RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR USE BY SPECIAL
REVIEW PERMIT#1458 - KENNETH SHANNON
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,by Resolution dated September 1,2004,the Board approved the application of
Kenneth Shannon, P O. Box 843, Brighton,Colorado 80601,for a Mineral Resource Development
Facility, Including an Oil and Gas Support and Service Facility in the A(Agricultural)Zone District
on the following described real estate, to wit:
Part of the NW 1/4 of Section 28, Township 1 North,
Range 66 West of the 6th P.M., Weld County,
Colorado, and
WHEREAS,on May 4,2005,the Board of County Commissioner of Weld County,Colorado,
approved an Improvements AgreementAccording to Policy Regarding Collateral for Improvements
(Private Road Maintenance)for, between the County of Weld,State of Colorado, by and through the
Board of County Commissioners of Weld County, and Kenneth Shannon with terms and conditions
being as stated in said agreement, and accepted personal check #5598 from the account of
Kenneth or Margaret Shannon,drawn on the drawn on the Valley Bank and Trust, in the amount of
$4,373.13, and
WHEREAS,staff from the Weld County Department of Public Works has conducted a visual
inspection and recommends release of said collateral.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the collateral listed above, in the amount of$4,373.13 be, and hereby is,
canceled and released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is,
directed to return said collateral to the appropriate issuing party.

COLORADO SUBJECT: USR-1458 Kenneth Shannon
The applicant for USR-1458, Kenneth Shannon has submitted the attached letter dated July 22,
2005. The applicant is requesting a full release of collateral for lighting. The Department of
Planning Services conducted a site visit for compliance and finds that the lighting is in
compliance with the recorded plat.
The Use by Special Review USR-1458 was accepted by the Board of County Commissioners
on September 1, 2004.
Staff is recommending that the request for release of collateral for four thousand three hundred
and seventy three dollars and thirteen cents be approved at this time since the lighting installed
at 1760 County Road 27 meets the Weld County Code and the recorded USR-1458 plat.

Dear Clerk and Members to the Board:
In April I submitted a check #5598 in the amount of$4373.13 to the board. This money
was to be retained until I received approval from the planner, Ms. Jacqueline Hatch, for
the lot lights that were installed on my property located at 1760 Weld County Road 27.
Ms. Hatch has approved the lights and has directed me to submit in writing my request
for the release of the monies being held. I would appreciate your prompt attention to this
matter.
Thank you for your concern of the condition of my property and the consideration of
others near our facilities.
