FOR A USE PERMITTED AS A USE BY RIGHT, ACCESSORY USE, OR USE BY
SPECIAL REVIEW IN THE COMMERCIAL AND INDUSTRIAL ZONE DISTRICTS
(WELDING FABRICATION SHOP) IN THE A (AGRICULTURAL) ZONE DISTRICT -
DANIEL DAVIS, C/O LARRY AND KATHY RITTEL
A public hearing was conducted on August 3, 2005, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated June 24,2005,and duly published June 29,2005, in
the Fort Lupton Press, a public hearing was conducted on July 13, 2005, to consider the request
of Daniel Davis,do Larry and Kathy Rittel fora Site Specific Development Plan and Use by Special
Review Permit#1506 for a Use Permitted as a Use by Right, Accessory Use, or Use by Special
Review in the Commercial and Industrial Zone Districts (welding fabrication shop) in the
A(Agricultural)Zone District. At said hearing,at the request of the applicant, the Board deemed it
advisable to continue the matter to August 3, 2005, when a full quorum of the Board would be
present. On August 3,2005,Lee Morrison,Assistant CountyAttorney,made this a matter of record.
Kim Ogle, Department of Planning Services,gave a brief description of the location of the site and
surrounding land uses. He stated the site will be serviced by an existing domestic well and
individual sewage disposal system which are associated with an on-site single family dwelling unit.
He further stated the site is accessed from Weld County Road 392,which is a paved road,and the
internal driveway and parking will be gravel. Mr.Ogle stated eleven referral agencies reviewed this
proposal, eight responded favorably or provided comments which have been addressed in the
Conditions of Approval and Development Standards, staff has not received any correspondence
from surrounding property owners,and he displayed photographs of the site and surrounding area.
Char Davis, Department of Public Health and Environment, reiterated the site will be serviced by
an existing domestic well and a septic system.
Donald Carroll, Department of Public Works, stated there is one main access from Weld County
Road 392,and there is adequate turning radii,parking,and drainage. Responding to Commissioner
Vaad, Mr. Carroll stated the access is located approximately 828 feet south of Weld County
Road 392.

Dennis Egge, CR Design Service, represented the applicant and stated this will be a home-based
business, most of the work will take place at the customers'locations,there will be no employees,
and the site will be used solely for storage and fabrication. Responding to Commissioner Long,
Larry Rittel, applicant, indicated he recently purchased the property.
No public testimony was offered concerning this matter. In response to Chair Jerke, Mr. Egge
stated he and the applicants have reviewed and concur with the Conditions of Approval and
Development Standards as proposed.
Commissioner Long moved to approve the request of Daniel Davis,c/o Larry and Kathy Rittel,for
a Site Specific Development Plan and Use by Special Review Permit#1506 fora Use Permitted as
a Use by Right,Accessory Use,or Use by Special Review in the Commercial and Industrial Zone
Districts (welding fabrication shop) in the A (Agricultural) Zone District, based on the
recommendations of the Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record. The motion was seconded by
Commissioner Masden,and it carried unanimously. There being no further discussion,the hearing
was completed at 11:30 a.m.
This Certification was approved on the 8th day of August 2005.
