RE: APPROVAL OF LOT SIZE VARIANCE NO. 111 - BERNARD AND MICHELE
WAGY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has determined
at a public meeting held on the 30th day of July, 1980 in the
Chambers of the Board of County Commissioners of Weld County,
Colorado that a ceratin parcel of land is owned by Bernard and
Michele Wagy, which land is more particularly described as follows :
Part of the Southwest Quarter of Section
15, Township 2 North, Range 68 West of
the 6th P.M. , Weld County, Colorado
WHEREAS, the owners of said tract of land desire to obtain
a variance from the minimum lot size requirement so that said
applicants may make application to the Board of County Commis-
sioners for a recorded exemption, as set forth in Section 9-4 .A. (6)
of the Subdivision Regulations , and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado feels that the applicants have shown good cause for
granting a lot size variance under Section 9-4 .A. (6) of the Weld
County Subdivision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that a variance from lot size
requirements be, and hereby is, granted to Bernard and Michele
Wagy for the above described parcel of land, however, the appli-
cants should be aware of the lot width requirements in the Agri-
cultural Zone District. If either lot has less than 180 feet of
road frontage, the owners must apply for a lot width variance from
the Weld County Board of Adjustment.

Re: Lot Size Variance #111
Dear Commissioners:
The attached letter and related materials are in reference to a request
for a lot size variance from Bernard and Michele Wagy. The property on
which this request has been made is described as part of the SW14, Section
15, T2N, R68W of the 6th P.M. , Weld County, Colorado. This property is
located in Rinn at the Southeast corner of the intersection of Weld County
Roads 7 and 201/2. The property under consideration contains approximately
one (1) acre of nonirrigated soils. The request is to obtain a variance
from the minimum lot size requirement, Section 9-4. A. (6) of the Weld
County Subdivision Regulations, so that they may make application for a
recorded exemption.
The Wagy's wish to divide the property in order that they may sell the
blacksmith shop. The Wagy's will continue to reside on the remainder of
the property.
Based upon the information submitted and the adopted policies in the County,
the Department of Planning Services Staff recommends this request be approved
for the following reasons:
1. The proposed request conforms with the intent clause of the
recorded exemption procedure (Section 9-2 of the Weld County
Subdivision Regulations) . The intent clause of the Agricul-
tural District (Section 3.3.A of the Weld County Zoning Resolu-
tion) , and the Weld County Comprehensive Plan because the request
will be compatible with surrounding land uses. Both lots contain
existing improvements and are located within an existing community,
the unincorporated town of Rinn.
2. The request complies with Section 9-4 A. (6) of the Weld County
Subdivision Regulations because in the opinion of the Department
of Planning Services Staff, the applicant has shown good cause
for the variance.

The Department of Planning Services would like to make the applicants aware
of lot width requirements in the Agricultural Zone District. If either lot
has less than 180 feet of road frontage, the owners must apply for a lot
width variance from the Weld County Board of Adjustment.
The Weld County Health Department has no objections to the use of a cistern
on the property until a tap can be issued from the Left Hand Water Supply
Company.

RESOLUTION
LEFT HAND WATER SUPPLY COMPANY
BE IT RESOLVED that the Board of Directors of the Left Hand Water Supply
Company hereby makes the following requirements concerning raw water derived
from any stock or other water rights deriving their water from Boulder Creek,
a part of the rules and regulations of Left Hand Water Supply Company:
1 . Any tap committed after April I , 1979 to a parcel of land which is
in the Boulder Creek drainage area shall be required to submit stock
or water rights which have historically irrigated lands for which
application is made. Such stock or water rights shall have derived
their raw water source from Boulder Creek. Left Hand Water Supply
Company shall have the right to not accept such water until after
additional raw water storage has been procured by said Water Com-
pany.
2. The Board of Directors of the Left Hand Water Supply Company shall
have sole discretion to waive this requirements after they have
procured storage facilities in the Boulder Creek drainage that will
adequately supply water for a future filtration facility in the
Boulder Creek drainage area.
3 . This resolution is required because the current filtration capacity
of the Left Hand Water Supply Company has been totally committed
to other domestic taps and the exchange potential of the current
treatment facility has reached its maximum capacity.
The Left Hand Water Supply Company is currently actively pursuing an agreement
for such storage facilities but makes no guarantees as to how soon these facili -
ties may be acquired or additional treatment facility will be constructed.
