HEALTH SERVICES As a result of a complaint received in our office on April 14, 2005, concerning excessive wear of County Road 46 and the stockpiling of contaminated soil on Petro-Canada Resources property located on the corner of County Roads 49 and 46, an investigation was conducted. Bethany Salzman accompanied me during the site investigation. It appears approximately 10 acres or more is being used to stockpile contaminated soil. The southern portion of the facility contained piles of unknown substance as observed in photos 1 through 4. Photos 5 and 6 show an empty cell that appears to be in preparation to lay out soils for remediation or plastic to stockpile more contaminated soils. There appears to be three to six cells that have been constructed. Three of those cells appear to contain stockpiles of contaminated soil. Containment berms were observed around the stockpiled areas. Plastic was shown to be laying underneath the soil stockpiles. However, the plastic was limited to the edge of soil stockpiles and not within the entire containment area (shown in photo 14). Photos 10 through 12 were of Action Oil located at the northwestern portion of Petro-Canada Resources property and land in between the stockpiles. In photo 17 it is observed that drilling mud or other material has been placed outside of stockpile/treatment area. Additional acreage surrounding the treatment area appears to have had this drilling mud or other material spread throughout the acreage. The entire site consists of 160 acres. Communications with Patrick Flinn (303-706-1094 ext: 301, Mobile: 303-941-0389), a representative for Petro-Canada Resources, formerly known as Prima Oil & Gas, indicated they are currently stockpiling hydrocarbon contaminated soil on the site. He said the contaminated soil on site came from soil that was excavated from two different Petro-Canada sites. The soil is contaminated with light hydrocarbons which volatilize more quickly than the heavy hydrocarbons like crude oil. Once the soil is remediated it will then be used during construction projects and in berms, roads, and as back fill for other remediation projects. He said they intend to obtain a permit to conduct a centralized on site land treatment. Mr. Flinn committed to providing an application for a Special Use Permit by the end of April. It appears that this operation might be out of compliance with the Weld County Code. As a result, I recommend you initiate a violation process. I have also forwarded a copy of this report to Troy Swain and Dan Joseph in the Environmental Health Services Division so that the can assess the facilities compliance with stormwater regulations. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide comments. According to the referral information the only water supply that will be used at the site is water transported to the site by truck. Therefore, our office has no comments regarding the proposed plan. The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: WCR 46 is designated on the Weld County Road Classification Plan (FHU) as a local gravel road, which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. The most recent traffic count on WCR 46 between 49 and 51 reflects 107 vehicles per day. This count was ken in 2003. REQUIREMENTS: Access: The main and only access to the proposed USR site is at the top of the hill adjacent to the oil and gas tank batteries,. There is adequate sight distance and turning radiuses at this location. The access road should be included in the USR application. Circulation: The circulation throughout the site is adequate. Utilize the designated haul road for access to the unloading areas. Storm Water Drainage: The applicant is identifying an earth berm located around the site. Materials are stockpiled with either fabric or plastic to control saturation. I am referring the major portion of the storm water run-off to the Health Department, as it deals with oil and gas-related saturated soils. Non-manned Site: The applicants have indicated that this proposed site for the USR is a non-manned site. The site is only utilized when there is a spill at a drilling site and materials need to be transported to this facility. The main office is located at the corner of WCR 46 and WCR 49. Dust suppressant: The applicant shall apply dust suppressant chemical (magnesium or calcium chloride) on WCR 46 adjacent any existing or future structures between WCR 49 and the main entrance to the land treatment facility when hauling is occurring. The land treatment facility shall be constructed and operated in accordance with the approved design. Evidence shall be submitted to the Weld County Department of Public Health and Environment and the Colorado Oil & Gas Conservation Commission that demonstrates the land treatment facility was constructed in accordance with the approved design. 5. A detailed closure plan shall be submitted to the Weld County Department of Public Health and Environment and the Colorado Oil and Gas Conservation Commission. The closure plan shall include a description of the manner in which the treated and hydrocarbon contaminated soils will be disposed of, as well as specific details regarding reclamation of the property. No equipment associated with the facility shall remain on the property following closure. 6. The facility shall post financial assurance with the Colorado Oil and Gas Conservation Commission (COGCC). The financial assurance shall be adequate to cover a third-party closure of the facility, including removal of soil that has been affected by hydrocarbons or other contamination. The site shall be returned to its original grade. In the event the COGCC does not have the authority to require financial assurance for the entire cost required for third- party closure, the facility shall post the remainder of the financial assurance with Weld County. The facility shall submit evidence to the Weld County Department of Public Health and Environment. We recommend that the following requirements be incorporated into the permit as development standards: 1. The facility shall be constructed and operated to ensure that contamination of soils and groundwater does not occur. 2. Safe and adequate sewage disposal system shall be available on the facility premises. 3. A safe and adequate fresh water supply shall be available on the facility premises. 4. No disposal of waste other than non-hazardous hydrocarbon-affected soil and frac sand derived from Petro-Canada oil and gas properties in Weld County. 5. Any wastes generated on the facility shall be disposed in accordance with the Colorado Solid Waste Act, Section 30-20-100.5, C.R.S., or other appropriate rule, regulation, or law. 6. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A), as measured according to Section 25-12-102, C.R.S. 7. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 8. All chemicals stored on site must be stored according to manufacturer recommendations for safe storage and handling. 9. The facility shall notify the Weld County Department of Public Health and Environment, Weld County Planning Department, and Colorado Oil and Gas Conservation Commission a minimum of 90 days prior to closure. 10. The ground water monitoring wells shall be sampled quarterly. At a minimum, ground water samples shall be analyzed using an appropriate method for: depth to groundwater, Total Petroleum Hydrocarbons (TPH), Benzene, ethyl benzene, toluene, xylene. The facility shall submit groundwater monitoring results quarterly to the Weld County Department of Public Health and Environment and the Colorado Oil and Gas Conservation Commission. In the event the down gradient wells exhibit a statistical increase over background levels, the facility shall: a. Cease accepting contaminated soil on-site, pending review of analytical data by Weld County Department of Public Health and Environment and the Colorado Oil and Gas Conservation Commission. b. Notify the Weld County Department of Public Health and Environment and Colorado Oil and Gas Conservation Commission in writing within five (5) working days. c. Immediately develop a plan to determine the extent of contamination. This plan must be approved by the Weld County Department of Public Health and Environment and Colorado Oil and Gas Conservation Commission. d. Upon determining the extent of contamination, the facility shall develop a remedial action plan. This plan must be reviewed and approved by the Weld County Department of Public Health and Environment and Colorado Oil and Gas Conservation Commission. 11. The facility shall collect and analyze soil samples semi-annually directly beneath the treatment area. Samples shall be collected at a minimum of ten (10) separate locations. These samples shall represent impact from the facility to a depth of five (5) feet. In addition, yearly soil samples shall be collected at five, ten, fifteen, and twenty feet (or sampled to groundwater). At a minimum, these soil samples shall be analyzed using an appropriate method for: Benzene, ethyl benzene, toluene, xylene, Total Petroleum Hydrocarbons and Oil and Grease. The facility shall submit soil monitoring results (including sample locations) to the Weld County Department of Public Health and Environment and the Colorado Oil and Gas Conservation Commission. In the event the soils exhibit an impact from the facility at a depth greater than five (5) feet from grade, the facility shall: a. Cease accepting contaminated soil on site, pending review of analytical results by the Weld County Department of Public Health and Environment and Colorado Oil and Gas Conservation Commission. b. Notify the Weld County Department of Public Health and Environment and Colorado Oil and Gas Conservation Commission in writing within five (5) working days. c. Immediately develop a plan to determine the extent of contamination. This plan must be approved bye the Weld County Department of Public Health and Environment and the Colorado Oil and Gas Conservation Commission. d. Develop a remedial action plan addressing clean up of the contaminated soil and determine and amend operational practices as necessary to abate the impact. The plan shall be approved by the Weld County Department of Public Health and Environment and Colorado Oil and Gas Conservation Commission. The facility must receive approval from the Weld County Department of Public Health and Environment and Colorado Oil and Gas Conservation Commission prior to accepting additional contaminated soils on site. 12. Soil and groundwater monitoring requirements may be revised and amended at a later date. The Weld County Department of Public Health and Environment reserves the right to require additional environmental monitoring requirements if the facility demonstrates that it is necessary. The facility may request to the Weld County Health and Planning Departments to amend monitoring requirements provided an adequate demonstration can be made of the irrelevance of the monitoring. 13. Any analysis of waste shall be forwarded to the Weld County Department of Public Health and Environment, Environmental Health Services Division. The Division reserves the right to require additional, more extensive monitoring at a later date. 14. The facility must comply with the laws, standards, rules and regulations of the Air Quality Control Commission, the Water Quality Control Commission, the Hazardous Materials and Solid Waste Division, the Colorado Oil and Gas Conservation Commission, any other applicable agency, and all applicable Weld County zoning laws and ordinances. 15. Any solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 16. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 17. All storm water, which has come into contact with waste materials on the site, shall be confined on the site and bermed in accordance with the Colorado Oil and Gas Conservation Commission rule 907 and the submitted application materials to the Colorado Oil and Gas Conservation Commission and Weld County Department of Public Health and Environment for review and approval. 18. In the event that storm water is not adequately controlled on the site, upon written notification from the Weld County Department of Public Health and Environment or the Colorado Department of Public Health and Environment, a comprehensive site-wide storm water plan shall be developed and implemented. The plan must be approved, in writing prior to implementation by the Weld County Department of Public Health and Environment. 19.
