HomeMy WebLinkAbout20050876.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST 1-25 PROPERTIES AND RICARDO MORGANTI, DBA MORGANTI MODULAR HOMES, FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, 1-25 Properties and Ricardo Morganti, dba Morganti Modular Homes, VI #0400135, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 13th day of December, 2005, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, 1-25 Properties and Ricardo Morganti,dba Morganti Modular Homes,were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS,the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until January 13, 2006, to allow adequate time for the property owners to record the Site Plan Review to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. Condition #2: Back in June I spoke with the Building Official - Roger Vigil. His determination that show homes and the office facility would need building permits. At that time, I forwarded Roger's response via e-mail to Mike McDonough The principal issue was to provide accessibility for the Public. Roger indicated that the permit fee for the show homes (since block & tie and temporary)would be only $400.00 vs. the full fee. Any questions should be directed to Roger Vigil at (970) 353-6100 ext. 3540. #3 - In regards to item#3. You are located in the Geologic Hazard Overlay District. Staff does not have the authority to waive this condition. The way that this has been dealt with in the past is that the applicant contacts the Colo. Geological Survey to see if they would be willing to provide evidence that there are no hazards and no geologic hazard permit will be required. (I would recommend contacting Celia Greenman at Geological Survey at (303) 866-2611). Remaining items (in addition to what you have already mentioned)are: Item H: Submit an amended plat for USR-971 (for the woodworking shop)that amends the boundaries for USR- 971 so that it is not located within the boundaries of your site plan review. I would recommend getting a full size copy of the USR-971 plat and making modifications to the boundaries on the site map. The requirements for amending USR boundaries is located in Section 23-2-200.G of the Weld County Code. You can access this section by going to the county website at www.co.weld.co.us and then click"Weld County Code". Items I. and J: Let me know when these conditions have been addressed with Char Davis - Health Department. Item N: Improvements Agreement: The options regarding this condition are to provide collateral with the agreement for any remaining parking, landscaping and drainage (if any) improvements on site. Or in lieu of an improvements agreement, complete all improvements up front and let me know, then Planning and Public Works will verify that improvements have been completed. I have made arrangments with him after I e-mailed you yesterday, to complete this process ASAP. He is meeting with the engineer to begin the drainage report process tommorow. I will work out the financial obligation for that myself as I need this process to be completed immediatley. In addition to the drainage report, I understand there are six other things that need to be accomplished and they are as follows: 1. Apply for a zoning permit to allow for the use. 2. Apply for building permits for the models. 3. Provide information as to the geology of the site. 4.Document that we have a well generating at least 1000 gallons per day. 5. Demonstarate that the back door to the office is 200 feet or less from the restroom facilities. 6. A revised drawing showing the parking spaces and landscaping to be planted. Hopefully, this coincides with your records. Items 5 and 6 will be taken care of by the engineer that does the drainage report. I have called the person who owns the well and hope to have that information sent to me. As for items 1 and 2, we are a C-3 zoning and therefore allowed to operate the business here as mobile home sales as a Use by Right(Section 23-3-230 C-3 Business Commercial Zone District item #7 "Vehicle sales establishment" Described in the General Provisions section 23-1-90 a Vehicle Sales Establishment would include Mobile Home Sales) and therefore should not have to apply for zoning. In addition, building permits should not be necassary for the models as they are temporarily set up and then sold usually in a years time frame. There are no permanant foundations poured and no building, as the code would define "building" being done as a result of them being here. I am asking that these last two conditions (items 1 and 2 contained here) be waived based on this information. Item #3 I am not sure as to the relevancy and would asked that this condition also be waived. Please get back with me regarding these issues as soon as you are able. September 16, 2004 From: Bethany Salzman, Zoning Compliance Officer Subject: SPR-381 Referral Upon review of my computer and files, an active Zoning Violation was noted(VI-0400135). This violation was initiated as a result of the operation of"Morganti Modular Homes"without the required Weld County Zoning permits. This case was scheduled to appear before the Board of County Commissioner's through the Violation Hearing process on September 14, 2004; however, due to the receipt of this application staff requested the Board to refer the case back to our office. Several other issues have arisen during this violation process. Please see as follows: After speaking with Roger Vigil, Building Official, building permits shall be completed and submitted to the Department of Building Services for the 3 (three) modular home units already located on the property. Zoning Permits for Mobile Homes may also be required for the office and model homes. The Use by Special Review permit(USR-971)shall be reduced as to not include this site. During several inspections tall weeds and a "Noncommercial Junkyard"were noted on the USR site. The "Noncommercial Junkyard" consists of derelict vehicles, wood and miscellaneous debris. A Probable Cause case may need to be initiated to correct these violations of their existing USR. After approval, please make sure that an appropriate time line be established for them to record their plat.
