USE BY SPECIAL REVIEW (USR) QUESTIONNAIRE

This application has been prepared by established guidelines found in the Weld County Code,Section 23-2-
260,Use by Special Review Application Requirements,and the most current Weld County Procedural Guide
for a Use by Special Review Application as found on the Weld County Web Site.
1. Explain,in detail,the proposed use of the property.
The proposed use of the Carril El Herradero is for a Horse Racing facility and an outdoor rodeo/
roping arena as a Use allowed by Special Review in the Agricultural (A) Zone District per Weld
County Code Section 23-3-40.C.1 (Race Tracks and race courses — Recreational facility); 23-3-
40.B.17& 18 (Commercial Rodeo Arena and Commercial Outdoor/Indoor Roping Arenas); 23-4-
200(Mobile Home as Principal Dwelling Unit for Caretaker's Residence).
Horse match racing is an event that is increasing in popularity. In addition to match racing,rodeos
and roping events will be highlighted. The mission of the Carril El Herradero is to provide a safe
entertainment forum for individuals in Northern Colorado. This facility and business has
differentiated from other facilities in that it is a safe and legal environment. The facility and property
owner has extensive business success in the Northern Colorado community and would like to further
develop his influence in this community by providing a high-quality operation.
Concessions will be catered by a licensed establishment. Liquor will be served in an Arena beer
garden for the Match Races to those patrons who do not appear to be intoxicated. The applicant
would like to have the option of licensing the entire premise to serve alcohol. All serving staff will
be T.J.P.S.trained. If a patron appears to not be able to drive,staff will drive the individual home. If
the patron refuses a safe ride home from staff, the Sheriffs office will be contacted. Cars will be
checked at the entrance to make sure alcohol is not brought onto the property by spectators and
participants.
Either a Mobile Home,modular or stick-built structure will be placed on the property upon approval
of this USR application to be used as a Residential structure for an on-site caretaker. Section 23-4-
200 for a Principal Dwelling shall be adhered to, if necessary for the structure.
The command center shall also serve as an emergency First Aid center. Supplies will be kept in the
care taker's quarters in the event First Aid is needed.At least one employee will be certified in CPR
and First Aid and present at each event. This employee will wear identifiable clothing and carry a
walkie-talkie or cell phone for accessibility. For events with greater than 1,000 participants, two
EMTs will be on site.
On-site security measures have been planned in the following manner:
• The applicant will be working with the Weld County Sheriff's Office through the Crime
Prevention Through Environmental Design program.
• The Sheriffs Office has also agreed to assist the applicant with emergency strategies.
• Security on-site will be enforced by employees and/or contract officers.

• Firearms are not allowed on the premises except for enforcement officials and the property
owner.
• Staff will periodically collect proceeds and store in a safe place.
• Evidence of Liability Insurance is available, upon request, in the form of a Certificate of
Insurance.
2. Explain how this proposal is consistent with the intent of the Weld County Code,Chapter 22
(Comprehensive Plan).
Guiding Principles of the Comprehensive Plan found in Section 22-1-120 state, "Land use
changes must afford flexibility based on the specific location and the particular circumstances
encountered within this locality. It is also important to weight the cumulative impacts that
specific land use changes will have." This proposal represents a change in use that is consistent
with the surrounding properties. Currently,the average size of the 5 adjacent properties is 371.96
acres. The smallest adjacent parcel is 78 acres in size. Land Use activities on adjacent properties
and surrounding area include Mobile Homes, a Turkey Farm, an Egg Facility and Industrial Uses.
The uses proposed will be compatible with the future development of the surrounding area as
permitted by the existing zone district and with future development as projected by Chapter 22 of
this Code and any other applicable code provisions or ordinances in effect, or the adopted Master
Plans of affected municipalities.
• The property is not located within the I-25 Mixed Use Development area or within an
Intergovernmental Agreement Boundary. The site is located approximately 6 miles east
of Platteville, 10 miles south of LaSalle, and 8 miles northeast of Fort Lupton.
• The applicant made contact with surrounding property owners in late April and early
May, 2005 regarding proposed plans. Of those neighbors the applicant spoke with, no
negative comments were received.
• The Right to Farm Statement as found in the Weld County Code shall be observed.
• The property perimeter is fenced in three-strand barbed wire to contain parking and
pedestrian movement to this site. Gates are to be located at the three entrance points to
the property.
• Loud noises such as radios and other music is not appropriate to this site as the music
often scares the horses. Any music played prior and after the event will be kept to a
minimum level to not disturb neighbors. Music will be played during the day but not
during an actual race.
This proposal is for a Horse Racing facility as a Use allowed by Special Review in the Agricultural
(A) Zone District per Weld County Code Section 23-3-40.C.1 (Race Tracks and race courses —
Recreational facility); 23-3-40.B.17 & 18 (Commercial Rodeo Arena and Commercial
Outdoor/Indoor Roping Arenas);23-4-200(Mobile Home as Principal Dwelling),if necessary based
upon the type of structure used. The uses listed in these sections were carefully reviewed. These
uses have been identified as appropriate uses through a Special Use Permit in the Agricultural Zone
District by Section 23-3-40 of the Weld County Code.
Efficient and orderly land development and the conservation of agricultural land suggest that urban-
type development take place in or adjacent to existing municipalities or where adequate

infrastructure is currently available or reasonably obtainable. Through review of Section 22-2-
100.B, the applicant has taken necessary steps to ensure that adequate water, sewage disposal,
security, access and fire protection is available to the site.
• Fire Protection will be handled in the following manner:
o Platteville Fire Protection District will be advised of any and all operational days.
o An emergency access for Emergency Personnel and the Sheriff's Office is illustrated
on the plat.
o In the event of an emergency, a staff member will meet the responding Emergency
Personnel at the Emergency Entrance and guide them to the situation.
• The proposed Waste Handling Plan is as follows:
o Garbage collection will be accomplished through B & C Refuse on Mondays. The
contact person at B & C Refuse is Brad or Carol. The telephone number is (970)
785-2908.
o Any unforeseen trash along the property perimeter will be picked up and disposed of.
o Participants will be reminded of the site's cleanliness goals upon entering.
o Garbage cans/barrels will be placed throughout the site for use on event days. A
trash collection location has been delineated on the plat and is located adjacent to the
primary parking area.
o Anticipated waste to be generated on site includes food and beverage containers and
food and beverage storage/preparation containers including, but not limited to
Styrofoam, paper, cardboard,plastic, metal, aluminum, and glass.
• A Manure Handling Plan is as follows:
o On-Site Manure will be disposed of in an appropriate manner.
• Drinking Water will be provided by a well and/or through a contract with a bottled water
provider.
• Sanitary Sewage Disposal will be accomplished by state and county—approved methods.
The continuance of,and support of,agriculture in Weld County is a paramount goal outlined in the
Weld County Comprehensive Plan, Chapter 22 of the Weld County Code. Support of the Agri-
Business Sector is equally important. This facility will host rodeo, roping and racing activities.
A.Policy 1.3 of Section 22-2-60.3 states,"Allow commercial and industrial uses,which are directly
related to, or dependent upon agriculture to located within the Agricultural Zone District when the
impact to surrounding properties is minimal, and where adequate services and infrastructure are
currently available or reasonably obtainable. . . .Agricultural businesses and industries are defined
as those which are related to ranching,livestock production,farming and agricultural uses." Rodeos
and Roping arenas are directly related to ranching operations. As stated previously in application
materials, adequate services are obtainable at this site.
3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23
(Zoning) and the zone district in which it is located.
This application has been filed in accordance with Article 2, Division 4, Chapter 23 of the
Weld County Code, starting with Section 23-2-200. Application materials submitted comply
with Article V of Chapter 23 of the Weld County Code (Overlay Districts).
o The property is not located within the I-25 Mixed Use Development area or within an
Intergovernmental Agreement Boundary. Use by Special Review Design Standards

found in Section 23-2-240 of the Weld County Code were consulted in preparing this
application.
o The site is not in an Overlay District,verified by documentation supported by and/or
created by the Department of Planning Services.
The use is proposed to be located in the Agricultural Zone District. The property is classified
as"Other"by the USDA as illustrated on the Weld County Prime AG Map dated June 8,
2001 on file with the Weld County Department of Planning Services. Therefore, "Prime"
Farmland is not being removed from production. This land shall remain in agricultural
zoning for a use directly related to agricultural, ranching and agri-business operations.
Adequate provision has been made to protect the health, safety and welfare of the inhabitants
of the neighborhood and the County. Operation Standards as found in Section 23-2-260 of
the Weld County Code were consulted in preparing this application as stated previously in
application materials.
Conditions of Approval and Development Standards ensure the development upholds the
purpose and intent of the Weld County Code, Chapter 23 as listed in Section 23-1-40. Such
Conditions of Approval and Development Standards as found in the Weld County Code,Referral
Agency responses and Staff Comments shall be considered and appropriately incorporated into
the final use and site design.
A noise report,as stipulated in Section 23-2-260.E.A is not applicable. Based upon the proposed
uses, the applicants believe the proposed uses will not necessitate such report and are hereby
requesting a waiver from this requirement.
4. What type of uses surround the site? Explain bow the proposed use is consistent and
compatible with surrounding land uses.
Surrounding land uses include agricultural and rural residential. The nearest residential structure
located off this property is approximately 600 feet from the property boundary. Currently, the
average size of the 5 adjacent properties is 371.96 acres. The smallest adjacent parcel is 78 acres
in size. Land Use activities on adjacent properties and surrounding areas include Mobile Homes,
equestrian activities, and agricultural uses including an existing hatchery facility. Also to the
southeast of this site is industrial zoning which includes the tire mountain facility.
The following measures will ensure compatibility of the proposed use to surrounding properties:
Dust Abatement Plan: Dust is to be handled by a water truck during event days.
• The track and also WCR 28 is proposed to be watered to suppress dust during
events.
• Any manure generated on-site will be handled by standard best management
practices.

• The proposed animals units to be on this site during events will not exceed the
"units by right"in the agricultural zone district.
• Further a waiver has been requested herein from the requirements of a Noise
Report and a Lighting Plan as the uses anticipated will not warrant the preparation
of such documents.
5. Describe, in detail,the following:
a. How many people will use this site
A maximum number of participants and spectators at each event will be 2,000.The number of
spectators to this site are proposed to be phased based on requirements pertaining to the
septic systems and possible state site application requirements. The number of participants
and spectators for phase one based on the existing septic system plan is 1,079. Phase two
would allow up to 2,000 participants and spectators based on an approved site application
through the State Health Department.
Approximately 20 Employees will serve the site in the following capacities during events:
parking attendants, racing officials, cleaning services, and security personnel. Employees
may be on site when an event is not scheduled for maintenance and upkeep. A care-taker
will reside on site.
The 1,079 number does not include 20 employees or the caretaker's facility. Therefore Phase
One would allow for a maximum of 1,103 persons using the site.
b. How many employees are proposed to be employed at this site?
Approximately 20 Employees will serve the site in the following capacities during events:
parking attendants,racing officials, cleaning services,and security personnel. At least one
employee will be certified in both CPR and First Aid as stated previously in application
materials. Outside events, employees may be on site for maintenance and upkeep. A care-
taker and his/her family will also reside on site(not to exceed four people).
c. What are the hours of operation?
The following schedule will be adhered to for events:
Wednesdays: 3 p.m.— Sundown;
Saturdays: 9 a.m.-Sundown;
Sundays: Noon—Sundown
Special Occasions: 9 a.m.—Sundown.
Special Events include the following: Memorial Day,4th of July,Labor Day,Thanksgiving,
Christmas and New Years Eve and New Year's Day.
It is important to note that employees may remain on site after sundown to complete their
assignments(maintenance, cleaning, etc.).

d. What type and how many structures will be erected (built) on this site?
The proposed facility includes the following structures and/or areas as illustrated on the
attached plans:
A future outdoor rodeo and roping arena with grand stand;
Restroom facilities;
A concessions and command center area;
Primary and secondary parking areas;
Parking and horse facilities for participants and owners of livestock;
Shelters and grand stands for spectators;
Beer garden area;
Playground area;
Storage Shed for equipment storage;
A caretakers quarters.
Outdoor Lighting of the race track is not planned at this time. Traditional lighting of other
buildings will be designed to retain light within the property boundaries and not spill onto
adjacent properties. Therefore, a Lighting Plan is not necessary to this application.
The concessions will be through a mobile licensed vender and is proposed to serve snack
items such as chips,sodas,hamburgers,and hotdogs. Alcohol is also proposed to be served.
Appropriate permits and applications shall be filed upon approval of the USR application.
A Mobile Home, modular or stick built residence shall be placed onto the property after
approval of this USR application and applicable permits to be used as a Residential structure
for an on-site caretaker. Section 23-4-200 for a Principal Dwelling shall be adhered to, as
applicable. A building envelope has been designated on the Use by Special Review plat for
potential future construction of a caretaker's garage and/or additional storage structures, as
needed.
The aforementioned new structures and areas are anticipated to be constructed in phases
beginning at the earliest date possible based upon approval of this permit,plat recording,and
approved building and septic permits.
e. What type and how many animals,if any,will be on this site?
It is anticipated that 30 horses and 20 - 30 cattle will be on site for each event. Ten (10)
Horses will be housed on site. The animal units allowed by right in the agricultural zone
district as found in Section 23-1-90 of the Weld County is 4 Animal Units per acre. The
animals on this property shall not exceed those allowed by right. It is not anticipated that
more animals units will be on site than those listed above,however,this application doesn't
preclude the property owner the ability to have animals units within the numbers allowed in
the agricultural zone district as long as they don't interfere with the proposed operations of
the facility.
f. What kind(type,size,weight) of vehicles will access this site and how often?
A maximum number of participants and spectators at each event will be 2,000. These
individuals will access the site through passenger vehicles(approximately 700). Participant

Pick-Up Trucks, Sport Utility Vehicles and other passenger cars will also access the site
towing horse trailers. Employees will enter the site in passenger vehicles.
Site preparations prior to an event, and maintenance/site clean-up activities will be
accomplished through employee vehicles. Garbage collection will be accomplished through
B & C Refuse on Mondays.
A water truck will access the site to water the track and Weld County Road 28 for events.
The Sheriff's Office has agreed to lend the applicant four blinking speed radars to help
control traffic speed to and from the event. A special area for Emergency personnel vehicle
parking will be designated.
The Traffic, Circulation and Parking Plan is as follows:
o Signage will be placed at the entrance of the track illustrating where the following
site components are located: entrance, parking lots, emergency exit, concession
stand, and the First Aid Center.
o Accommodations for persons with disabilities will be made in accordance with the
Americans with Disabilities Act(ADA)through reasonable compliance. Parking has
been provided and is shown on the Plat.
o Two access points—2 lanes in and 2 lanes out at two different points.
o Any staging to occur will happen on the road south of the property and will not be
allowed on WCR 39.
o Emergency Access: An Emergency Access point in the northeastern corner of
property as illustrated on the plat. This access shall be maintained.
o Primary Access and Parking: The roadway on the property into the primary parking
area is to be either gravel or recycled asphalt. Parking will be accomplished by
parking attendants. The applicant is not proposing curb or wheel stops in the parking
area.
o Secondary/Overflow parking area: This area is to be left in its natural state and will
be used as needed. Future surfacing of this area will be investigated by the applicant
if needed based on success and number of cars accessing the site during events.
o Dust Abatement Plan: A water truck will come onto the site and spray the track and
WCR 28 adjacent to the property, as needed.
g. Who will provide fire protection to the site? The Platteville Fire Protection District will
provide fire protection to the site.
h. What is the water source on the property? A Well has been applied for. Drinking Water
will be provided by a well and/or through a contract with a bottled water provider and will
serve the following purposes:
o Caretaker's Residence;
o Restroom and Handwashing Facilities;
o Drinking water for patrons and employees (up to 2000);
o Livestock watering;

o Watering of the proposed shade trees;
o Track watering and dust suppression on WCR 28 south of the facility.
i. What is the sewage disposal system on the property? A Septic Permit shall be applied for
upon approval of this Use by Special Review application. The application procedures and
standards outlined by the Weld County Department of Public Health and Environment shall
be followed. Five conventional onsite wastewater systems(OWS)are proposed. One OWS
will serve the Caretaker's residence. Two OWS will serve each of the two restroom
buildings. All drain fields to meet the required setbacks from water wells and setbacks must
not overlap for Phase One.
j. If storage or warehousing is proposed,what type of items will be stored? Garbage areas
will be screened from view as depicted on the attached site map.
6. Explain the proposed landscaping for the site. The landscaping shall be separately submitted
as a landscape plan map as part of the application submittal.
Landscaping is shown on the plat. The planting of shade trees around the playground and the
command center/mobile concessions area will offer future shaded areas. Signage shall be located at
the property entrance. A sign detail is included on the plat.
7. Explain any proposed reclamation procedures when termination of the Use by Special Review
activity occurs.
Reclamation procedures are not applicable to this particular Use by Special Review application.
S. Explain how the storm water drainage will be handled on the site.
Storm flow patterns are illustrated on the attached USR plat and shall follow historic drainage
patterns. It is not anticipated that this proposal will affect the historic drainage off-site.
9. Explain how long it will take to construct this site and when construction and landscaping is
scheduled to begin.
Upon approval of this application,and the recording of this Use by Special Review plat,construction
will commence. It is the intent to proceed with the construction phase of the project at the earliest
date possible. Some of the proposed items may be phased based on need and the success of the
events.
10. Explain where storage and/or stockpile of wastes will occur on this site.
Garbage cans will be placed at several locations and emptied after each event to reduce flies,wind-
generated litter,etc. A large dumpster will be kept at the northwestern corner of the primary parking
lot to collect refuse from the garbage cans. This dumpster will be emptied once a week by the
garbage collection contractor as stated previously.
