ehrlich farm located in thg north half of the
south east quarter of Section 26, Township 6 North'; Range 67 West, 6th
P.'1.
As you will note in the letter from the Ehrlich's, they have no intention
of building a residence on the larger parcel , therefore there will be no
need for sewage disposal facilities, The parcel with improvements has an
existing septic system that has been replaced in the recent past.
I will be representing this application before the County. If you have
any questions concerning the materials submitted, please feel free to
contact me. Please let me know when this will be scheduled for consider-
ation by the various referal and decision making bodies.

Honorable County Commissioners:
We are requesting a Recorded Exemption for our property located
at 31459 Weld County Road 23 in order to sell the improvements, together
with about 1.3 acres , and keep the balance of the farm. The farm has been
owned by members of our family since the middle 1930's , we acquired title
to it in 1954. We have farmed it personally for about 40 years.
We are farmers and cattle feeders , not rental property managers,
We need to keep, and want to keep the farm in production without the
headaches associated with tennants in the farm house. Over the past
few years we have had many problems with tennants in the house, problems
that we no longer have the patience or desire to deal with.
We are interested in efficient, modern farming and need to pro-
duce good crops to support our cattle feeding business. Therefore, we
have no intention to build additional residences on the part of the farm
that we will keep.
