The north portion of the property, which borders State Highway 256, will have a 180-foot setback. In addition, hay bales, or another means of screening (for example, earthen berm), will be provided to protect the adjacent proposed home sites, when homes are built, from headlights of vehicles entering and exiting the parking area. In the event the adjacent property owners have installed a barrier that shields headlight glare, hay bales will not be required. If the property owners provide a letter to the owner of the recreational facility stating that screening is not applicable, no extra buffering to shield headlights will be required. The letter will be provided to Weld County Department of Planning Services. A plat note will be added to the recorded exemption and subdivision exemption plats that states: "potential purchasers are hereby notified that a recreational facility is located adjacent to the property". May 5, 2005 EXHIBIT AMus2-tar June 3, 2005 Dear Western Mutual Ditch Company, I appreciate your concerns for the ditch and it's shareholders. In your letter it states that this property will no longer be cultivated is grossly over stated. Only a very small portion of the site will not be cultivated, and much of that area will be planted with cover crops i.e.: lawn and or wild grasses. The majority of the area will still be a cornfield and parking lots planted to rye. The historic drainage will not be altered. It is my position that the suggested retention pond is unnecessary. As for the potential trash problem, the first five years did not create a trash problem and I foresee no problem with trash in the future. Numerous trash containers are available through out the area and trash is collected one or two times a day when we are open. The potential trash issue period is a very short time. The maze is open no more than 10 weeks, late in the irrigation season. It is my position that the suggested trash catchers and fence are unnecessary. Because of the proximity of the Western Mutual Ditch to the proposed development, these concerns must be satisfactorily addressed to preserve the agricultural uses made by shareholders of the Western Mutual Ditch and to protect and promote the health, safety, convenience and general welfare of the present and future residents of Weld County, particularly those who live in and around the Western Mutual Ditch and/or depend upon the Ditch for their livelihoods. Primarily, the Ditch Company is concerned with the preservation of the timing, amount and quality of water to be carried in the ditch. It is essential that this development does not cause an increase or decrease in the amount of water that will flow into the ditch, alter the timing of return/storm water runoff into the Ditch, nor should it degrade the quality of water carried in the Ditch. Based on the Site Plans provided to the Ditch Company, the possibility that the quantity or quality of the water could be changed is very real, considering the fact this property will no longer be cultivated farm ground and may include, among other things, increased spraying to control weeds, operation of amusement park equipment and other small engine vehicles, increase in motor vehicles on the property, a decrease in vegetation, an increase in the amount and type of debris associated with the operation of an amusement park facility not normally found on a farm, and an increase in the number of structures, compact earth, asphalt/concrete, paved or unpaved parking lots and other changes which will alter the timing, quantity and quality of water returning to the Ditch. If not properly controlled on the property, much of this trash could end up accumulating in the Ditch. This will place an increased cost on the shareholders of the Ditch as they may be forced to pay additional assessments to have the Ditch cleaned on a more frequent basis. In addition, it could disrupt the ability of the Company to provide water to its shareholders if the water must be shut down in order to clean the Ditch. At its worst, the effect of increased debris in the Ditch could result in localized flooding if siphons, gates and check structures "down stream" of the amusement park become plugged and cause the water in the Ditch to back up. The Ditch Company's position is that the developer should be responsible for these potential damages and increased costs associated with their proposed new uses and should attempt to mitigate them to reduce the possibility of damaging the Ditch Company and its shareholders. In order to reduce the potential for future damages caused by the landowners and their development, the Ditch Company suggests a retention pond be incorporated into the design, so that water returning to the Ditch from the development can be monitored and controlled so that the timing, quantity and quality of the water returning to the Ditch is the same as it has been historically. In addition, trash catchers and fences should be required so that the potential for accumulation of trash and debris in the Ditch will be reduced. Nothing herein shall be deemed as mitigation or waiver of the Ditch Company's rights should any actions or inactions associated with the development and/or actions or inactions by the owners/operators/visitors/agents/licensees/invitees/assigns of the development injure the Ditch Company. The Ditch Company appreciates the consideration of these concerns. However, should future traffic volumes increase, CDOT will require improvements to US 85 and potentially SH 256. Also, because these volumes exceed those initially approved by the access permit, a new access permit must be obtained. I would also urge the County to specify in the special review process, that the ingress traffic is planned to come by way of US 85 and egress traffic is planned to go to SH 256. The corn maize operates some weeknights and all day Saturdays and Sundays with the busiest time being weekends from 7 P.M. to midnight. The operator estimates that 75 - 80% of the customers will arrive in a three hour period sometime between 6 and 10 P.M. Assuming 2 -3 adults per car, some 550 -815 vehicles will likely arrive at the site over three hours. This equates to some 180 - 275 inbound vehicles per hour. Typically, vehicles will exit the site from 8:30 P.M. until midnight. Site traffic enters from U.S. 85 and exits to State Highway 256. The operator has stated that signage is in place to promote this routing. Hope this helps better define the access permit. Give me a call if you have any questions. The Permittee shall refer to all additional standard requirements included with this permit and any enclosed additional terms,conditions,exhibits, and noted attachments. 3. Incorporated as part of this permit are the following: Application for Access Permit(CDOT Form No. 137) Permit(CDOT Form No. 101) and its two page attachment Exhibits: "A" -Vicinity Map 4. This permit is issued in accordance with the State Highway Access Code(2 CCR 601-1), and is based upon the information submitted by the Permittee. This permit is only for the use and purpose stated in the Application and Permit. Any changes in traffic volumes or type, drainage, or other operation aspects may render this permit void,requiring a new permit to the be applied for based upon exisiting and anticipated future conditions. 5. Access construction methods and materials shall conform to the Colorado Department of Transportation Standard Specifications for Road and Bridge Construction (current edition). 6. If necessary,minor changes, corrections and/or additions to this permit may be ordered by the Department inspector, other Department representative or local authority to meet unanticipated site conditions. Changes may not be in violation of the State Highway Access Code. All major changes to the plans must be approved in writing by the Department prior to commencement of any work on or within the State Highway right-of-way. 7. This permit is subject to revocation due to: 1)Noncompliance with the provisions of this permit; 2) Abandonment; 3) Supersedure by new permit covering the same installation; or 4) Conflict with necessary planned highway construction and/or improvements. The Permittee shall promptly terminate occupancy upon notice of cancellation of the permit from the Department,unless a new permit is applied for and granted. 8. Reconstruction and improvements to the access may be required when the Permittee has failed to meet the required design and/or material specifications. If any construction element fails within two years due to improper construction or material specifications,the Permittee is responsible for all such reparis. 9. The Department retains the right to perform any necessary maintenance work in this area. 10. Backing maneuvers within and into the State Highway right-of-way are strictly prohibited. All vehicles shall enter and exist the highway right-of-way in forward movement. Backing into the right-of-way shall be considered a violation of the terms and conditions of this access permit and may result in revocation of the permit by the Department and/or the issuing authority. 11. All costs associated with the maintenance of this access are the responsibility of the Permittee. This includes design, construction, signing and striping, utility relocation,testing of materials,and inspections. 12. Landscaping and site construction shall not obstruct sight distance at any State Highway access point. Landscaping within the State Highway right-of-way requies the Permittee to obtain a CDOT Landscaping Permit from the Maintenance Section. The access permit does not authorize that activity,although a proposed landscaping plan shall be included in the access permitting document. The Department shall be given proper advance notice whenever maintenance work will affect the movement or safety of traffic on the State Highway. The access shall be maintained in a manner that will not cause water to enter onto the roadway, and will not interfere with the existing drainage system within the State Highway right-of-way. Water service is presently available to the above described property by tap number 406 located at Weld Co. Rd. 44 between 31 & 33. Water service can be made available to this property for use at the corn maze through the existing tap. This property has been petitioned into Northern Colorado — Water Conservancy District. New service will have to meet the criteria stated in the Water Shortage Contingency Plan adopted by the Board on June 20, 20O2. Central Weld County Water District requires that contracts be consummated within one (1) year from the date of this letter or this letter shall become null and void unless extended in writing by the District. Please contact the Central Weld office for further information about water service. Due to the rapid cost increase of raw water, existing tap fees may not apply for water service to this property. The District will not notify, by separate letter, any prospective landowners or land purchasers of tap fee or line extension cost increases.
