WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners held a public hearing on the 27th day of June, 1984, at the hour of 2 : 00 o 'clock p.m. in the Chambers of the Board for the purpose of hearing the application of Lousberg Grain and Feed, Inc. , P.O. Box 689 , Sterling, Colorado 80751, for a Use by Special Review for commercial grain storage on the following described real estate, to-wit: Part of the Ez, Section 5, Township 7 North, Range 56 West of the 6th P.M. , Weld County, Colorado WHEREAS , Section 24. 4. 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the re- quest of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that this request shall be approved for the following reasons : 1. The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . -It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24. 4. 2 of the Weld County Zoning Ordinance as follows : a. The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on continued agricultural use in the vicinity or County. -The proposal does not appear to have any adverse impacts on the agricultural interests of the County or the environment. NOW, THEREFORE, BE IT RESOLVED by the Board -of County Com- missioners of Weld County, Colorado, that the application for a Use by Special -Review for commercial grain storage on the her-einabove described parcel of land, be, and hereby is , granted subject to the _following conditions : 1. The attached Standards for Use by Special Review be adopted and placed on the Use -by Special Review plat prior -to recording. 2. A •sevised mylar plat shall be submitted to the Depart- ment of Planning Services showing all existing and proposed structures in the Use by Special Review area. The uses permitted shall be a Commercial Grain Storage facility as described in the application materials nn file -with the Department of Planning Services. 2. All rubbish and debris shall be removed from the Use by Special Review area to prevent rodent harborage. 3. The applicant shall comply with the design standards for the Use -by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. 4. The applicant shall comply with the Operation Standards for Uses by Special -Review, Section 24.6 et seq. , of the Weld County Zoning Ordinance. 5. Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted -access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Operation Standards stated hereon and all applicable Weld County Regulations. 6. The Use by Special Review area shall be limited to the plans shown hereon and governed by the Standards -as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commissi-on and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other -changes shall be filed in the office of the Department of Planning Services. 7. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Lee Morrison, Assistant County Attorney, read this application into the record. Michael Mullen, Planning Department representative, read the favorable recommendation of the Planning Commission into the record, stating that seven Operation Standards have-been proposed. Dean Lousberg, representing Inusberg Grain & Feed, Inc. , came forward to answer questions of the Board. Mr. Lousberg stated that they are familiar with the proposed Operation Standards and have no problem with them. There was no opposition voiced in regards to this Use by Special Review. No further comments were made. Commissioner C. Carlson moved to approve this Use by Special Review for Lousberg Grain 'Sifted, Inc. , including the Standards as recommended by the Planning Commission. Secretary 1 DETERMINATIONS TO BE MADE BY THE BOARD OF COUNTY COMMISSIONERS ON USE BY SPECIAL REVIEW REQUESTS 24.4.2 The Board of County Commissioners shall hold a public hearing to consider the application and to take final action thereon. In making a decision on the proposed Use by Special Review, the Board shall consider the recommendation of the Planning Commission, and from the f-acts presented at the public hearing and the information contained in the official record, which includes the Department of Planning Services case file, the Board of County Commissioners shall approve the request for the Special Review Permit unless it finds that the applicant has not met one or more of the standards or conditions of Sections 24.2.2, 24.5 (design standards) and 24.6(operation standards) . The applicant has the burden of proof to show that the standards and conditions of 24.4.2, 24.5 (design standards) and 24.6 (operation standards) are met. The applicant shall demonstrate: 24.4.2. 1 That the proposal is consistent with the Weld County Comprehensive Plan. 24.4.2.2 That the proposal is consistent with the intent of the district in which the USE is located. 24.4.2.3 That the USES which would be permitted will be compatible with the existing surrounding land USES. 24.4.2.4 That the USES which would be permitted will be compatible with the future DEVELOPMENT of the surrounding area as permitted by the existing zone and with future DEVELOPMENT as projected by the COMPREHENSIVE PLAN of the COUNTY or the adopted MASTER PLANS of affected municipalities. 24.4.2.5 That the application complies with the Weld County Zoning Ordinance, Section 50, Overlay District Regulations if the proposal is located within any Overlay District Area identified by maps officially adopted by Weld County. 24.4.2.6 That if the USE is proposed to be located in the A-District, that the applicant has demonstrated a diligent effort has been made to conserve productive agricultural land in the locational decision for the proposed USE. 24.4.2.7 That there is adequate provision for the protection of the health, safety and welfare of the inhabitants of the NEIGHBORHOOD and the COUNTY. The operation is very simple in that the farmers will truck their grain from the field and limp at the elevator to be stored in one of two new strD7turcm or in the existing struc'lurs lepending on the tyoe of grain or the availab]e space. -Need for Jse Presently during harvest grain is dumped in the open on the ground and is at the mercy of the weather. This causes spoilage, loss of grain and lower grades. This facility would help very much to alleviate this problem. Types of Existing Uses of Surrounding Properties The surrounding properties are all either grass land or wheat land and this facility is directly related -to receiving the products that are produced on the surrounding properties. Distance to Residential Structures Seespecial review plan map -Maximum Number of Users This would encompass all are-a farmers which we estimate at about 120. -3- April 1 0,1984 -Number of Employees, Shifts and Hours of Operation The full time employee and up to three additional at harvest time. One snift and hours of 8 to 5 normal and all daylight hours during harvest. -Type of Water Source None -Access Route -._cess to the structures will be the same as the existing facility and that is from Marble Street in Stoneham. -Associated Vehicular Traffic This will not change from the existing facility. The traffic consists of farm trucks and semi trucks, size is anywhere from 50 to 1000 bushel trucks. Weight is anywhere from 10,000 to 80,000 gross load weight. -Sewage Facility None to be built-use existing. -Proposed Fire Protection Grain systems are under constant surveillance by 0.S.H.A. We will meet all 0.S.H.A. regulations just as is done with the existing facility. Stoneham is under protection by the Stoneham fire protection district. -Animal Concentration None -Waste, Stockpile or Storage Areas None with the possible exception of continuing grain stockpiles if the crop is too large. a- Apri. 9, 1984 -Storm Water Retention This facility will essentially stand in a oast hre with a slope of approximately 1 f00t • slope per 50 of run. The run off eventually ends up in a small lake and creek about 1 mile away in the middle of tare pasture land. -Removal of Debris and Other Wastes A grain storage facility such as this toes not contain waste or produce waste. -Landscaping and Erosion Control We will maintain the same measures as exists witn the existing facility. The small amount of disturbed soil will be controlled by either concrete surface or gravel layers. -Reclamation Procedures Upon Cessation All disturbed soil will be replaced in original location. -Time Table We need to start immediately because we have a c0 day estimated construction schedule and we need to be ready to receive farmers grain by July 1 , 1984. -Consistency with the Weld County Comprehensive Plan re. We are building this facility to improve agricultural {productivity and methods r of marketing agricultural products in this area. Also it will aid in the ability to unload trucks thus creating a faster, cleaner harvest for the farmers. -Consistency of District Same -5- April 19, 1984 -Conservation of Productive Land This facility should not effect any productive land because it is sitting o❑ soil that has been used by Burlington Northern Railroad for rail line use and we are reclaiming it for use as a grain storage area. -Protection of Health, Safety and Welfare We are building this facility according to the standards set by the Occupational Safety and Health Administration and should protect all inhabitants of the neighborhood and county . -Compatibility With Surrounding Land We are building this facility in direct relationship to the product that is produced on the land. Adjacent land uses includes the existing facility on one side and open pasture on the other. -Future Development Compatibility The Stoneham area is basically a very open and sparsely populated area and future development would probably only be more intense agricultural production causing only more need for this type of facility. -Location Near Flood Plain, Geologic Hazard and Weld County Airport Overlay This special review area is approximately 25 miles from the nearest potential water flood plain. The soils engineers from Empire Laboratories found no geological hazards. The area is also far away from the airport overlay district. -Water Supply Requirements None 5- Apr L9, 1984 -Noise Report Additional noise will not be created because the same trucks that pile the grain on the ground will be used to fill the new system which creates very small noise factors in a very sparsely populated area. -Soils Reports 3y Empire Laboratories in Fort Collins.
