LANDSCAPING/BUFFERING PLAN
A ten-foot setback will be provided for buffering adjacent to the north, west and
south boundaries of the property. The north portion of the property, which
borders State Highway 256, will have a 180-foot setback.
In addition, hay bales, or another means of screening (for example, earthen
berm), will be provided to protect the adjacent proposed home sites, when
homes are built, from headlights of vehicles entering and exiting the parking
area. In the event the adjacent property owners have installed a barrier that
shields headlight glare, hay bales will not be required.
If the property owners provide a letter to the owner of the recreational facility
stating that screening is not applicable, no extra buffering to shield headlights will
be required. The letter will be provided to Weld County Department of Planning
Services.
A plat note will be added to the recorded exemption and subdivision exemption
plats that states: "potential purchasers are hereby notified that a recreational
facility is located adjacent to the property".

Dear Western Mutual Ditch Company,
I appreciate your concerns for the ditch and it's shareholders. In your letter it states that
this property will no longer be cultivated is grossly over stated. Only a very small portion
of the site will not be cultivated, and much of that area will be planted with cover crops
i.e.: lawn and or wild grasses. The majority of the area will still be a cornfield and
parking lots planted to rye. The historic drainage will not be altered. It is my position that
the suggested retention pond is unnecessary.
As for the potential trash problem, the first five years did not create a trash problem and I
foresee no problem with trash in the future. Numerous trash containers are available
through out the area and trash is collected one or two times a day when we are open. The
potential trash issue period is a very short time. The maze is open no more than 10 weeks,
late in the irrigation season. It is my position that the suggested trash catchers and fence
are unnecessary.

Dear Glen and Sheri:
This letter is being sent to articulate the Western Mutual Ditch Company's concerns regarding
the development proposed pursuant to Case Number AmUSR-1268. Because of the proximity of
the Western Mutual Ditch to the proposed development, these concerns must be satisfactorily
addressed to preserve the agricultural uses made by shareholders of the Western Mutual Ditch
and to protect and promote the health, safety, convenience and general welfare of the present and
future residents of Weld County, particularly those who live in and around the Western Mutual
Ditch and/or depend upon the Ditch for their livelihoods.
Primarily, the Ditch Company is concerned with the preservation of the timing, amount and
quality of water to be carried in the ditch. It is essential that this development does not cause an
increase or decrease in the amount of water that will flow into the ditch, alter the timing of
return/storm water runoff into the Ditch, nor should it degrade the quality of water carried in the
Ditch. Based on the Site Plans provided to the Ditch Company, the possibility that the quantity
or quality of the water could be changed is very real, considering the fact this property will no
longer be cultivated farm ground and may include, among other things, increased spraying to
control weeds, operation of amusement park equipment and other small engine vehicles, increase
in motor vehicles on the property, a decrease in vegetation, an increase in the amount and type of
debris associated with the operation of an amusement park facility not normally found on a farm,
and an increase in the number of structures, compact earth, asphalt/concrete, paved or unpaved
parking lots and other changes which will alter the timing, quantity and quality of water
returning to the Ditch.

Second, the Ditch Company is concerned with the increase in the amount of trash and debris that
will be generated on the property in connection with the development, operation and use of the
amusement park facilities. If not properly controlled on the property, much of this trash could
end up accumulating in the Ditch. This will place an increased cost on the shareholders of the
Ditch as they may be forced to pay additional assessments to have the Ditch cleaned on a more
frequent basis. In addition, it could disrupt the ability of the Company to provide water to its
shareholders if the water must be shut down in order to clean the Ditch. At its worst, the effect
of increased debris in the Ditch could result in localized flooding if siphons, gates and check
structures "down stream" of the amusement park become plugged and cause the water in the
Ditch to back up.
The Ditch Company's position is that the developer should be responsible for these potential
damages and increased costs associated with their proposed new uses and should attempt to
mitigate them to reduce the possibility of damaging the Ditch Company and its shareholders. In
order to reduce the potential for future damages caused by the landowners and their
development, the Ditch Company suggests a retention pond be incorporated into the design, so
that water returning to the Ditch from the development can be monitored and controlled so that
the timing, quantity and quality of the water returning to the Ditch is the same as it has been
historically. In addition, trash catchers and fences should be required so that the potential for
accumulation of trash and debris in the Ditch will be reduced.
Nothing herein shall be deemed as mitigation or waiver of the Ditch Company's rights should
any actions or inactions associated with the development and/or actions or inactions by the
owners/operators/visitors/agents/licensees/invitees/assigns of the development injure the Ditch
Company. The Ditch Company appreciates the consideration of these concerns.

Based upon the information provided, I'm not going to require any highway improvements at this time. However,
should future traffic volumes increase, CDOT will require improvements to US 85 and potentially SH 256.
Also, because these volumes exceed those initially approved by the access permit, a new access permit must be
obtained. I would also urge the County to specify in the special review process, that the ingress traffic is planned
to come by way of US 85 and egress traffic is planned to go to SH 256.
Issuance of the permit is all but guaranteed.

Gloria:
Based upon several discussions with Glen Fritzler, it was learned that the best night ever for attendance at the
corn maize was 2,040 adults and 581 children (12 and under). The corn maize operates some weeknights and all
day Saturdays and Sundays with the busiest time being weekends from 7 P.M. to midnight. The operator
estimates that 75 - 80% of the customers will arrive in a three hour period sometime between 6 and 10 P.M.
Assuming 2 -3 adults per car, some 550 -815 vehicles will likely arrive at the site over three hours. This equates
to some 180 - 275 inbound vehicles per hour. Typically, vehicles will exit the site from 8:30 P.M. until midnight.
Site traffic enters from U.S. 85 and exits to State Highway 256. The operator has stated that signage is in place
to promote this routing.
Hope this helps better define the access permit. Give me a call if you have any questions.

The following are recommended changes to the Conditions of Approval and Development
Standards.
1) Add the following as Condition of Approval 1.C.12:
The plat shall be amended to include the location of the screening in the northeast corner of the site
as approved by the Board of County Commissioners. The plat shall indicate that the screening shall
be limited to hay bales and earthen berms unless otherwise approved by the Department of
Planning Services.
2) Add the following as Development Standard 37 and renumber:
At any time when more than the produce stand is operating from the site, an employee shall be
stationed at the entrance to the site to ensure traffic does not exit onto the Highway 85 frontage
road.
3) The applicant has completed conditions 1.6 regarding water service. Staff would ask that this
condition be removed.

Upon the signing of this permit the permittee agrees to the terms and conditions and referenced attachments contained
herein. All construction shall be completed in an expeditious and safe manner and shall be finished within 45 days from
Initiation. The permitted access shall be completed in accordance with the terms and conditions of the permit prior to
being used.
The permittee shall notify Linda McWilliams with the Colorado Department of Transportation in Greeley at 970-350-
2147 at least 48 hours prior to commencing construction within the State Highway right-of-way.
The person signing as the permittee must be the owner or legal representative of the property served by the permitted access and have full authority to
accept the permit and its terms and conditions.

1. If there are any questions regarding this permit,please contact Gloria Hice-Idler at(970) 350-2148.
2. The Permittee shall refer to all additional standard requirements included with this permit and any enclosed
additional terms,conditions,exhibits, and noted attachments.
3. Incorporated as part of this permit are the following:
Application for Access Permit(CDOT Form No. 137)
Permit(CDOT Form No. 101) and its two page attachment
Exhibits:

4. This permit is issued in accordance with the State Highway Access Code(2 CCR 601-1), and is based upon
the information submitted by the Permittee. This permit is only for the use and purpose stated in the
Application and Permit. Any changes in traffic volumes or type, drainage, or other operation aspects may
render this permit void,requiring a new permit to the be applied for based upon exisiting and anticipated
future conditions.
5. Access construction methods and materials shall conform to the Colorado Department of Transportation
Standard Specifications for Road and Bridge Construction (current edition).
6. If necessary,minor changes, corrections and/or additions to this permit may be ordered by the Department
inspector, other Department representative or local authority to meet unanticipated site conditions. Changes
may not be in violation of the State Highway Access Code. All major changes to the plans must be approved
in writing by the Department prior to commencement of any work on or within the State Highway
right-of-way.
7. This permit is subject to revocation due to: 1)Noncompliance with the provisions of this permit; 2)
Abandonment; 3) Supersedure by new permit covering the same installation; or 4) Conflict with necessary
planned highway construction and/or improvements. The Permittee shall promptly terminate occupancy upon
notice of cancellation of the permit from the Department,unless a new permit is applied for and granted.
8. Reconstruction and improvements to the access may be required when the Permittee has failed to meet the
required design and/or material specifications. If any construction element fails within two years due to
improper construction or material specifications,the Permittee is responsible for all such reparis.
9. The Department retains the right to perform any necessary maintenance work in this area.
10. Backing maneuvers within and into the State Highway right-of-way are strictly prohibited. All vehicles shall
enter and exist the highway right-of-way in forward movement. Backing into the right-of-way shall be
considered a violation of the terms and conditions of this access permit and may result in revocation of the
permit by the Department and/or the issuing authority.
11. All costs associated with the maintenance of this access are the responsibility of the Permittee. This includes
design, construction, signing and striping, utility relocation,testing of materials,and inspections.
12. Landscaping and site construction shall not obstruct sight distance at any State Highway access point.
Landscaping within the State Highway right-of-way requies the Permittee to obtain a CDOT Landscaping
Permit from the Maintenance Section. The access permit does not authorize that activity,although a proposed
landscaping plan shall be included in the access permitting document. Irrigation of features within the
right-of-way may require the Permittee to install a subsurface drain in accordance with CDOT Standard

" M-605-1 or other approved system. The Permittee shall contact Ed Stieber at the Evans Maintenance Office,
(970)506-4973,to obtain the Landscaping Permit.
13. Routine,periodic maintenance and emergency repairs may be performed within the State Highway
right-of-way,under the general terms and conditions of the pLimit. Any significant repairs such as culvert
replacement,resurfacing, or changes in design or specifications,will require written authorization from the
Department. The Department shall be given proper advance notice whenever maintenance work will affect the
movement or safety of traffic on the State Highway. In an emergency,the Department Region Office and the
State Patrol shall immediately be notified of possible hazards.
14. The access shall be maintaned at 16 feet wide with 20 foot radii.
15. The access shall be maintained in a manner that will not cause water to enter onto the roadway, and will not
interfere with the existing drainage system within the State Highway right-of-way. Drainage to the State
Highway right-of-way shall not exceed historical rate of flow.
16. The maintenance of the access and/or further development of this property shall not negatively impact
adjacent nearby properties. Correction of the problem and cost resulting from damages shall be borne by the
Permittee.

1- It is the applicant's responsibility to contact appropriate agencies and obtain all environmental clearances that apply

procedures, and all applicable U.S. Occupational Safety and Health Administration (OSHA) regulations- including, but not

-Safety and Health Regulations for Construction.
Personal protective equipment (e.g. head protection, footwear, high visibility apparel, safety glasses, hearing protection,
respirators, gloves, etc.) shall be worn as appropriate for the work being performed, and as specified in regulation. At a
minimum, all workers in the State Highway right of way, except when in their vehicles, shall wear the following personal
protective equipment: High visibility apparel as specified in the Traffic Control provisions of the documentation
accompanying the Notice to Proceed related to this permit (at a minimum, ANSIIISEA 107-1999, class 2); head
protection that complies with the ANSI Z89.1-1997 standard; and at all construction sites or whenever there is danger of
injury to feet, workers shall comply with OSHA's PPE requirements for foot protection per 29 CFR 1910.136, 1926.95,
and 1926.96. If required, such footwear shall meet the requirements of ANSI Z41-1999.

SUBJECT: AmUSR-1268, Glen Fritzler
As a follow-up with CDOT, Gloria Idler, on the status of the US Highway 85 Frontage Road which accesses the
Fritzler, Ms. Idler indicated that CDOT has had issues with Mr. Fritzer on this Frontage road and requires that it
be a one-way only.
The Weld County Public Works Department requests that the development standard 2G6 prior to recording the
plat be removed, which speaks to two-way traffic at the entrance.
2G6 shall be replaced with the following paragraph:
The main entrance to the facility from the US Highway 85 Frontage Road is identified as a one-way ingress
nnly. Access from the facility will be from the north/south road, which is a one-way out only to State Highway
56.

RE: Water Service—The Maize
Dear Mr. Fritzler:
This letter is in response to a request for water service to serve the following property described as
follows:
Part of Section 22, Township 4 North,Range 66 West of the 6th P.M., Weld County,
Colorado.
Water service is presently available to the above described property by tap number 406 located at
Weld Co. Rd. 44 between 31 & 33. Water service can be made available to this property for use at
the corn maze through the existing tap. This property has been petitioned into Northern Colorado
— Water Conservancy District.
New service will have to meet the criteria stated in the Water Shortage Contingency Plan adopted
by the Board on June 20, 20O2. Central Weld County Water District requires that contracts be
consummated within one (1) year from the date of this letter or this letter shall become null and
void unless extended in writing by the District. Please contact the Central Weld office for further
information about water service. Due to the rapid cost increase of raw water, existing tap fees may
not apply for water service to this property. The District will not notify, by separate letter, any
prospective landowners or land purchasers of tap fee or line extension cost increases. The cost of a
tap fee and/or improvements will have to be paid in advance to the District by the prospective
customer in accordance with District policy.
