RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0400375
AGAINST DAVID ISAACS FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, David Isaacs, VI#0400375, is allegedly in violation of the Weld County Code,
and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of June, 2005, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, David Isaacs was not present or represented at said hearing, although all
parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS,the Board of County Commissioners deems it advisable to refer said violation
back to the Department of Planning Services for further investigation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado,that VI#0400375 be,and hereby is, referred back to the Department of Planning
Services for further investigation.

REMEDY
To bring the property into compliance the"Noncommercial Junkyard" consisting of derelict vehicles and a

RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney's
office for immediate legal action.
CASE HISTORY
November 18, 2005 Initial complaint received.
December 30, 2004 Five day compliance encouragement letter issued.
January 11, 2005 Received email from property owner stating he was not living in camper/trailer.
February 8, 2005 Email was sent responding to his.
February 2, 2005 Initial inspection completed.
March 30, 2005 Violation letter issued. Sent Certified.
April 26, 2005 Property inspected. Property remains in violation.

May 2, 2005 Letter sent to property owner indicating that the violation case was scheduled
before the Board of County Commissioners.
June 6, 2005 Property owner came into office and met with me. He also met with Plans
Examiner, Bryon Horgen, who looked over his building plans and cleared him for
the need of any permits. Mr. Isaacs also stated vehicles were all tagged. I would
inspect the day before hearings.

The property referenced above remains in violation of the Weld County Code. I have scheduled a
meeting with the Board of County Commissioners on June 14, 2005 at 10:00 a.m., to consider the
violations occurring on the property. The above mentioned property remains in violation of the

permitted under Section 23-3-20 A above.

To bring the property into compliance:
The"Noncommercial Junkyard" consisting of derelict vehicles, camper/trailer, a pile of
wood and trash and a pile of scrap metal, shall be removed, restored or screened from
all adjacent properties and all public road right-of-ways. Additionally, building permits
shall be obtained for the newly constructed structure and any remodeling done with the
existing one.
This hearing will take place in our Hearing Room, located at 918 10th Street, Greeley, Colorado. It is
recommended that you or a representative be in attendance to answer any questions the Board of
County Commissioners might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent properties
the business day before or as in as possible to the above mentioned Vic Dn Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the violation. Our
records indicate that you were made aware of the nature of the violation including the action necessary
to correct the violation, and that you were given sufficient time to remedy this violation. If you have any
questions concerning this matter, please call me.

Dear Mr. Isaacs:
The uses on the above described property are being considered as a zoning code violation of Sections of the
Weld County Code. Currently your property is in violation of the following Section(s)of the Weld County Code:
Chapter 23, Article Ill, Div 1 "(Agricultural) Zone District"
Section 23-3-20 "Uses allowed by right"
Section 23-3-30 "Accessory uses"
Section 23-3-30.1 "Noncommercial Junkyard"
To bring your property into compliance with the Weld County Code:
The "Noncommercial Junkyard" consisting of wood, pallets, metal, derelict vehicles and other
miscellaneous debris shall be removed, restored or screened from all adjacent properties and public
right-of-ways.
There was also a Recreational Vehicle noted on your property that appeared to be set with hay bails.
The Weld County Code does not make provisions for the utilization of Recreational Vehicles as storage
units. The term Recreational Vehicle shall include: motor home, camper bus and travel trailer. There
fore,the unit shall remain unplugged at all times, and maintain current plates and tags;otherwise it shall
be removed from the property.
NONCOMMERCIAL JUNKYARD: An area where any waste,junk or used or secondhand materials are
stored or handled, including but not limited to scrap iron and other metals, paper, rags, rubber tires,
building materials and bottles. A NONCOMMERCIAL JUNKYARD may also include the storage or
keeping of DERELICT VEHILCES registered last or currently registered under the property owner
and/or tenant's name.
This definition does not include COMMERCIAL VEHICLES. If the Zone district allows, the
NONCOMMERCIAL JUNKYARD shall be totally ENCLOSED within a BUILDING or STRUCTURE or
visually SCREENED from all ADJACENT properties and public right-of-way.
DERELICT VEHICLE: A vehicle that is inoperable (unable to move under its own power); is partially or
totally dismantled; has eu or portions of its body work missing or is substantially damaged; is not
registered with the State, as required by Section 42-3-103,C.R.S.,or by Section 42-3-138 or 42-12-102,
C.R.S., and/or the number plate assigned to it is not permanently attached to the vehicle,as required by
Section 42-3-123, C.R.S.; or is lacking proper equipment to the extent that it would be unsafe or illegal
to USE on public road rights-of-way or otherwise not equipped with lamps and other equipment as
required in Sections 42-4-202 to 42-2-227, C.R.S. This definition shall not include implements of
husbandry, farm tractors or vehicles customarily operated in a FARMING operation.
JUNK: Scrap brass, iron, lead, tin, zinc; all other scrap metals and alloys; bones; rages; used cloth,
rope, rubber, tinfoil, bottles, old or used machinery of any type; used tools; used appliances; used
lumber or crates; building materials;fabrication of any material; used pipe or pipe fittings; used conduit
or conduit fittings; used automobile parts; DERELICT VEHICLES; used tires and other manufactured
goods that are so worn, deteriorated or obsolete as to make them unusable in their existing condition.
SCREENED: Construction and maintenance of fences, earth berms or the USE of LANDSCAPING
materials or other materials USED with the approval of the Department of Planning Services to lessen
the noise, light, heat or visual impacts of a USE on surrounding uses. A SCREENING PLAN shall be
submitted and approved by the Department of Planning Services.
It is the intention of this office to assist and cooperate with you without imposing undue hardships; however,
we have no discretion in this matter if you fail to correct this violation. You have 30 (thirty) days from
February 23, 2005, to correct this zoning violation. Failure to do so will result in this office scheduling the
violation before the Board of County Commissioners to consider whether to refer the violation to the County
Attorney's Office for legal action.

I am responding to your email written to Bethany Salzman, on January 11, 2005, regarding the use of a
camper/trailer as storage or a dwelling unit and a "Noncommercial Junkyard"on the property.
You stated that you are not living in the camper/trailer, but simply using it as storage. The Weld County Code
does not make provisions for the utilization of Recreational Vehicles as storage units. The term Recreational
Vehicle shall include: motor home, camper bus and travel trailer. Therefore, the unit shall remain unplugged at
all times,and maintain current plates and tags; otherwise it shall be removed from the property.
As for the "Noncommercial Junkyard", you said that is has been cleaned up and the remainder of the junk and
debris is from surrounding neighbors. If this is the case, I would ask that you call me to set up an on-site
inspection so we can clear up any discrepancies that remain.

I received your letter dated December 30, 2004.
I am absolutely not living in a camper/trailer, I have a house that I am living in. I am using the motorhome that I have
parked here for storage of items I don't want in the house and don't want to freeze.
I do not have any derelict vehicles on my property. All vehicles are able to move under thier own power, are not missing
portions of thier body or have any unsafe conditions or any defects which would make them illegal to operate on the public
highways. License plates are current and I have proper insurance on the vehicle that I do drive on the roads.
I have cleaned most up the few items of junk and debris that were on the property when I purchased it in September. This
junk was sitting here for years untouched.
However, the property to my west and northwest does have numerous derelict vehicles, rusted metal, motorhome frames
and tons of junk and debris. This debris has obviously been there for many years. Also on this property is a camper that
the owner stays in from time to time, but he does not live there.
Likewise, I note that most every piece of property out in this area has junk of one sort or another,junk which has been
there for years and years.

It has come to the attention of the Department of Planning Services'staff that the uses on your property may
