RE: CREATION OF SOUTHWESTERN WELD COUNTY LAW ENFORCEMENT AUTHORITY
A public hearing was conducted on August 29, 2005, at 10:00 a.m., with the following present:
Commissioner William H. Jerke, Chair- EXCUSED

The following business was transacted:
I hereby certify that pursuant to a notice dated July 15, 2005, and duly published July 20, 27, and
August 3, 2005, in the Fort Lupton Press, a public hearing was conducted on August 8, 2005, to
consider the Creation of the Southwestern Weld County Law Enforcement Authority. At said
hearing,the Board deemed it advisable to continue the matter to August 29, 2005,to allow time for
the completion of a work session. At said hearing on August 29, 2005, Lee Morrison, Assistant
County Attorney, made this a matter of record.
Mr. Morrison stated the first Resolution before the Board is the Declaration of Intent to Create the
Southwestern Law Enforcement Authority, which has the effect of placing the matter on the ballot
for the November election. He further stated a provision states action may not be taken earlier than
45 days before the election date, and recommended the Resolution be continued to a later date.
Mr. Morrison stated the second Resolution before the Board is the Approval of the Ballot Question,
requesting authorization of a levy of seven mills, as well as a provision allowing for growth.
Responding to Commissioner Vaad, Mr. Morrison stated only the residents and eligible property
owners within the boundaries of the District would be allowed to vote on the ballot issues. He
further stated the purpose of these ballot issues is to create a seed from which the Law
EnforcementAuthority may expand. He stated additional properties may be added in the future by
petition and election, or by petition signed by all electors and property owners. Mr. Morrison stated
as more development occurs in the area,the developers of the additional properties are in control,
and would be responsible to bring any new developments into the seed district. He stated a map
has been presented indicating the area generally included;however,municipalities are not included
in the Law Enforcement Authority. He further stated personal property,and aboveground equipment
for mineral development would be included; however, the actual mineral estate would not be
included.

Responding to Commissioner Vaad, Mr. Morrison stated the Resolution of Intent is tentatively
scheduled to come before the Board on September 21,2005,to coincide with the 45 day time limit.
Responding to Chair Pro-Tern Geile, Mr. Morrison stated existing developments may seek and
petition to join,and hold the required election,if they so choose;however,existing developments are
not required to join. He further stated future developments in the District would be required to
participate, and the developer will need to petition to join during the development process.
Marvin Dyer,Adler Farms representative, stated he did not understand how future developments
could be accepted without an election. Responding to Mr. Dyer, Mr. Morrison stated a petition
signed by both the electors and the owners of the land would not require a further election; however,
a resolution would come before the Board of County Commissioners to include the development
in the Law Enforcement Authority. Mr. Morrison further stated if a majority of residents in
developments within the present target area are interested in joining, an election can be held.
Responding to Mr. Dyer, Mr. Morrison stated any residents in the boundaries of the District who
desire a greater level of law enforcement, and are willing to pay for the services, may join.
Mr. Morrison presented a map of the boundary of the proposed Law Enforcement Authority to Mr.
Dyer, and stated the map is a concept of residents/landowners who would be eligible to join. He
stated the County will expect any new Urban-type developments to petition,as a part of the rezoning
process. He further stated previously approved Urban-type developments can seek to join, but will
not be required to join. Responding to Commissioner Vaad, Mr. Morrison stated a majority of the
residents in Idaho Creek would have to petition to be able to join. Responding to Mr. Dyer, Mr.
Morrison stated all residents in unincorporated Weld County receive law enforcement services from
the Sheriff's Office; however, the available resources for support are not comparable to an
Urban-type Police Department. He stated the purpose of the Law Enforcement Authority would be
to enhance the level of protection and presence of officers within the boundary. He further stated
Weld County currently provides services to several municipalities through contracts, and the intent
of this Authority would be similar to those agreements.
Responding to Mr. Dyer, Don Warden, Director of Finance and Administration,stated the services
in the area would be enhanced by extra patrol services, as is typical in a municipality. He stated
incidents and concerns from residents would have a quicker response time. Responding to Mr.
Dyer, Mr. Morrison stated Vista Ridge could be included in the Law Enforcement Authority;however,
it is not required to join. He further stated information about joining should be made available to the
residents and property owners in Vista Ridge, as well as other developments.
Commissioner Masden moved to approve the Ballot Question for the 2005 General Election, and
continue Declaring Intent to Create to September 21,2005,at 9:00 a.m.The motion was seconded
by Commissioner Vaad,and it carried unanimously. There being no further discussion,the hearing
was completed at 10:15 a.m.
