As used herein, the term event means an assembly or anticipated assembly which is scheduled to last for three (3) consecutive days or less. July 16, 2005 from 11 AM till 8 PM. 4) 2000 People are expected to be at assembly a one given time. 5) No tickets will be sold. Event is open to the public. About 300 free entries will be given away on the radio for event. 6) Orosco Security Agency will be in charge of crowd control and to limit the number of persons to the maximum, security guards will not let any more people in to the event and traffic will be redirected. However we expect this not to happen, we planned ahead and fence off an area large enough to accommodate people if we were to surpass the number of people expected. 7) Tubs of bottled water will be placed on property to benefit our guest. Bottled water will be sold as well as other drinking beverages, like soda and juice. Please see attached drawing for tub locations. 8 cubic-yard dumpsters will be placed in locations that are beneficial to the event for dumping. Waste Management will provide all services for disposing of waste. (Waste Management 500 E. Vine Dr. Ft. Collins, CO 80524 970-416-3552) The measures of the dumpsters are 6 1/2 ft tall x 6ft wide. Also sinks will be provided by Super Bowl Portable Restrooms Incorporated (3263 Oakland St. Aurora, CO 80010 303-341-6828), Attached is a letter stating that Super Bowl Restrooms Incorporated will provide the service. 8) Waste Management will provide 8 cubic dumpsters to accommodate the disposing of garbage. They will also service and dispose of any waste collected at the event. (Waste Management 500 E. Vine Dr. Ft. Collins, CO 80524 970-416- 3552). 9) Super Bowl Portable Restrooms Incorporated(3263 Oakland St. Aurora, CO 80010 303-341-6828)will provide toilet facilities for both males and females. They clean and service all portable restrooms and also provide sinks and portable restrooms to accommodate any handicap people attending the event. Attached is a letter stating that Super Bowl Restrooms Incorporated will provide the portable restrooms for the event. 10)An application has been submitted to the Mountain View Fire Protection District, so that they can provide and paramedic service or emergency service for the event. 11)The property will not need to be illuminated because the event will be taking place outside during daylight hours. Sat. July 16th, 2005 from 11 AM till 8PM. 12)The parking lot will be 300 ft. x 500 ft. in size and a second parking lot for performers or vendors that is 200 ft. x 100 ft. in size. There are 5 roads leading to the event from County Line Road 1 and County Road 36. There are 3 emergency roads that are 20 ft wide for emergency for emergency vehicles only. 4 roads lead to County Line Rd 1. Two of them for the general public the other two roads are for emergency use. 1 road leading to County Rd 36 is for emergency Rd. use only. See sketch attached for any more information. 13)Cell phones will be made available for emergency use to communicate any accident or any emergency service needed. Orosco Security Agency will also have cell phone communication available for any emergency that needs to be reported. The Mountain View Fire Protection District will also be present upon review of application. 14)N/A 15)Plans for fire protection include having certified fire extinguishers on the property, no smoking on property, the Mountain View Fire Protection District to be present upon review of application. Also the tent being put up by Rental City is fire proof. First, just a couple days before the party, my husband and a newspaper photographer found the hearing sign that was supposed to be posted at the site, prior to the Commissioners meeting, informing neighbors of the proposed permit. The sign was found on the West side (Boulder County) of WCR1, in a field, down an embankment, and out of sight from the road. The sign was laying in the field and partially folded over so it could not be read. It was located on the opposite side of the road from where the event was held. The only way the sign could even be seen, much less read, was by climbing down the embankment and trespassing on private property across the road from the planned event. Upon examination of the sign we found no nail hole, tack hole, staple, tape or gum mark to indicate that this sign was ever attached to any kind of support structure. We feel it is obvious this sign was never intended to be posted or seen by residents in the area. We have this sign in our possession if you would like to inspect it. What my husband did find on the subject property was a blank hearing sign partially laid over flat and hidden in tall grass with no information concerning the event. It was a generic pre-printed sign with none of the information filled in. This is consistant with the non-compliant notification practices utilized last year when this same land owner applied for the same non-compliant special use permits. Second, we did inform authorities regarding the noise level during this party and our complaints have been recorded by authorized parties, including Boulder County Sheriff and the Weld County Sheriffs office per the recommendations of the Commissioners . One resident also measured noise levels of 90dB on an adjoining property about 200 yards from the property line. If you are not familiar with noise measurement, this is the maximum allowable level OSHA approves for an 8 hour shift in the workplace. That does not seem appropriate for a normally quiet residential neighborhood. Third, the clean up of the party did not meet the permits requirements. For at least 10 days after the party, large spray painted plywood signs were still posted at major intersections and in the town of Longmont with arrows pointing to our neighborhood. I was under the impression that all clean-up was to be completed within 48 hours. The porta- potty cluster was still located on the property. The posts for the fencing are still installed on the property. We do appreciate that this year the trash was picked up and not left to scatter throughout the neighborhood, as it was last year. Fourth, Prior to the party we complained that the ditch has been blocked in three places along WCR 1 without the benefit of any culverts for over a year. Last week we experienced heavy rains and flooding. Part of this flooding was due to the ditches being blocked. The water then overflowed west across WCR 1 and through neighboring properties and down Wasatch Rd. In addition to the impact on personal property, there is the cost to tax payers for road maintenance due to erosion over time, it has also affected the ditches along Wasatch Road. As a homeowner in the area, I was required to purchase a permit when I wanted to put in a driveway accessing a public road. This permit also required the installation of a culvert. Why is this other property exempt from this common requirement? We have reported this zoning violation, but nothing has been done by Weld County to correct this obvious oversight. As I am sure you can surmise by the tone of this letter, my neighbors and I are not in any way supportive or agreeable to the continuation of parties in our quiet residential neighborhood, and we feel that the organizers are intentionally trying to subvert any efforts of the homeowners to even be aware of the upcoming events. We feel it is important to note that the only non-residential land use in the area is farming. The only c.95?-t29- oy 2004-2279 buildings are homes. The radio station that is sponsoring t,.ose events is from Windsor, which is no-where near the Longmont/Mead area where they are having the parties. Wouldn't it be more appropriate to hold these parties in a location more consistant to these kinds of public events? Is it appropriate to sell beer without having any types of food available in a day long event? Is it appropriate to have minors present at an event where the only source of contribution is through the alcohol purchases? These parties do not charge admission, or charge for parking, they only make money on the beer sales. They are bringing in large crowds of people, encouraging alcohol consumption, generating intrusive noise levels, and increasing traffic on small side roads, by orders of magnitude in a quiet residential neighborhood. Is it appropriate for the Weld County Board of Commissioners to support an "outdoor bar" with live music where minors are also admitted? Another issue that I would like to draw your attention to is that as Boulder County residents we are subjected to rather strict rules regarding noise, lights and other zoning restrictions that do not apply in Weld County. As this party is being held on the county line, facing the Boulder county residents we are being subjected to the noise and other issues which our zoning regulations would normally protect us from. Our planning and zoning regulations would prevent us from organizing the same type of activity on our own property. The Boulder County officials cannot intervene if the noise is coming from a non-Boulder county location, and thus our hands are tied. As a Weld County official, you do not technically represent me, and I did not elect you, but I am being affected by your decisions just as surely as if I lived in downtown Greeley. When Mr Rodriguez went before the Planning Commission attempting to build a commercial business on this property, the Planning Commission did not approve his application because that type of business did not fit in with the surrounding neighborhood. I forgot that the "Special Use Permits" are not inside that commissions jurisdiction. Jacqueline Hatch, Planner, processed USR-1439. This case was presented to the Planning Commission on September 16,2003. The Planning Commission forwarded this case to the Board of County Commissioners with their recommendation of denial. Subsequently, the applicants did not respond to requests by staff to proceed with their application (USR-1439). Therefore, USR-1439 was never pursued to its completion. During previous special events, staff has received numerous complaints regarding, but not limited to,traffic, trash, noise and the number of people in attendance. Therefore, staff has the following concerns: Based upon Mr. Rodriguez's failure to finalize USR-1439, staff is concerned that whatever conditions of approval the Board may require might also not be completed. As a result of previous special events, staff is also concerned that removal of trash and fencing might not occur in a timely manner. However, no existing violations were noted. If approved, based up the 2,500 attendance listed in one of the applications, staff indicates the following minimal personal shall be in attendance: No less than 9 persons trained as EMT's shall be in attendance. Special Event Permit Questionnaire and Affidavit 1) An annual event is being planned. 2) The event is to benefit the Ronald McDonald House of Charity by donating proceeds from the event. The event is celebrating 'The 6th Year Anniversary of La Ley 1170 AM. The event gives listeners to celebrate their heritage and help raise money for a good cause. The festival will include live music by famous Mexican Regional Artist, clowns and a one-man circus act for the children. This gives families who do not take part in nighttime leisure activities the opportunity to listen and be entertained by there favorite Mexican regional artist. A team large enough to handle this kind of event will be assembled. 7) 12 security officers will be on site. 3 will monitor the beer garden and check Ids. 8) Security officers will be identified because they will be using their security uniforms. 9) An orange safety barricade fence will outline the premises and exterior boundaries. The work will be performed by R&M Drain and waterproofing. Attached is a copy of the type of fence and a letter of work performed. 10)Mexican Regional Artist will provide live performances. 11)Wristband will identify anyone over the age of 21. People over the age of 21 will be allowed to consume alcohol in beer garden area only, which can be identified in the drawings that are attached. Tampering with wristbands or the use of fake identification will result in ejection from the event. Any fake identification will be handled through the proper authorities. 12)Conduct and intoxication monitoring, will be done security officers and bartenders serving the beer. A local bar TEXMEX will be assisting us with serving the alcohol. Any guest who is suspected of misbehavior because of intoxication will be escorted from the premises and reported to the police. 13)Volunteers from local businesses with liquor license have committed to help serve alcohol. 14)Water, soda and juices will be available on the premises. However we expect this not to happen, we planned ahead and fence off an area large enough to accommodate people if we were to surpass the number of people expected. 7) Tubs of bottled water will be placed on property to benefit our guest. Bottled water will be sold as well as other drinking beverages, like soda and juice. Please see attached drawing for tub locations. 8 cubic-yard dumpsters will be placed in locations that are beneficial to the event for dumping. Also sinks will be provided by Super Bowl Portable Restrooms Incorporated (3263 Oakland St. Aurora, CO 80010 303-341-6828), Attached is a letter stating that Super Bowl Restrooms Incorporated will provide the service. 8) Waste Management will provide 8 cubic dumpsters to accommodate the disposing of garbage. They clean and service all portable restrooms and also provide sinks and portable restrooms to accommodate any handicap people attending the event. Attached is a letter stating that Super Bowl Restrooms Incorporated will provide the portable restrooms for the event. 10)An application has been submitted to the Mountain View Fire Protection District, so that they can provide and paramedic service or emergency service for the event. 11)The property will not need to be illuminated because the event will be taking place outside during daylight hours. Sat. July 16th, 2005 from 11 AM till 8PM. 12)The parking lot will be 300 ft. x 500 ft. in size and a second parking lot for performers or vendors that is 200 ft. x 100 ft. in size. There are 5 roads leading to the event from County Line Road 1 and County Road 36. There are 3 emergency roads that are 20 ft wide for emergency for emergency vehicles only. 4 roads lead to County Line Rd 1. Two of them for the general public the other two roads are for emergency use. 1 road leading to County Rd 36 is for emergency Rd. use only. See sketch attached for any more information. 13)Cell phones will be made available for emergency use to communicate any accident or any emergency service needed. Orosco Security Agency will also have cell phone communication available for any emergency that needs to be reported. HE STATED IN HIS CALL TO DISPATCH HE LIVED APPROXIMATELY 2.5 MILES NORTH OF HIGHWAY 66, AND THE REPORTING PARTY SAID HE COULD HEAR VERY LOUD MUSIC IN THE AREA. HE THINKS IT'S COMING FROM APPROXIMATELY ONE MILE AWAY. I DID NOT CONTACT HIM VIA PHONE PER HIS REQUEST.
