HomeMy WebLinkAbout800865.tiff JaiiN RESOLUTION RE: DECLARE CERTAIN DATA PROCESSING EQUIPMENT AS SURPLUS PROPERTY AND APPROVE AGREEMENT BETWEEN WELD COUNTY, COLORADO AND BOULDER COUNTY, COLORADO WHEREAS, the Board of Colinty Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Weld County and Boulder County mutually agree that the following described data processing equipment is no longer needed for governmental purposes: IBM 370/138 Model J with features 4640 , 8075 , 4655 , 4722 , 9610 , 1431, 9317 , 3907 , 9080, 9650 , 9609 , 9423 , 9649 , 9314 , 9820, 4723 , 9651, 9611 , 4724 , 9652 , 9612 , 4725 , 9653 , 9613; with IBM 3046 Power Unit. WHEREAS, Weld County and Boulder County desire to declare said equipment surplus property, and WHEREAS, an agreement between Weld County and Boulder County which sets forth the procedures for the disposition of such pro- perty has been presented to the Board of County Commissioners of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado has studied said agreement and deems it advisable to approve the same . NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the hereinabove described equipment be, and hereby is, declared to be surplus property. BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County, Colorado that the agreement between Weld County and Boulder County which sets forth the procedures for the disposition of said surplus property be, and hereby is, approved. Markey ATTES . l///G Deputy County Clerk 1 AGREEIENT • THIS AGREEMENT is made and entered into this 2nd day of June, 1980 , by and between the COUNTY OF WELD, a political sub- division of the State of Colorado and the COUNTY OF BOULDER, a political subdivision of the State of Colorado. WITNESSETH: WHEREAS, the County of Weld and the County of Boulder, by an agreement dated October 8, 1975 , established the Boulder-Weld Computer Data Processing Center, and WHEREAS, the County of Boulder, on March 24 , 1980 pursuant to paragraph 12 of the above stated agreement, gave notice to the County of Weld of its intent to terminate said agreement on January 1, 1982, and • WHEREAS, it is the desire of Weld County and Boulder County to sell certain data processing equipment and purchase other data processing equipment to satisfy the needs of the Boulder- weld Computer Data Processing Center between the present date and the termination of the agreement on January 1, 1982. NOW, THEREFORE, in consideration of the foregoing and of the mutual covenants and agreements hereinafter set forth, the parties hereto legally intending to be bound thereby, do covenant and agree, for themselves and their respective successors and assigns, as follows: 1. Weld County and Boulder County mutually agree that the following described equipment is surplus property: IBM 370/138 Model J with features 4640 , 8075 , 4655 , 4722, 9610 , 1431, 9317, 3907, 9080 , 9650 , 9609 , 9423 , 9649 , 9314 , 9820 , 4723, 9651, 9611, 4724 , 9652 , 9612 , 4725, 9653 , 9613; with IBM 3046 Power Unit. 2 . Weld County and Boulder County mutually agree that the Director of the Boulder-Weld Computer Data Processing I Center shall, in conjunction with the Weld County Direc- tor of Purchasing, prepare bids and advertise for the sale of the abovedescribed surplus equipment. 3. Weld County and Boulder County further mutually agree that the high bid received for the abovedescribed equipment shall be accepted unless, upon review of the bid and within ten (10) days of the bid opening, both Boards of County Commissioners determine that the high bid should be rejected. 4 . Weld County and Boulder County mutually agree that all costs associated with the sale of said surplus equipment shall be charged to the Boulder-Weld Com- puter Data Processing Center and said Center shall make full payment of any remaining balance on the contract for the purchase of the abovedescribed surplus equipment out of the proceeds of said sale . Any net proceeds remaining after the deduction of the aforementioned costs and payments shall be remitted to the Boulder and Weld County Treasurers for deposit in the same proportion of payment, which is 57% to Boulder County and 43% to Weld County. Weld County and Boulder County mutually agree that in order to serve the needs of the Boulder-Weld Computer Data Processing Center until its dissolution on January 1, 1982 , the acquisition of an IBM 4341 CPU and associate equipment on an IBM state and local lease is required. It is further agreed by the parties hereto that inasmuch as Weld County intends to continue operating a joint data processing center after January 1, 1982 , the County of Weld shall be the sole lessee of the IBM 4341 unit. 6 . Weld County and Boulder County mutually agree that between the date of acquisition of the abovedescribed fish‘ -� equipment and January 1 , 1982 , all rentals shall be billed from IBM directly to Weld County who in turn will bill the Boulder-Weld Computer Data Processing Center for the exact rental amount and said Data Pro- cessing Center shall reimburse the County of Weld ' said billed amount. 7. Weld County and Boulder County further mutually under- stand and agree that Boulder County shall have no obligation or interest in the IBM 4341 CPU and associate equipment acquired by Weld County for use by the Boulder-Weld Computer Data Processing Center under the abovedescribed lease.
