RESOLUTION RE: ACTION OF BOARD AT SHOW CAUSE HEARING CONCERNING USE BY SPECIAL REVIEW PERMIT #1100 FOR A COMMERCIAL BUSINESS (AUTO AND FARM MACHINERY REPAIR)IN THE A(AGRICULTURAL)ZONE DISTRICT-JOE AND RITA GAONA WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,on April25,2005,a Show Cause Hearing was conducted to consider revocation of Use by Special Review Permit#1100 for a Commercial Business (auto and farm machinery repair) in the A (Agricultural) Zone District, issued to Joe and Rita Gaona, 23268 Weld County Road 74, Eaton, Colorado 80615, and WHEREAS, Joe and Rita Gaona are the current owners of the facility located on property being further described as follows: Lot A of Recorded Exemption#1769;being part of the NW1/4 of Section 1, Township 6 North, Range 65 West of the 6th P.M., Weld County, Colorado WHEREAS,at said hearing of April 25, 2005, the Planning staff advised the Board that all derelict vehicles had been removed,the screening was in place,and the only outstanding item was a mobile home which was on the property without a permit, and WHEREAS,after hearing all testimony presented,the Board deemed it advisable to continue said Show Cause Hearing to October 26, 2005,at 10:00 a.m.,to allow Mr. Gaona time to have the mobile home removed or dismantled, and WHEREAS, on October 26, 2005, the Planning staff advised the Board that the mobile home has been dismantled, the site is in compliance, and this matter can be dismissed, and WHEREAS,after hearing all testimony presented,the Board deemed it advisable to dismiss said Show Cause Hearing. Weld County, Colorado. Use by Special Review 1100 was approved by the Board of County Commissioners on January 17, 1996. USR-1100 was for auto and farm machinery repair in the Agricultural Zone District. The application and plat map indicate that all storage would be located in screened areas designated "Work in Progress", "Proposed Finished Work" and "Proposed Storage Area". At this time various vehicles are being stored outside of this area, most of which are derelict. Time line for Probable Cause PUSR-1100: January 27, 2005 The Department of Planning Services received a complaint from a citizen regarding a junkyard. February 10, 2005 Field inspection of the property indicated derelict vehicles including a bus located outside of the designated storage area and a mobile home without any zoning or building permits. February 15, 2005 10 day letter sent February 17, 2005 Mr. Gaona called to discuss the violation. He seemed very willing to come into compliance. Said he would remove the MH over the weekend and move the bus and vehicles into the storage area. He would call the owner of the white car located by the access to pick it up. Said he would be in compliance by the following Monday. February 24, 2005 Field inspection of the property indicated that none of the derelict vehicles or the mobile home had been removed.
