Dear Carlin:
Enclosed please find the revised application for the Evezich Annexation, Zoning, Easement
Vacation, and Minor Subdivision. We have revised the application for external referral pursuant
to the comments submitted by the Town staff.
The following is submitted in response to your comments. All of the comments have been
addressed and/or complied with. I have submitted the following to clarify certain issues:
• Annexation Comment 2: The Annexation Agreement has been drafted by the Town
Attorney and submitted to Dick Leffler for review. We have not seen a copy of it yet.
➢ Zoning Comment 1: The existing land uses have been delineated in full.
➢ Concept Map: All changes have been made. The legal description of the area to be
developed is provided on the map. There are no proposed arterial collector streets.
➢ Concept Map Comment 3: There are no oil wells on the site. The one on adjacent
property has been located and depicted, and all setbacks have been shown.
• Concept Map Comment 4: An AutoCAD CD-ROM has been provided to Dick Leffler.
Minor Subdivision Comment 2: KP Kauffman has been identified as a mineral interest
owner/lessee in the mineral interest report, provided. There is no oil or gas structure on
the site.
➢ Minor Subdivision Comment 6: The Town Attorney has confirmed that surface use
agreements will not be required on this particular project because no real development is
being done. This application is only to legally divide the property for ownership and sale
purposes.

➢ Engineering Comment lc. The Town-approved certificate blocks no longer include a
block for the Weld County Clerk and Recorder.
➢ Engineering Comment 1 g. The information requested is contained within the surveying
certificate, and thus a note is not required and is redundant.
➢ Engineering Comment lk. Block 5, Lots 4, 5, 6 and the west side of lots 7 through 12 are
not being annexed because the owners do not wish to annex to the Town. The
Annexation boundary does not go through the west side of Lots 7 through 12.
➢ Engineering Comment 11. The difference in footage was a typo and has been corrected.
➢ Engineering Comment lm. The applicant owns Lots 1 through 5 Block X.
➢ Engineering Comment 3a. The acreages differ because the applicant is dedicating 10 feet
of Lot 5 to the Town of Frederick in the Minor Sub Plat.

AGREEMENT FOR PAYMENT OF
DEVELOPMENT REVIEW EXPENSES INCURRED BY THE TOWN
THIS AGREEMENT, made and entered into this day of January 2005, by and between the
TOWN OF FREDERICK, COLORADO, a municipal Corporation, hereinafter referred to as "the Town" and
LOUIS EVEZICH, hereinafter referred to as "the Owner/Developer."
WITNESSETH:
WHEREAS, the Owner/Developer owns of certain property situated in the County of Weld, State of
Colorado, and legally described as follows, to-wit:
See Exhibit A, attached hereto.
WHEREAS, the development process includes all aspects of land use, including but not limited to,
annexation, subdivision, change of land use and the installation of public improvements; and
WHEREAS, the Owner/Developer desires to develop said property and has made application to the
Board of Trustees of the Town of Frederick for approval of Annexation, Zoning, and Minor Subdivision; and
WHEREAS,the Parties hereto recognize that the cash deposits and non-refundable land use fees as
specified by resolution of the Town of Frederick may not be adequate to fully cover the Town's expenses in
considering the referenced application, including, but not limited to, legal publications, planning services,
engineering services, attorney fees, consultant fees, reproduction of material, public hearing expenses and
recording documents; and
WHEREAS, the Parties hereto recognize that the Town will continue to incur expenses throughout the
entire development process, until the final completion of the development project, including but not limited to,
planning services, engineering services, attorney fees, consultant fees, reproduction of material, securing
permits and easements, and recording of documents;
NOW, THEREFORE, in consideration of the premises and of the mutual promises and conditions
hereinafter contained, it is hereby agreed as follows:
1. FULL AND SEPARATE ACCOUNTING OF REVIEW AND DEVELOPMENT EXPENSES.
The Town will maintain separate accounts of all monies collected and expended as a result of the
review of the above referenced application throughout the development process. Monthly statements
of expenses incurred and the balance remaining in the account will be made available to the
Owner/Developer by the Town.
2. EXPENDITURE OF FEES PAID BY THE OWNER/DEVELOPER.
The Town shall expend the monies collected from the Owner/Developer in the form of land use fees
and cash deposits, in the payment of expenses incurred in processing the Owner/Developer's
request, throughout the development process, until final completion of the project. Expenses shall
include, but not be limited to, fees charged to the Town for legal publications, planning services,
engineering services, attorney services, consultant services, reproduction of material, public hearing
expenses, the securing of permits and easements and the recording of documents. Any cash

deposits held by the Town and not expended will be refunded to the Owner/Developer, without
interest, upon completion or termination of the project.
3. PAYMENT OF REVIEW AND OTHER EXPENSES BY THE OWNER/DEVELOPER.
In the event that the Town incurs expenses for the review of the Owner/Developer's request, greater
than the monies collected from the Owner/Developer in the form of land use fees and cash deposits,
the Owner/Developer shall reimburse the Town for the additional expenses and/or replenish the cash
deposit to the level specified. Said reimbursements and/or replenishment shall be made within ten
(10) days of the Town submitting an invoice for the expenses or a demand for replenishment of the
cash deposit. Failure by the Owner/Developer to pay within the specified time shall be cause for the
Town to cease processing the application,or deny the Owner/Developer the right to appear before the
Planning Commission or the Board of Trustees, or deny approval of the application, or withhold the
issuance of building permits or certificates of occupancy.
4. APPLICATION TERMINATION.
Except where the law or an agreement with the Town provides otherwise, the Owner/Developer may
terminate his application at any time by giving written notice to the Town. The Town shall immediately
take all reasonable steps necessary to terminate the accrual of costs to the Owner/Developer e.g.,
notify newspapers to cancel publications, etc. The Owner/Developer will continue to be liable for all
costs reasonably incurred by the Town to terminate the application.
5. COLLECTION OF REVIEW AND OTHER EXPENSES.
If the Owner/Developer fails to pay the review and other expenses incurred by the Town when due,
the Town may take those steps necessary and authorized by law to collect the expenses due. The
Town shall also be entitled to all court and attorney's fees, other costs incurred in collection and
interest on the amount due at the rate of 18% per annum.
6. PERSONAL GUARANTY.
At the option of the Board of Trustees, the Owner/Developer may be required to provide a personal
guaranty for the payment of review and other expenses.
7. ORIGINAL COUNTERPARTS.
This Agreement may be executed in counterparts, each of which will be an original, but all of which
together shall constitute one and the same instrument.

Grant, Grant & Goiran, LLP is submitting Annexation, Zoning and Minor Subdivision
applications on behalf of the Evezich family for annexation, zoning, and subdivision of its
property located just north of Frederick.
The Evezich property is located north of First Street, between Johnson Street and Aspen Drive
and contains a total of 9.6134 acres. This annexation satisfies the 1/6 contiguity requirements.
The applicants request R-1 zoning and have submitted a minor subdivision application along
with the annexation and zoning application. Such application is for the purpose of re-
subdividing the property for distribution to various family members and/or sale of certain
parcels. The applicants do not intend to further develop the property at this time. Any further
development will be covered by subsequent development applications.
The property, which is currently divided into 20 lots within the Weld County Evans Addition and
two blocks within the Weld County Wolff Gardens subdivision, will be re-subdivided to contain
only five lots.
Primary access to the property is currently provided by Johnson Street, First Street, and Aspen
Drive. These streets will continue to provide such access.
The owners currently have no plans to change or build homes on the property. The landscaping
shall remain the same. Wildlife habitat will not be affected by the annexation or minor
subdivision of the property.

PETITION FOR ANNEXATION TO THE TOWN OF FREDERICK
DATE: January 10, 2005
TO: THE BOARD OF TRUSTEES OF THE TOWN OF FREDERICK, COLORADO.
We, , the undersigned landowners, in accordance with Colorado law, hereby petition the
Town of Frederick and its Board of Trustees for annexation to the Town of Frederick of the
following described unincorporated territory located in the County of Weld and State of
Colorado, to-wit:
Block 7 and Block 8 Wolff Gardens and Portions of Block S, Block U, and Block
X of Evans Addition, more particularly described in Exhibit A.
As part of this petition, your petitioner further states to the Board of Trustees of
Frederick, Colorado, that:
1. It is desirable and necessary that the territory described in Exhibit A be annexed to the
Town of Frederick.
2. The requirements of C.R.S. sections 31-12-104 and 31-12-105, as amended, exist or
have been met in that:
a. Not less than one-sixth of the perimeter of the area proposed to be
annexed is contiguous with the Town of Frederick or will be contiguous with the
Town of Frederick within such time as required by 31-12-104.
b. A community of interest exists between the area proposed to be
annexed and the Town of Frederick.
c. The area proposed to be annexed is urban or will be urbanized in the
near future.
d. The area proposed to be annexed is integrated with or is capable of
being integrated with the Town of Frederick.
e. No land within the boundary of the territory proposed to be annexed
which is held in identical ownership, whether consisting of one tract or parcel of
real estate or two or more contiguous tracts or parcels of real estate, has been
divided into separate parts or parcels without the written consent of the landowner

or landowners thereof, unless such tracts or parcels were separated by a dedicated
street, road or other public way.
f. No land within the boundary of the area proposed to be annexed which
is held in identical ownership, comprises twenty acres or more, and which,
together with the buildings and improvements situated thereon has an assessed
value in excess of two hundred thousand dollars ($200,000.00) for ad valorem tax
purposes for the year next preceding the annexation, has been included within the
area proposed to be annexed without the written consent of the landowner or
landowners.
g. No annexation proceedings have been commenced for any portion of
the territory proposed to be annexed for the annexation of such territory to another
municipality.
h. The annexation of the territory proposed to be annexed will not result
in the detachment of area from any school district.
i. The annexation of the territory proposed to be annexed will not have the
effect of extending the boundary of the Town of Frederick more than three miles
in any direction from any point of the boundary of the Town of Frederick in any
one year.
j. Prior to completion of the annexation of the territory proposed to be
annexed, the Town of Frederick will have in place a plan for that area, which
generally describes the proposed: Location, character, and extent of streets,
subways, bridges, waterways, waterfronts, parkways, playgrounds, squares, parks,
aviation fields, other public ways, grounds, open spaces, public utilities, and
terminals for water, light, sanitation, transportation, and power to be provided by
the Town of Frederick; and the proposed land uses for the area; such plan to be
updated at least once annually.
k. In establishing the boundary of the territory proposed to be annexed, if
a portion of a platted street or alley is to be annexed, the entire width of the street
or alley has been included within the territory to be annexed. The Town of
Frederick will not deny reasonable access to any landowners, owners of any
easement, or the owners of any franchise adjoining any platted street or alley
which is to be annexed to the Town of Frederick but is not bounded on both sides
by the Town of Frederick.
3. The owners of more than fifty percent of the area proposed to be annexed, exclusive
of dedicated streets and alleys, have signed this petition and hereby petition for annexation of
such territory.

4. Accompanying this petition are four copies of an annexation map containing the
following information:
a. A written legal description of the boundaries of the area proposed to be
annexed;
b. A map showing the boundary of the area proposed to be annexed, said
map prepared and containing the seal of a registered engineer;
c. Within the annexation boundary map, a showing of the location of each
ownership tract in unplatted land and, if part or all of the area is platted, the
boundaries and the plat numbers of plots or of lots and blocks;
d. Next to the boundary of the area proposed to be annexed, a drawing of
the contiguous boundary of the Town of Frederick and the contiguous boundary
of any other municipality abutting the area proposed to be annexed, and a
showing of the dimensions of such contiguous boundaries.
5. Upon the Annexation Ordinance becoming effective, all lands within the area
proposed to be annexed will become subject to all ordinances, rules and regulations of the Town
of Frederick, except for general property taxes of the Town of Frederick which shall become
effective as the January 1 next ensuing.
6. The zoning classification requested for the area proposed to be annexed is R-1
Residential.
WHEREFORE, the following petitioner respectfully requests that the Town of Frederick,
acting through its Board of Trustees, approve the annexation of the area proposed to be annexed.

Note: Effective September 1, 1997, CRS 30-10-406 requires that all documents received for recording or filing

does not conform, except that, the requirement for the top margin shall not apply to documents using forms

D) The Company must receive payment of the appropriate premium.
E) If there has been construction, improvements or major repairs undertaken on the property to be purchased
within six months prior to the Date of the Commitment, the requirements to obtain coverage
for unrecorded liens will include: disclosure of certain construction information; financial information
as to the seller, the builder and or the contractor; payment of the appropriate premium fully
executed Indemnity Agreements satisfactory to the company, and, any additional requirements
as may be necessary after an examination of the aforesaid information by the Company.
No coverage will be given under any circumstances for labor or material for which the insured
has contracted for or agreed to pay.

This notice applies to owner's policy commitments containing a mineral severance instrument
exception, or exceptions, in Schedule B, Section 2.
A) That there is recorded evidence that a mineral estate has been severed, leased, or otherwise

Evezich Annexation
January 24, 2005
A. The Evezich Annexation is only 9.6134 and will not significantly impact the Town of
Frederick.
B. The Evezich Annexation will have no impact on the Town's economy.
C. The Evezich Annexation will have no impact on the St. Vrain Valley School District,
which currently provides education for any children living on the property.
D. The Evezich Annexation will have no impact on the existing transportation system, as it
will neither increase nor decrease traffic.
E. The Evezich Annexation will have no impact on the existing storm drainage system, as
there is no current plan to develop the property further.
F. The Evezich Annexation will have minimal impact on the police department, as the
property contains only three residences.
G. The Evezich Annexation will have minimal impact on the Frederick Fire Protection
District, as the property contains only three residences.
H. The Evezich Annexation will have minimal impact on Carbon Valley Recreation District
and the Town park facilities, as the property contains only three residences.
I. The Evezich Annexation will have no impact on the Town environment.
