The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our
comments and requirements are as follows:
COMMENTS:
WCR 31 is designated on the Weld County Road Classification Plan (FHU) as a minor arterial road, which
requires a 130-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The road is
maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23,
Article III, Section 23-3-50, the required setback is measured from the future right-of-way line.
Traffic Counts: Our most recent average daily traffic count (ADT) reflects 300-400 vehicles taken in 2004.
REQUIREMENTS:
' 'ccess: There are two existing access locations to the proposed USR. The southern access has dual
,.urposes, to provide access to the Fulton Ditch and to the gas/well tank site locations. At the end of this
access point, there is a turnaround and a locked gate providing access to the proposed parking arena. The
north access is also gated at approximately 100 yards from WCR 31. There are two gated access points at
this location. The north access road provides access to the proposed parking area. The other access appears
to access the home and barn section.
I recommend that both the north and south access gates be opened as not to back up, stage, or park overflow
traffic on to WCR 31 if being used to accommodate the parking area prior to an event.
Parking Circulation: The parking lot appears to be between two and three acres. The applicant has fenced
this section with temporary fencing that could be adjusted to accommodate additional parking. If all vehicles
are parked property, one acre would accommodate approximately 100 vehicles. The applicant is not indicating
a special location for pickup and horse trailer parking that requires additional parking space or any overflow
parking that might be necessary on site.
Off-Street Parking: The off-street parking including both access drives shall be surfaced with gravel or the
equivalent and shall be graded to prevent any drainage problems.
Storm Water Drainage: I inspected the size of the property and the configuration. It is located between two
ditches with vegetation I did not see any potential drainage problems where water would leave the site and
cause property damage to the adjacent properties.
Clarification: The applicant is identifying on the plat drawing a horse trailer parking area on the adjacent
^roperty to the west. Clarification is needed as to whether the applicant has approval from the adjacent
roperty owner to accommodate this item or does Planning Services have a problem with this issue?

Environmental Health Services has reviewed this proposal for a recreational facility
including horse racing tracks and courses. We have no objections to the proposal,
however, the application lacks a description for adequate sewage disposal for the
proposed use. The application indicates that up to 1,000 people may be using the site
and that sewerage will be Port-a Johns. Port-a Johns are not adequate to serve this
permanent use and the potential volume of people. An Individual Sewage Disposal
System is more appropriate for the use.
The application indicates water availability via a commercial well, but does not indicate
what measures will be taken to ensure that the well water is potable or how race
attendees and volunteers will have access to the water for drinking or sanitary
purposes.
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
2. The potable water system shall comply with the Colorado Primary Drinking Water
Regulations (5 CCR 1003-1). The applicant shall submit evidence to the Weld
County Department of Public Health and Environment of compliance from the
Water Quality Control Division (WQCD), Colorado Department of Public Health
and Environment. Alternately, the applicants can provide evidence from the
WQCD that they are not subject the requirements.
3. The applicant shall submit a waste and manure handling plan, for approval, to
the Environmental Health Services Division of the Weld County Department of
Public Health & Environment. The plan shall include at a minimum, the
following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to issuance of building permits:
4. In the event that 1 or more acres are disturbed during the development of this
site, the applicant shall inquire with the Water Quality Control Division (WQCD) of
the Colorado Department of Public Health and Environment if they are required
to obtain a stormwater discharge permit. Alternately, the applicant can provide
evidence from WQCD that they are not subject to these requirements.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required and shall be installed according
to the Weld County Individual Sewage Disposal Regulations. The septic system
is required to be designed by a Colorado Registered Professional Engineer. In
the event the septic system(s) requires a design capacity of over 2,000 gallons of
sewage per day the applicants shall provide evidence that all requirements of the
Water Quality Control Division of the Colorado Department of Public Health and
Environment have been satisfied. Evidence of compliance shall be provided to
the Weld County Department of Public Health and Environment.
2. The applicant shall submit evidence of an Underground Injection Control (UIC)
Class V Injection Well permit from the Environmental Protection Agency (EPA)
for any large-capacity septic system (a septic system with the capacity to serve
20 or more persons per day). Alternately, the applicant can provide evidence
from the EPA that they are not subject to the EPA Class V requirements.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. Animal and feed wastes, bedding, debris and other organic wastes shall be
disposed of so that vermin infestation, odors, disease hazards, and nuisances
are minimized. Such wastes shall be removed at least weekly from the facility
and disposed by a commercial hauler.
2. The facility shall be operated in a manner to control flies.
3. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and

Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
4. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
5. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
6. The applicant shall operate in accordance with the approved "waste handling
plan".
7. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
8. The facility shall have sufficient equipment available to implement dust control as
required by the Weld County Department of Public Health and Environment.
9. There shall be no open burning conducted on the site, with exception to burning
defined as "agricultural open burning" as defined by Regulation No. 9 of the
Colorado Air Quality Control Commission Regulations,
10.This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
11.Adequate handwashing and toilet facilities shall be provided for volunteers and
attendees.
12.Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
13.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
14.If applicable, the water system shall comply with the requirements for a
community water system as defined in the Primary Drinking Water Regulations (5
CCR 1003-1).
15.If applicable, the applicants shall ensure compliance of the Colorado Retail Food
Establishment Rules and Regulations Governing the Regulation of Food Service

Establishments.
16.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code,

A Site Specific Development Plan and special Review permit for Recreational facilities and uses including race
tracks and race courses (horse racing) in the A (Agricultural) Zone District.
1. A building permit shall be obtained prior to the construction of any new building.
2. A plan review is required for each building for which a building permit is required. Plans shall include a floor
plan. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans
are required when applying for each permit. Provide a Code Analysis Data sheet provided by the Weld County
Building Department with each Building permit application.
-a- Buildings shall conform to the requirements of the various codes adopted at the time of permit application.
Jrrently the following has been adopted by Weld County: 2003 International Building Code; 2003 International
Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; and the 2002 National
Electrical Code and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical report or an open
hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a
Colorado registered engineer.
3 The structures (if built)will probably be classified as a U ( horse barn) and A-5 (bleachers) occupancy. Fire
resistance of walls and openings, construction requirements, maximum building height and allowable areas will
be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance.
6. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of
determining the maximum building size and height for various uses and types of construction and to determine
compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be
measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset
and setback requirements. Offset and setback requirements are measured to the farthest projection from the
building.
7. Portable toilet facilities shall meet the minimum number in table 2902.1 for bleacher facilities.
8. The bleachers, when built, shall be built to standard ICC/ANSI 300-2002.

Uses Including Race Tracks and Race Courses (Horse Racing) in the Agricultural Zone District

NRCS REPESENTATIVE: Jan Fritch, District Conservationist
In consultation with the Natural Resources Conservation Service(NRCS),we have reviewed the above
referenced case and have the following comments:
SOILS/LIMITATIONS: The proposed site specific development plan for a horse race track is located
on the following soil types: Loup-Boel loamy sand(35),Nelson fine sandy loam(38), Olney loamy sand
(44), Olney fine sandy loam(47)and Vona loamy sand(73). The Olney and Vona soils have slight
limitations for dwellings with or without basements. Loup-Boel soil has severe limitations for dwellings
with or without basements due to its wetness and flooding potential;Nelson soil has moderate to severe
limitations for this use due to shallow depth to rock. Special engineering design maybe required for
foundations constructed in both of these soil types.
For sanitary septic system absorption fields, the Olney and Vona soil types have slight limitations. The
Loup-Boel soil has severe limitations for this use due to its rapid permeability and flooding potential;
Nelson soil has severe limitations for septic absorption fields due to shallow depth to rock. Again, special
engineering design may be required for these structures in both soil types.
PRIME FARMLANDS: When irrigated, the Olney fine sandy loam soil is considered `prime farmland'.
SOIL EROSION POTENTIAL: All of the soil types found on the proposed development parcel have
high potential for wind erosion. Appropriate measures should be taken to minimize wind soil erosion
during future construction activities, such as avoiding disturbances to large areas and preventing soil
movement offsite. Developments such as race tracks with their associated facilities and parking areas will
result in large areas disturbed during construction as well as during ongoing operation. Given that fact, it
is strongly recommended that at the conclusion of construction activities disturbed areas be stabilized
with gravel,pavement and,perhaps,perennial vegetation in areas that will not be used on a regular basis.
Should fugitive dust become a problem during operation, consideration should be given to applying water
to tracks,parking areas and other associated facilities to reduce the problem. The NRCS can be contacted
for more information on grasses suitable for the site and instructions for planting.
OTHER: Weed infestation can be a serious problem with developments such as that proposed. Should
this occur the applicant can contact Ron Broda,Vegetation Weed Management Specialist with the Weld
County Public Works Department at(970) 356-4000 X 3770 for assistance in developing a weed
management plan.

Subject: USR-1483 Referral
Upon review of my case files and computer, a Zoning Violation (VI-0400103)was noted. The violation was
initiated as a result of commercial rodeo events without a Use by Special Review(USR)permit. The property
owner has since submitted this Use by Special Review(USR-1483)application to the Department of Planning
Services.
Additionally,a building permit(BCS-030082)was located for the conversion of a garage into a craft/computer
room. The last inspection conducted on this permit was on April 17, 2003,as a result, it is facing expiration.
This aspect will need to be addressed with Peggy Gregory, Building Compliance Officer.
Due to the prompt response of the property owners,this case has not been presented to the Board of County
Commissioners through the Violation Hearing process.
Should this Use by Special Review(USR-1483)application be approved,the plat shall be recorded within 30
days of approval to avoid revocation proceedings. As soon as the plat has been recorded,this violation will be
closed.
Should this Use by Special Review (USR-1483) application be denied, the applicant shall have 30 days to
remove all commercial equipment and associated activity prior to proceeding with the violation process.

Re: Horse race application
I am a Community Resource Officer for the Weld County Sheriffs Office assigned
to the south east portion of the county. I was asked by Weld County Planning and
Zoning to provide a response for USR-1483. After researching this application and
visiting the area where the races are to occur I can make the following response.
Every week I man a "Storefront" at the AWRP community building located in the
Aristocrat subdivision. This service is provided to the citizens Aristocrat so that
they can come visit me and voice law enforcement concerns in their community.
For the past several months I have had dozens of citizens come in to complain about
the hone racing events that Mr. Gutierrez hosts at his property. The 3 major
complaints these people have are; 1. The spectators park their vehicles along WCR
31, thus causing a traffic hazard. Some of the spectators have even been known to
park their vehicles in neighboring driveways. 2. Spectators leaving the property
and urinating along the public roadway or in view of the neighboring property. 3.
Spectators leaving the property and loitering along the roadway or trespassing
across the neighboring properties.
I checked our calls for service at this location and we have received several calls
complaining about the traffic hazard created by the spectators parking along the
road as well as some public urination complaints.

As of this time the Sheriffs Office has handled several calls at this location and up to
now Mr. Gutierrez has had fairly low attendance at his events. I read in the
application that Mr. Gutierrez plans to have up to 1000 people attend these events.
As a law enforcement officer this concerns me. Luckily we have had no traffic
accidents due to the cars parked along the road but I believe it will only be a matter
of time until we have one. WCR 31 is a heavily traveled road, it is one of the main
roads used by the citizens of Aristocrat Ranchettes. I have attached photos that
show WCR 31. You will be able to see that there is no place to park along the
roadway. I was also given a video tape by one of the neighboring property owners
who filmed the traffic problem that occurs on the days the horse races take place.
I believe it will be very easy for spectators to bring alcoholic beverages onto the
property, and as stated before there is expected to be a large number of people
attending these events. These two factors create the possibility of people drinking
and driving when they leave the event. I also fear the possibility of people fighting
and other such criminal activity occurring at these events.
During the time these events are scheduled to take place the Sheriffs Office has only
1 deputy scheduled on duty in the south east portion of the county. I fear these
events will increase the call load for this deputy and create a potentially unsafe
situation for the citizens in southeast Weld County.
The applicant mentions nothing about security being provided. With the crowds
that are expected I believe not having security is inappropriate.
When I looked at the property I did not see very much lighting on the property. If
these events linger into the evening I believe the lack of adequate lighting will cause
an unsafe condition.
I did not see in the application where liability insurance has been obtained. I do not
know for sure if this is a requirement but I believe this question needs to be
addressed.
Based upon my listed concerns I recommend that this application be denied.

The following photos show how WCR 31 does not accommodate parking on the
roadway. Also, I have included a video tape given to me by Aristocrat resident,
Marty Matthews who lives at 15075 Higgins. Mr. Matthews taped the traffic
problems that occur during these race events. He taped 2 separate days. The first
was on 3/27/04 and the second on 7/18/04. I highly encourage that you view this tape
to see the traffic problem this creates.
