RESOLUTION RE: APPROVE TASK ORDER FOR BIOTERRORISM PUBLIC HEALTH PREPAREDNESS PROGRAM AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Task Order for the Bioterrorism Public Health Preparedness Program between the County of Weld,State of Colorado,by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Department of Public Health and Environment, and the Colorado Department of Public Health and Environment, commencing September 1, 2005, and ending August 31, 2006,with further terms and conditions being as stated in said task order, and WHEREAS,after review, the Board deems it advisable to approve said task order, a copy of which is attached hereto and incorporated herein by reference. If approved, this will become part of the Master Contract between the Colorado Department of Public Health and Environment (CDPHE) and Weld County on behalf of the Department of Public Health and Environment (WCDPHE). With this task order, CDPHE is awarding Weld County renewal funding in the amount of $275,761 as pass through from the United States Department of Health and Human Services, Centers for Disease Control and Prevention (CDC) to provide public health preparedness and response to bioterrorism incidents, outbreaks of infectious disease, and other public health threats and emergencies. To accomplish this, statements of work and designated milestones have been established in the following project areas planning and response, information technology and communications infrastructure, training and exercising, disease investigation and control, and laboratory capacity and readiness. Enc. 2005-2892 DEPARTMENT OR AGENCY NAME COLORADO DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT DEPARTMENT OR AGENCY NUMBER FHA CONTRACT ROUTING NUMBER 06 FHA 00101 TASK ORDER Bioterrorism Public Health Preparedness Program THIS TASK ORDER is made this 12th day of August,2005,the State of Colorado, for the use and benefit of the COLORADO DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT,whose address or principal place of business is 4300 Cherry Creek Drive South,Denver,Colorado 80246,hereinafter referred to as"the State"; and,BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY (a political subdivision of the State of Colorado,whose address or principal place of business is 915 10th Street,3rd Floor,Greeley,Colorado 80631, for the use and benefit of the Weld County Department of Public Health and Environment,whose address or principal place of business is 1555 North 17th Avenue,Greeley,Colorado 80631 hereinafter referred to as "the Contractor". FACTUAL RECITALS The United State Department of Health and Human Service, Centers for Disease Control and Preventions("CDC") has awarded the State federal funds under Notice of Cooperative Agreement Award ("NCAA")number U90/CCU816827-06 to fund"Public Health Preparedness and Response for Bioterrorism"activities,see,Catalog of Federal Domestic Assistance("CFDA")number 93.283. The funds from this NCAA are intended to assist the State to upgrade the ability of state and local public health agencies to prepare for,and respond to: terrorism, outbreaks of infectious disease, and other public health threats and emergencies; The State has formulated a comprehensive State plan, with associated budgets,to disburse these federal funds throughout the State of Colorado. Under this comprehensive State plan,the State shall allocate these federal funds to qualified entities to assist those entities to upgrade and integrate State and local public health jurisdictions' preparedness for and response to terrorism and other public health emergencies with Federal, State, local, and tribal governments, the private sector, and Non-Governmental Organizations(NGOs).These emergency preparedness and response efforts are intended to support the National Response Plan(NRP)and the National Incident Management System(NIMS); As of the made date of this Contract,the State has a currently valid Group II purchasing delegation agreement with the division of finance and procurement within the Colorado Department of Personnel and Administration; Section 29-1-201,C.R.S.,as amended,encourages governments to make the most efficient and effective use of their powers and responsibilities by cooperating and contracting with each other to the fullest extent possible to provide any function,service,or facility lawfully authorized to each of the cooperating or contracting entities,and to this end all state of Colorado contracts with its political subdivisions are exempt from the state of Colorado's personnel rules and procurement code; The Contractor is a political subdivision of the state of Colorado. The State and the Contractor mutually agree that the most efficient and effective way to provide the above-described services is at the local level. The State and the Contractor previously entered into a Master Contract with contract routing number 05 FAA 00054. This Task Order is issued pursuant to the terms and conditions of that Master Contract. As to the State,authority exists in the Law and Funds have been budgeted,appropriated,and otherwise made available, and a sufficient uncommitted balance thereof remains available for subsequent encumbering and payment in Fund Code 100,Organizational Unit Code 3650 Appropriation Code 369,Program Code 9012, Function Code Page I of 6 FLWT,Object Code 5120,and Grant Budget Line Code HW61 under Contract encumbrance number PO FHA EPI0600101. All required approvals,clearances,and coordination have been accomplished from and with all appropriate agencies. NOW,THEREFORE, in consideration of their mutual promises to each other, stated below,the parties hereto agree as follows: A. PERIOD OF PERFORMANCE AND TERMINATION. The proposed effective date of this Contract is September 1,2005. However,in accordance with section 24-30-202(1),C.R.S.,as amended,this Contract is not valid until it has been approved by the State Controller,or an authorized designee thereof. If the underlying NCAA authorizes the State to pay all allowable and allocable expenses of a contractor as of the effective date of that NCAA,then the State shall reimburse the Contractor for any allowable and allocable expenses of the Contractor that have been incurred since the proposed effective date of this Contract. If the underlying NCAA does not authorize the State to pay all allowable and allocable expenses of a contractor as of the effective date of that NCAA,then the State shall only reimburse the Contractor for those allowable and allocable expenses of the Contractor that were incurred on or after the effective date of this Contract. The initial term of this Contract shall commence on its effective date and continue through and including August 31,2006. If the State receives additional federal funding for the purposes of this Contract,then this Contract shall automatically renew for the period covered by those additional federal funds. This Contract is funded entirely with federal funds. Therefore,the State's liability for payment for all services rendered,or goods supplied,under this Contract is contingent upon the State's receipt of those federal funds. If the State does not receive all,or any part,of the federal funds necessary to pay its obligations under this Contract,then the State may immediately amend or terminate this Contract without further liability to the State. The total term of this Contract, including all automatic renewals,bilateral options to renew, and extensions,may not exceed five(5)years. B. DUTIES AND OBLIGATIONS OF THE CONTRACTOR. The Contractor, in accordance with the terms and conditions of the Master Contract and this Task Order, shall perform and complete,in a timely and satisfactory manner,all work items described in the Statement of Work and Budget,which are incorporated herein by this reference,made a part hereof and attached hereto as"Attachment A". C. DUTIES AND OBLIGATIONS OF THE STATE. I. The Contractor shall be compensated in accordance with the rates set forth in"Attachment A"hereto. In consideration of those services satisfactorily and timely performed by the Contractor under this Task Order the State shall cause to be paid to the Contractor a sum not to exceed TWO HUNDRED SEVENTY-FIVE THOUSAND,SEVEN HUNDRED SIXTY-FIVE DOLLARS,($275,765.001 for the initial term of this Task Order. Of the total financial obligation of the State referenced above, $275,765.00 are identified as attributable to a funding source of the United States government and, $0.00 are identified as attributable to a funding source of the state of Colorado. 2. Payments under this Task Order shall be made either through the State's Electronic Fund Transfer system or,upon the Contractor's periodic submission of a duplicate"Task Order Reimbursement Statement". 3. If this Task Order requires the Contractor submit a"Task Order Reimbursement Statement",then the Contractor shall submit a signed, monthly Task Order Reimbursement Statement within sixty(60) calendar days of the end of the billing period for which services were rendered. The required Task Order Reimbursement Statement Template and Grant Year 2005-2006 Invoice Requirements are incorporated herein by reference,made a part hereof,and attached hereto as"Attachment B". Expenditures shall be in accordance with those items identified in Attachment A. These items may include,but are not limited to:the Contractor's salaries,fringe benefits, supplies,travel,operating,and indirect costs which are allowable and allocable expenses related to its performance under this Task Order. Page 2 of 6 Each Task Order Reimbursement Statement shall reference the related Matter Contract by its contract routing number and this Task Order by their respective contract routing numbers. The contract routing numbers are located on page one of these documents. Each Task Order Reimbursement Statement shall also indicate the applicable performance dates,the names of payees; a brief description of the services performed during the relevant performance dates; all expenditures incurred; and,the total reimbursement requested. Reimbursement during the initial, or any renewal,term of this Task Order shall be conditioned upon affirmation by the State that all services were rendered by the Contractor in accordance with the terms of this Task Order. The State may prospectively increase or decrease the amount payable under this Task Order through a "Task Order Change Order Letter"that is substantially similar to the sample Task Order Change Order Letter that is incorporated herein by this reference,made a part hereof,and attached hereto as "Attachment C". To be effective,a Task Order Change Order Letter must be: signed by the State and the Contractor; and, approved by the State Controller or an authorized designee thereof. Additionally, a Task Order Change Order Letter shall include the following information: A. Identification of the related Master Contract and this Task Order by their respective contract routing numbers and affected paragraph number(s); B. The type(s)of service(s)or program(s)increased or decreased and the new level of each service or program; C. The amount of the increase or decrease in the level of funding for each service or program and the new total financial obligation; D. A provision stating that the Task Order Change Order Letter is effective upon approval by the State Controller, or designee,or its proposed effective date,whichever is later. Upon proper execution and approval, a Task Order Change Order Letter shall become an amendment to this Task Order. Except for the General and Special Provisions of the Master Contract,and the Additional Provisions of the Task Order, if any,the Task Order Change Order Letter shall supersede this Task Order in the event of a conflict between the two. It is expressly understood and agreed to by the parties that the task order change order letter process may be used only for increased or decreased levels of funding,corresponding adjustments to service or program levels,and any related budget line items. Any other changes to this Task Order,other than those authorized by the task order option to renew letter process described below,shall be made by a formal amendment to this Task Order executed in accordance with the Fiscal Rules of the state of Colorado. If the Contractor agrees to and accepts a proposed Task Order Change Order Letter,then the Contractor shall execute and return that Task Order Change Order Letter to the State by the date indicated in that Task Order Change Order Letter. If the Contractor does not agree to and accept a proposed Task Order Change Order Letter, or fails to timely return a partially executed Task Order Change Order Letter by the date indicated in that Task Order Change Order Letter,then the State may,upon written notice to the Contractor,terminate this Task Order no sooner than thirty(30) calendar days after the return date indicated in the Task Order Change Order Letter has passed. This written notice shall specify the effective date of termination of that Task Order. If a Task Page 3 of 6 Order is terminated under this clause,then the parties shall not be relieved of their respective duties and obligations under that Task Order until the effective date of termination has passed. Increases or decreases in the level of contractual funding made through the task order change order letter process during the initial, or renewal,term of a Task Order may only be made under the following circumstances: E. If necessary to fully utilize appropriations of the state of Colorado and/or non- appropriated federal grant awards; F. Adjustments to reflect current year expenditures; G. Supplemental appropriations,or non-appropriated federal funding changes resulting in an increase or decrease in the amounts originally budgeted and available for the purposes of a Task Order; H. Closure of programs and/or termination of related contracts or task orders; I. Delay or difficulty in implementing new programs or services;and, 7. Other special circumstances as deemed appropriate by the State. 5. The State may renew a Task Order through a"Task Order Option to Renew Letter"substantially similar to the sample Task Order Option to Renew Letter that is incorporated herein by this reference, made a part hereof, and attached hereto as"Attachment D". To be effective,a Task Order Option to Renew Letter must be: signed by the State and the Contractor; and, approved by the State Controller or an authorized designee thereof. Additionally,a Task Order Option to Renew Letter shall include the following information: A. Identification of the related Master Contract and that Task Order by their respective contract routing numbers and affected paragraph number(s); B. The type(s)of service(s)or program(s), if any,increased or decreased and the new level of each service or program for the renewal term; C. The amount of the increase or decrease,if any,in the level of funding for each service or program and the new total financial obligation; D. A provision stating that the Task Order Option to Renew Letter is effective upon approval by the State Controller,or designee,or its proposed effective date,whichever is later. Upon proper execution and approval, a Task Order Option to Renew Letter shall become an amendment to this Task Order. If the Contractor does not agree to and accept the proposed renewal term, or fails to timely return a partially executed Task Order Option to Renew Letter by the date indicated in that Task Order Option to Renew Letter,then the State may, upon written notice to the Contractor,terminate this Task Order no sooner than thirty(30) calendar days after the return date indicated in the Task Order Option to Renew Letter has passed. This written notice shall specify the effective date of termination of that Task Order. If a Task Order is terminated under this clause,then the parties shall not be relieved of their respective duties and obligations under that Task Order until the effective date of termination has passed. 6. All attachments or exhibits to this Task Order are incorporated herein by this reference and made a pan hereof as if fully set forth herein. If a conflict or inconsistency is found to exist between the terms and conditions of this Task Order and those of any attachment or exhibit hereto,then the terms and conditions of this Task Order shall control. These emergency preparedness and response efforts are intended to support the National Response Plan (NRP) and the National Incident Management System(NIMS). In addition, the activities described in the cooperative agreement guidance are designed to develop emergency-ready public health departments in accord with the Interim National Preparedness Goal (NPG), the Interim Public Health and Healthcare Supplement to the NPG, and the Centers for Disease Control and Prevention(CDC)Preparedness Goals. Associated with the Interim NPG are two broad-gauged resources to help guide preparedness planning and implementation: a set of scenarios and the Target Capabilities List. The Department of Homeland Security(DHS) developed the Interim NPG and the associated resources in concert with the Department of Health and Human Services and other agencies of the Federal Government as well as with representatives of State and local public health departments and other stakeholders. CDC has developed Preparedness Goals designed to measure urgent public health system response performance parameters that are directly linked to health protection of the public. The Preparedness Goals are intended to measure urgent public health system response performance for terrorism and non-terrorism events including infectious disease, environmental and occupational related emergencies. For the purposes of this contract urgent response is intended to indicate non-routine public health system reaction to limit possible mortality,morbidity, loss of quality of life, or economic damage. The primary intent of this contract is to fund the active participation of the Contractor in the immediate establishment,use, and continuous improvement of a national system using the CDC Preparedness Goals to measure public health system response performance. Each Preparedness Goal has designated Outcome(s)as well as associated Critical Tasks. Agency activities follow each associated Critical Task. Emergency Preparedness and Response staff at the Colorado Department of Public Health and Environment(CDPHE) shall be responsible for taking the lead on any activities referenced in italics. Contractor shall comply with Colorado Revised Statute 25-1.5-102. CDPHE shall be responsible for setting any precedence for actual response to a disease outbreak or emergency over the activity requirements of this contract. The Contractor shall be responsible for the accomplishment of all Local Health Agency Activities through state, regional and local partnerships. NE Weld SOW.doc Page I of 48 Attachment A Weld County Department of Public Health Public Health Preparedness and Emergency Response 2005-2006 Scope of Work Contractor shall retain or recruit and supervise a full-time Regional Planner and Epidemiologist to serve the North East Region, including Cheyenne,Kit Carson,Larimer,Lincoln, Logan, Morgan, Phillips, Sedgwick, Washington, Weld, and Yuma counties. Contractor is responsible for ensuring staff availability to fulfill the Planner and Epidemiologist Roles and Responsibilities, see attachments B and C. If more than one staff member is recruited to fill the positions,the contractor must assign a lead person that will be responsible for fulfilling the contracted responsibilities and ensuring representation at all required meetings,training sessions,and conference calls. Contractor shall designate at least one staff member as the point of contact for public information,communications,or media relations. Contractor shall be responsible.for required agency and/or regional progress reports. Contractor shall be responsible for appropriate use of grant funds for all staff working on related projects as well as required equipment,supplies,travel, and operating expenses.Contractor shall at no time utilize grant funds to supplant other programs or unrelated projects. Contractor shall utilize the Colorado Preparedness Reporting System (PRS)to document and monitor progress and accomplishments on a quarterly basis. The due dates of the progress reports are December 15, 2005, March 15,2006,June 15,2006 and September I,2006. Billing Schedule: Contractor shall submit monthly invoices to CDPHE using the required Invoice Template, Attachment B to the Task Order,and shall be paid on a cost reimbursement basis only. Contractor shall follow the Guidelines for Invoicing contained in Attachment B to the Task Order for all types of reimbursement requests. Expenditures shall be in accordance with those items identified in the Scope of Work. These items may include, but are not limited to: the Contractor's salaries, fringe benefits, supplies,travel, operating,and indirect costs which are allowable and allocable expenses related to its performance under this Purchase Agreement. The Indirect Rate charged to this contract shall not exceed 16.29% of the Total Direct Costs utilized to fulfill the contracted responsibilities of this purchase agreement. The total cost to CDPHE shall not exceed the total budget amount of this agreement. Contractor understands and agrees that none of the funding made available pursuant to this procurement agreement can be used on any work or project other than that specified in this Scope of Work. Contractor further understands that Contractor is not to include any work not related to the Scope of Work, attached to this procurement agreement, on any invoices to the State. If Contractor mistakenly includes any unrelated work on an invoice, submitted pursuant to this procurement agreement,then Contractor hereby agrees to return this amount of money to the state immediately upon it becoming or being made aware. The salary range has been established based on 2004-2005 salaries,the average across all agencies with a set standard deviation. Contractor shall request prior approval from CDPHE to not abide by the minimum or exceed the maximum salary for any position. Agency shall review the job duties(both routine and emergency response),assess the need for specific workplace safety requirements,and ensure that staff that have the potential for exposures in either their routine or emergency response roles are instructed in proper safety procedures.Complete by March 1,2006 2. In compliance with Colorado Board of Health Rules CCR 1009-5 Regulation I,agency shall maintain sufficient supplies and a process for the provision of personal protective equipment against bacterial and viral infections to all staff and employees who are assigned to work in areas where they may be exposed to ill and contagious persons or to infectious agents and waste; personal protective equipment shall,at a minimum,be the equipment and supplies used to achieve standard precautions. Incorporate this information into local emergency operations plan.Complete by July 1,2006. 3. In compliance with Colorado Board of Health Rules CCR 1009-5 Regulation I,agency shall have a plan to maintain,procure and/or store at least five days supply of doxycycline or other antibiotic,as determined by the state health department,to be used as chemoprophylaxis for all employees.The plan should include procurement of another antibiotic for a small number of employees who may be unable to take doxycycline.Development of MOUs with other entities to house,provide and/or maintain caches is acceptable as well. Incorporate this information into local emergency operations plan.Complete by July I, 2006. CDPHE strongly encourages agencies to actually procure and store these prophylactic counter measures even though the regulations state that the agency need only have a plan in place. Submit the subtyping data and associated critical information(isolate identification,source of isolate,phenotype characteristics of the isolate,serotype,etc)electronically to the national PulseNet database within 72 to 96 hours of receiving the isolate in the laboratory. *CDPHE IS THE LEAD AGENCY 2A Critical Task 3d:Have or have access to a system for 24/7/365 notification/alerting of the public health emergency response system that can reach at least 90%of key stakeholders and is compliant with PHIN Preparedness Functional Area Partner Communications and Alerting. Local Agency Activities: Per strategic planning objectives,Agency shall: I. Maintain accurate profile/contact information on COHAN for at least 5 individuals in an organized health department or at least I person for a nursing service agency. All Regional FTE are required to maintain their accurate profile/contact information on COHAN. 2. Maintain 24x7 emergency contact information in COHAN,update as necessary and at least quarterly. 3. Maintain key stakeholder information in COHAN and/or Dialogics at a minimum for the required I6 public health roles,as stated in the PHIN Partner Communication and Alerting guidance. 4. All agencies,including nursing services,must have in 3 yrs(by 2008)or have access to 24x7x365 notification/alerting of the public health emergency response system that can reach at least 90%of key stakeholders and is compliant with PHIN Partner Communication and Alerting requirements. Notification/alerting systems must have the ability to generate a real-time delivery status report containing the number of recipients targeted to receive a communication or alert and the number who have confirmed receipt.For 2005-2006 grant year,agency must have or have access to 24x7x365 notification/alerting system. The agency must review PHIN PCA requirements and complete a self-assessment of this system. Specifically,the notification/alerting system must have the ability to generate a real-time delivery status report containing the number of recipients targeted to receive a communication or alert and the number who have confirmed receipt. 5. Agency will have firewall and virus protection software to protect their computers. 6. Agency will maintain high-speed connection to the Internet. 7. For Elbert County,El Paso HD,Montrose County,Mineral County,San Juan Basin HD,Otero and Crowley HD, Pueblo HD only. Agency will ensure appropriate use of the state blastfax system. By signing this contract,you agree to use the blastfax system for emergency preparedness related activities,you agree and understand that CDPHE reserves the right to apply usage charges for this service in the upcoming grant years,starting no earlier than September 1,2006. You will be notified of any such changes and will have the opportunity to decide on your continued use of the blastfax system. You agree not to use or disclose any data for any purpose or end inconsistent with the purpose of the system for which access is granted. You understand and agree that for audit purposes,CDPHE may monitor all of your activities while using the system. You agree to protect and confidential information and data. You agree to protect the user account and password information which was issued to you from any unauthorized access and use. 8. Agency will ensure that public health workforce will have continuous access to computer equipment and high-speed Internet link. 9. Agency will ensure participation in the quarterly testing of the 24x7 emergency contact role conducted by CDPHE.The tests will occur in October,January,April and July. Agency will ensure that all necessary individuals in their agency are informed of these tests and know how to respond to the notification system. 10. Agency will ensure participation in the quarterly HAN coordinators conference calls conducted by a state HAN Coordinator. The conference calls are scheduled on a 3rd Wednesday in October,January,April,July. 11. Agency will ensure participation in the quarterly fax tests conducted by CDPHE. The tests will occur in October,January, April and July. 12. Agency will conduct quarterly tests and assess response rates for fax and at least I other device/notification method. 13. Agency will ensure the improvement of use,through testing and exercises,of multiple methods of contact(phone,fax,radio, email)according to the need of receiver and emergency conditions(e.g.no cell phone). The agency will conduct at least 2 tests(in addition to regular quarterly tests)where all but I device,i.e.radio,have failed. The agency will assess the response results. 14. The thematic group included members from several different local public health agencies and CDPHE. Based on the experiences of the regional epidemiologists over the past several years and the current needs for epidemiological capacity, three priorities were established for the next year.These priorities reflect a shift from the didactic and classroom-based trainings of the past several years to experience-based skill building and integration into routine agency operations,in order for epidemiologists to provide greater assistance in local and regional disease surveillance and control. • Comprehensive integration: Emergency preparedness epidemiologists need to be fully integrated into daily public health activities. • Improving detection capabilities:Maintain a competent epidemiological workforce to ensure the rapid detection of public health threats. • Improving response competencies: Enhance the epidemiological readiness to respond to public health threats,including epidemics.
