RESOLUTION
RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT#869 - PAULINE AND
DANIEL DAVIS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated February 8, 1989, the Board approved Use by Special
Review Permit#869 for a Home Business(trucking operation) in the A(Agricultural)Zone District
for Pauline and Daniel Davis on the following described real estate, to-wit:
Part of the NE1/4 of Section 28, Township 8 North,
Range 62 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from Daniel Davis, 43901 Weld County
Road 77, Briggsdale, Colorado 80611, to vacate said Use by Special Review Permit#869, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said vacation.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit#869 be, and hereby is, vacated.

SUBJECT: Vacation of USR-869
The Department of Planning Services has received the attached letter received February 24,
2005 from Daniel Davis. Mr. Davis is requesting that USR-869 for a trucking operation be
vacated.
Background information:
Legal Description: Lot B of RE-3613 Pt N2 NW4 Section 28, T8N, R62W of the 6th P.M.,
Weld County, CO.
Location: West of and adjacent to State Highway 392 and south of and adjacent to
State Highway 14.
USR-869: USR-869 was approved by the BOCC on February 8, 1989, for a home
business (trucking operation) as described in the application materials on
files in the A (Agricultural) Zone District.
The Department of Planning Services requests approval of this vacation.
