RESPONSES TO REFERRAL COMMENTS
OFFICE OF THE STATE ENGINEER
• The North Weld County Water District needs to provide a water supply report or a
summary of water rights owned or controlled by the district, the yields of these rights
both in an average year and dry year, the present demand on the system and the
anticipated demand due to commitments for service entered into by the district and
the amount of uncommitted firm supply the district has available for the future.
Per the letter addressed to you from the Office of the State Engineer dated May 20,
2004, "...the proposed water supply will not cause material injury to existing water
rights and the supply is expected to be adequate. "
COLORADO GEOLOGICAL SURVEY
• Site-specific, design-level geotechnical investigations including drilling, sampling,
lab testing and analysis will be needed, once preliminary building layouts are known,
to determine alluvium thickness or depth to competent bedrock, and characterize soil
and rock engineering properties such as density, swell and consolidation potential,
bearing capacity and groundwater levels.
All lots will have site-specific geotechnical investigations.
• Recommends that individual perimeter foundation drain systems be constructed to
help prevent infiltration of perched water(if basements are determined to be feasible),
and to help control wetting of potentially collapsible or expansive soils in the
immediate vicinity of foundation elements. It is critical that the perimeter drains, if
constructed, are sloped to discharge to an interior pumped sump or a gravity outlet
that discharges water as far as possible away from structures.
All lots will have perimeter foundation drain systems if necessary.
• There may be an issue regarding further oil and gas development immediately east of
the eastern property boundary. This issue should be settled prior to final plat
approval.

An agreement has been reached with the oil company and is attached with this
submittal.
• Prospective residents should be advised and a plat note should be included informing
buyers that the oil/gas wells, separators and related equipment may be loud, may pose
a visual nuisance and will require ongoing servicing, maintenance and access via
local roads.
The note has been added to the drawing.
• All wells, pumps, processing facilities and tank batteries within the residential
development should be fenced and locked, with warning signs posted to protect
residents from hazards associated with the machinery and possibly tainted soils.
Fences already exist around the wells, pumps, processing facilities and tank batteries
within the residential development.
• Per county health department regulations, individual percolation tests will be needed
on all proposed lots.
Percolation tests will be performed on all lots prior to installing individual septic
disposal systems.
PUBLIC WORKS DEPARTMENT
External Roadways
• Coordinate with CDOT the requirements for right-of-way and any improvements on
SH 37. A letter of corroboration must be provided to Public Works. The applicant,
on the change of zone plat, shall show and label the right-of-way measured from the
section line.
A CDOT State Highway Access Code "Notice to Proceed" Permit is included with
this submittal.
• CR 55 is a local road requiring a 60-foot ROW. The applicant shall verify the
existing ROW and the documents creating that ROW shall be noted on the change of
zone plat.

• CR 60 1/2 is a local road requiring a 60-foot ROW. The applicant shall verify the

• The applicant shall enter into an agreement with the county to proportionately share
the cost of improvements. The applicant shall submit a proposed agreement with the
final plan application.
This agreement will be included with the final plat application.
Internal Roadways
• The internal roadway ROW shall be 60 feet in width including cul-de-sac with a 65-
food radius, and dedicated to the public. The cul-de-sac edge of roadway radius shall
be 50 feet.
The Change of Zone Land Use Map is dimensioned to show that the above requested
measurements have been met.
• The applicant may consider showing the typical cross-section of interior road to be
two 12-foot gravel lanes with 4-foot gravel shoulders on the change of zone plat.
The road will be entirely gravel; therefore, the county requirement of two, 13 foot
lanes with a 1-foot clear zone is shown on the Road Plan and Profile.
• Stop signs and street name sign locations must be shown on the final roadway
construction plans.
The stop sign with street names is shown both on the Road Plans and the Change of
Zone Land Use Map.
• Intersection sight distance triangles at the development entrance will be required.
Sight distance triangles have been placed at the entrance on the Change of Zone
Land Use Map.
• The applicant shall submit to Public Works stamped, signed and dated final plat
drawings and roadway/construction and grading plan drawings for review (with the
final plan application) and approval. Construction details must be included.
The county will receive signed and dated drawings at the time of the final plat
submittal.
• The applicant shall submit Improvements Agreements According to Policy Regarding
Collateral For Improvements with the final plan application.

An agreement will be submitted with the final plat application.
Drainage
• The 5-year storm and 100-year storm drainage studies shall take into consideration
off-site flows both entering and leaving the development.
The requested run-off information is included within the drainage report.
• The Final Drainage Report shall include a flood hazard review documenting any
FEMA defined floodways. The engineer shall reference the specific map panel
number, including date. The development site shall be located on the copy of the
FEMA map.
A copy of the FEMA map showing the FEMA-defined floodways, the panel number,
the date, and the development site has been included in this submittal. We will include
this copy in the final drainage report at the time of Final Plat submittal.
• Applicant shall prepare a construction detail for typical lot grading with respect to
drainage for the final application.
A typical lot grading detail has been included on the Change of Zone Land Use Map.
• Final drainage construction and erosion control plans must be submitted with final
plan application.
The final drainage plan will be included with the final plat application. The erosion
control plan is included on the Road Plan and Profile.
SHERIFF'S OFFICE-DAVID TUTTLE
• Designate an area by the entrance of the subdivision in which to place a shelter for
schoolchildren awaiting the school bus. This area should also include a pull off for
the school bus.
A school bus pull off has been placed on the west side of the entrance into the
proposed development. As a shelter is not required, one will not be provided at this
time.
• Either a mail distribution within the subdivision or a central drop off location within
the subdivision should be developed so that residents do not have to cross a county
roadway to obtain their mail.
A mail drop-off/collection stop has been placed on the east side of the entrance just
inside the proposed development.

• The name of the street and address numbers within the subdivision should be
presented to the sheriffs office for approval.
We are waiting to receive this info from Lin Dodge with the Weld County Planning
Department and will submit iffor approval as soon as we receive it.
• A permanent sign should be placed at the entrances to the subdivision detailing the
name of the subdivision and address.
An example sign has been included on the Change of Zone Land Use Map.
• A plan should be developed to maintain roadways within the subdivision especially
during inclement weather conditions for emergency vehicles.
The HOA covenants will address the issue of roadway maintenance.
• There is an oil and gas well within this subdivision. This needs to be fenced off in
order to mitigate the potential for tampering.
Fences already exist around the oil and gas wells on the property.
RE-7 SCHOOL DISTRICT
• $750/Lot before Final Plat.
The owner has been notified and agrees to meet the request of the School District
prior to the final plat stage.
PLATTE VALLEY FERE PROTECTION DISTRICT
• Per a telephone conversation with Barry Schaefer, Fire Chief, on July 15, 2004, the
Platte Valley Fire Protection District requested that a fire hydrant be placed on
Pheasant Meadow Lane midway between WCR 60 '/2 and the cul-de-sac.
The fire hydrant is shown both on the Road Plans and the Change of Zone Land Use
Map.

Responses to WC Code Section 23-2-50.E, #s 3, 4, 5, 6, 8, 9, 10, & 11
3. Consistency with policies of Chapter 22
This subdivision is consistent with the goals for a residential development as
stated in Sec. 22-2-190 of the Weld County Code. Individual septic disposal
systems are planned, and the access to the development is adequate. Only four
lots are planned, so the rural roads' capacity easily meets the expected burden.
Water will be available through the North Weld County Water District, so no well
water will be needed.
The Pheasant Meadow Subdivision is east of Greeley, outside of any urban growth
boundary areas. The surrounding land is currently farmed property. The large lots
planned for this development make it compatible with the surrounding agricultural
activity. Housing will be compatible with the existing surroundings and the
conservation of existing natural features has been considered in the design. All
necessary infrastructure and urban services are currently available or reasonably
obtainable. No unsightly materials currently exist or are planned for this property.
4. How the proposed zoning will correct what the applicant perceives as faulty
zoning....
The current zoning is agricultural. The applicant wishes to convert the property
zoning to Estate (E) zoning so that lots can be used for residential purposes.
5. A statement stating how the proposed rezoning is compatible with the surrounding
uses.
The average lot size of this development is 14 acres. The size allows the owner to
farm or ranch if they so desire. A dairy exists to the east, but other than that,
agricultural activity is mostly what occurs in this rural location. This development
is expected to have only positive effects on its surroundings.
6. Statements from public utilities....
Water will be provided by the NWCWD. A signed agreement is attached with this
submittal. Electricity will be provided by Xcel Energy (Public Service Company),
and telephone service will be provided by Qwest. "Will-serve" letters from these
providers are included with this submittal. Individual septic disposal systems are
planned for this development. The geotechnical report on this site confirms that
"preliminary percolation rates of 17 to 30 minutes per values are acceptable for

standard leachfield construction as outlined by Weld County regulations." The
geotechnical report is also attached with this submittal.
8. Street or highway facilities must be adequate....
The existing access to the property is adequate for this development. Peter Schei,
PE, of the Weld County Public Works department stated in his comments to the
planning department that "based on the proposal of limited development and
apparent low traffic impact, a traffic study is not currently required."
9. Commercial mineral deposits
A letter dated June 11, 2004, from Northern Colorado Geotech explains that "there
are no economic quantities of minerals or aggregate at the subject site." Please refer
to the copy of this letter included with this submittal.
10. Overlay district
The proposed development does not lie within an overlay district.
11. Mixed-use development area
The proposed development does not lie within a MUD area.

RE: Pheasant Meadows PUD
Thank you for contacting us in regard to the Pheasant Meadows Subdivision.
The district already has a bus route that travels on road 60 %z from east to west. Therefore
the bus would currently pick up and drop off students at the entrance to the subdivision
and not enter the subdivision. We appreciate your foresightedness in planning the cul-de-
sac so that a bus can turnaround. This may be a need in the future if the route were to
change and need a turnaround point at this subdivision. We would appreciate widening
the entrance to Pheasant Meadow Lane in case the bus needed to pull off the road there
would be sufficient space. It might also be nice for the students if the developer were to
provide some type of shelter to protect the students from the weather while waiting for
the bus.
The Board of Education of Platte Valley School District, Weld RE-7 passed the land
dedication, cash-in-lieu policy on March 13, 2000. This policy addresses new
developments and recorded exemptions that would affect the district. Each new lot (new
residence) would be required to pay the $750 land dedication fee.

Estates Development. The project area provides poor potential habitat for federally listed
species. Based on the development site map the wetlands will not be impacted by
construction.
This evaluation should help with the county permitting process. If needed, we can
complete a formal Habitat Assessment Report to submit to the U.S. Fish and Wildlife
Service.

1.0 Introduction
The proposed Pheasant Meadows Development is located in Weld County bordered by
Weld County Road 601/2 on the south, and Highway 37 on the west. The site is planned
for development into 3 rural lots ranging in size from 11.8 to 19.9 acres. The site is
currently being used for pasture and agriculture. Wildland Consultants, Inc. completed a
field reconnaissance of the site on April 1, 2004 to evaluate site potential for threatened
and endangered species. The field reconnaissance was completed by Eric Berg of WCI.
Mr. Berg is a Certified Wildlife Biologist and a Certified Professional Wetland Scientist.
2.0 Vegetation and Wetlands
The vegetation on the site is dominated by seeded pasture and tilled agricultural land. A
concrete lined ditch runs through the middle of the site. Another ditch runs along the
southern site boundary.
A large wetland occurs in the southwest corner of the site. The wetland is separated from
a larger wetland complex to the south by Weld County Road 601/2. These wetlands
appear to be isolated from other wetlands. However, prior to any wetland fill the
jurisdictional status of the wetlands should be determined in consultation with the Army
Corps of Engineers. Dominant plant species in the wetland includes: American cattail,
reed canarygrass, and meadow fescue. Photographs of the Wetland are included in
Attachment A. A few large cottonwood trees are located along the drainage swale.
3.0 Threatened, Endangered, and Special Status Species
There are no known locations of rare plants on or near the development site (System for
!s'", Conservation Planning 2004).
The wetland on the site provides poor potential habitat to the federally listed Ute ladies'
tresses orchid (Spiranthes dilivualis). This rare orchid occurs along streams and
associated wetlands that flow into the South Platte River (U.S. Fish and Wildlife Service
1992). The wetland on the site is not associated with any stream or drainage. The area
around the drainage swale provide poor potential habitat to the federally listed New
Mexico butterfly plant (Gaura neomexicana). This annual plant occurs in sub-irrigated,
alluvial soils of drainage bottoms in Weld County (Spackman et. al 1997). The site is
not connected with a natural drainage. No surveys for either species have been
completed on the development site.
The drainage swale on the site provides no potential habitat to the federally listed
Preble's meadow jumping mouse. The Preble's mouse prefers riparian habitat
(streamside habitat) with extensive brush cover(USFWS 1999). The wetland on the site
does not provide the thick brushy riparian habitat preferred by the Preble's mouse. The
irrigation ditches provide no riparian habitat.
The irrigation canals on the site are maintained (burning, herbicides) on an annual basis.
Both canals provide poor quality potential habitat to federally listed species.
4.0 Conclusions, Recommendations
Impacts to federally listed species should not occur with project construction. Surveys of
the site for the Ute ladies' tresses orchid and Colorado butterfly plant should not be
required because potential habitat on the site is not present.
Because of the lack of shrubby riparian habitat the site provides poor potential habitat to
the Preble's meadow jumping mouse. Surveys for the Preble's meadow jumping mouse
are not recommended for the site.
Based on current project design development will result in no impacts to jurisdictional or
non-jurisdictional wetlands. No permits from the Army Corps of Engineers should be
required for project construction. If wetlands are impacted the Army Corps of Engineers
should be consulted to confirm the jurisdictional status of wetlands on the site.
