RESOLUTION
RE: APPROVE PARTIAL VACATION OF USE BY SPECIAL REVIEW PERMIT #13 -
KENNETH AND CHRISTI NEUENS /ALEX AND KELLY KURZ
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated August 25, 1975,the Board did approve Conditional Use
Permit#13, hereinafter referred to as Use by Special Review Permit#13,for the erection of a home
and treatment barn for equine practice in the A(Agricultural)Zone District for Kenneth Neuens,on
the following described real estate, to-wit:
The W 1/2S 1/2E1/2SW 1/4 of Section 30,Township 2
North, Range 68 West of the 6th P.M.,Weld County,
Colorado
WHEREAS,the Board has received a request from current property owners, Kenneth and
Christi Neuens,354 Weld County Road 16.5, Longmont, Colorado 80501,and Alex and Kelly Kurz,
348 Weld County Road 16.5, Longmont,Colorado 80504, to vacate a portion of said Use by Special
Review Permit#13, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present,studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said partial vacation, conditional upon the
following:
1. Pursuant to Section 23-2-200.G.5 of the Weld County Code, the applicant shall
submit a revised Partial Vacation Use by Special Review Plat, conforming to Section
23-2-260.D of the Weld County Code.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado,that Use by Special Review Permit#13 be,and hereby is, partially vacated,with
the abovementioned condition.

SUBJECT: Partial Vacation of CUP-13
The Department of Planning Services has received the attached letter dated September 3, 2005
from Kenneth and Christi Ann Neuens and Alex and Kelly Kurz. The Neuens' and the Kurz's
are requesting that CUP13 for a veterinarian practice be partially vacated. The partial vacation
is a requirement for a Recorded Exemption.
Background information:
Legal Description: Lot B of RE-2447 Part of W2 S2 E2 SW4 of Section 30, T2N, R68W of
the 6th P.M., Weld County, CO.
Location: Approximately Y mile east of County Road 1 and approximately 1/2 mile
south of County Road 16 Yz.
CUP-13: CUP-13 was approved by the BOCC on August 25, 1975, for a
veterinarian practice in the A (Agricultural) Zone District.
Parcel number: 1313 30 000084
Should the Board of County Commission choose to approve the request for a partial vacation of
CUP-13, Planning Staff recommends that a revised Partial Vacation USR plat of CUP-13 be
submitted as required by Section 23-2-200.G.5.

Kenneth and Christi Ann Neuens and Alex and Kelly Kurz request that CUP-13
boundary be amended to reflect the attached map. The use (veterinarian
practice) is being conducted only in the northern portion of the site and the
boundary does not need to be for the entire site.
