Subject. Request for Meeting Regarding Road and Bridge Audit
The Board of County Commissioners is in receipt of your letter dated July 9,
1984 indicating that the findings of an investigation of Road and Bridge
found: "There are serious allegations of inefficiencies and deficiencies in
those departments. Those allegations involve matters concerning disregard of
County Personnel Policy, shoddy performance, sex discrimination, training
qualification deficiency, supervisory deficiencies, favoritism, and waste of
money. It is apparent that the study has just scratched the surface. . ."
The Council also requested an Executive Session on July 17, 1984 to discuss
the report. The Board must decline this invitation to meet in Executive
Session because we can see no legal reason justified under the open meeting
statute to meet behind closed doors with the Council to discuss this public
document. The Board would be happy to meet with you at your requested time in
a public session.
The Board shares the concerns of the Council and public regarding the
management and performance of the Road and Bridge Department, but questions
the validity of "the audit" when it was conducted without any discussion or
contact with Road and Bridge management or members of the Board. To the
Board's knowledge the audit sources were two terminated Road and Bridge
employees. To this end, the Board would like to report to you and the people
of Weld County actions taken by the Board in Road and Bridge management to
address concerns of Road and Bridge shared by the Board, Council, and Weld
County citizens:
1. The Road and Bridge Department was reorganized in early 1984 to allow
improved management control.
2. All policies impacting Road and Bridge were reviewed and modified as
necessary by the Board of County Commissioners in January, 1984.
3. The attached list of specific management objectives and corresponding
time frames were directed by the Board to be accomplished by Road and
Bridge management in 1984.
4. On June 14, 1984, the Board issued a request for proposal for a
management improvement project and on July 16, 1984 the Board approved a
contract for a management assessment of Road and Bridge by a highly
respected and capable firm specializing in road and bridge operations.
5. A study has been conducted the last six to eight weeks concerning the
alternative of contracting for fleet management in Road and Bridge, with
results to be available in August.

6. On June 29, 1984 Weld County requested funds via the State Energy Impact
Assistance Fund to provide resources to develop a comprehensive pavement
management system in Weld County.
These initiatives have been taken by the Board the last six months in order to
improve the management and overall efficiency of road and bridge operations in
Weld County. The Board would have been happy to provide this and any other
available information to the Council or its investigator had they contacted
the Board, County Engineer, or any management person in Road and Bridge during
the course of the audit. Perhaps different conclusions could have been
reached by the Council or its investigator had you had knowledge of the above
information.
The Board is unable to respond to the allegations of disregard of County
Personnel Policies and sexual discrimination in Road and Bridge, since no
individual has filed any complaint or grievance via the Personnel Procedures
from Road and Bridge. A memorandum to all road and bridge employees
encouraging anyone with a complaint or grievance to contact Personnel will be
sent out to insure that any existing problems are being addressed by County
management. The Board also requests of the Council, the specific complaints
and incidents referred to in the letter in order to address any aggrieved
present or past employee.
If the Council wishes to meet with the Board of County Commissioners on July
17, 1984 at 4:00 p.m. , the Board will be happy to meet in a public session but
feel that it would be inappropriate, and possibly even illegal, to meet in an
Executive Session to discuss the matter. The Board will make themselves
available for a meeting with you in public session but will decline meeting
with you in an Executive Session. If the Council does not wish to meet with
the Board in a public session we would still, once again, request a copy of
the audit so Road and Bridge management and Board of County Commissioners can
respond to your concerns. Please advise the Board as soon as possible of your
decision of whether or not to have an Executive or public session July 17,
1984.

Subject: Request for Meeting Regarding Road and Bridge Audit
Your memorandum of July 16, 1984, delivered to the
secretary of the County Council at approximately
3:00 p.m. was received and noted by the President
of the County Council .
The Council sought an executive session for July 17,
1984, to discuss our report which contains names of
specific individuals we were seeking to protect.
It would appear that if the executive session would
be illegal , then an open session on Tuesday, July
17 would also be illegal for lack of notice of said
meeting. The Council is sorry that it was not able
to bring about a meeting with the Board of Commissioners
on this matter. We will try again in the future to
work out some method of communication between the Board
and the Council in matters considered to be important
to Weld County.
