Explain, in detail,the proposed use of the property. The proposed use of the Windsor Assembly of God Church development includes built and natural environments. The proposed Church building includes a 296-seat multi-purpose room,classrooms, office and reception areas, restroom facilities, and a serving area/warming kitchen. The kitchen facility is not intended for food preparation on-site but for food to be brought in and served. A 101- stall paved parking lot is planned to serve the proposed church. Please refer to attached conceptual designs, site layout, lighting and landscape plans. The 12,000 square foot Church building is centrally located on the property. See attached concept elevation drawings. The church structure is a one-story building. The height of the building is depicted as 37 feet to the main gable and 47— '/z feet to the peak of the tower. This height is to be finalized with the size of the main assembly spaces and slope of the roofs,but not to exceed 50 feet tall. The final building height will be determined at time of building permit. The open field area depicted on the Use by Special Review plat provides a buffer between the existing single family houses along the eastern property boundary and the Windsor Reservoir Outlet Ditch. This space will also be used for recreational and continued agricultural outdoor uses. Such uses include picnics, church softball and volleyball games and other church associated gatherings. The gatherings, on occasion, may necessitate the need for use of Port-a-lets. The appropriate permitting and/or correspondence with Weld County officials will be followed in such an event. The applicant has been in contact with a representatives from the Larimer & Weld Irrigation Company and the Chalgren Latteral concerning this proposal. The applicant will continue to work with them to address any items that may come out of this proposal concerning the ditches. The Town of Windsor has adopted a plan called the`State Highway 257 North Corridor Plan.' This plan addresses design and site lay-out guidelines and standards. This plan was consulted when making site-specific decisions about the site. It is the applicant's belief that the proposed site plan meets the intent of the Windsor State Highway 257 North Corridor Plan. Lighting will be designed to retain light within the property boundaries and not spill onto adjacent properties. Pole luminaries will be full-cutoff with flat lenses and not exceeding 30'in height. Poles will be a dark, non-reflective finish such as medium or dark bronze. No light will spill onto residential properties and limited spill will occur onto Weld Country Road#72 which will provide entry illumination to the site. Building-mounted lighting will have cut-off optics to ensure quality light levels on portions of the property near the buildings,but will avoid glare or spill-off onto other property. All lighting will comply with Weld County standards and Windsor"State Highway 257 North Corridor Plan" lighting standards. 1 2. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 22 (Comprehensive Plan). • Chapter 22 of the Weld County Code discusses general provisions of land use categories. Section 22-1-50.D.3.a.1 states, "Conversion of agricultural lands to urban uses will be considered, but only in the areas in or around existing municipalities or in other areas where adequate facilities such as roads, sanitary sewer, water, etc., and adequate services such as fire protection,police, schools, etc., are currently available or reasonably obtainable. Compatibility of land uses will also be considered." And Section 22-1-50.D.4 states, "The cumulative effect of the goals and policies described in Article II will result in: b)Urbanization occurring in and around the cities and towns within the County." o This proposal is located in unincorporated Weld County in an area sandwiched between the growing municipalities of Windsor and Severance. Moriah Estates, a County-approved Residential Subdivision of 24 lots of approximately 1-acre each, is east of and east of and adjacent to this property. North Shores at Windsor, a Town of Windsor Residential Subdivision of 45 lots of approximately 2.5-acres each, is south of and adjacent to Weld County Road 72, based upon Assessor Information. o The current Town of Severance is approximately 1-1/3 miles north of the site, based upon Assessor Information. o This area is quickly urbanizing. o Agricultural uses are located north and west of and adjacent to this property. The end use proposed through this application will not change the zone of the property. The end use will be compatible with agricultural zoning. • Section 22-1-50.D.3.a.2 states, "Conversion of agricultural lands to non urban uses will be accommodated only in areas that can support such development with adequate facilities and services. This allows low density and low intensity development to occur where appropriate. It also encourages techniques and incentives such as clustering, restrictive easements, building envelopes and setbacks to be used to both minimize the impacts on surrounding properties, as well as conserve lands for agricultural production." o The proposed end use, a Church, is defined in the Weld County Code, Section 23- 3-40.E.1 as a Use allowed by Special Review in the Agricultural Zone District. A Church is also a Use allowed by Special Review in the R-1 and Estate Zone Districts. The property will remain in the Agriculture Zone District. The desired end use, a Church, is a consistent Use by Special Review in the existing district as well as the surrounding districts. The proposal is consistent with the intent of the district in which the use is located. o 22-1-120 Comprehensive Plan guiding principles state, "Land use changes must afford flexibility based on the specific location and the particular circumstances encountered within this locality. It is also important to weight the cumulative impacts that specific land use changes will have." This change is consistent with the surrounding properties as a Church is a Use allowed by Special Review in the R-1, Estate Zone and Agricultural Zone Districts. o Conversion of agricultural land to non urban residential, commercial and industrial uses will be considered when the subject site is in an area that can support such development. Such development shall attempt to be compatible with the region. This goal is intended to address conversion of agricultural land to non 2 urban uses. Once converted,this land is less conducive to agricultural production (A.Goal 4) o Section 22-1-50.D.2.b states, "Development outside of municipalities will occur only at the intensity that can be supported." o Efficient and orderly land development and the conservation of agricultural land suggest that urban-type development take place in or adjacent to existing municipalities or where adequate infrastructure is currently available or reasonably obtainable. 22-2-100.B. • North Weld County Water District, CDOT, the Weld County Department of Public Health and Environment, and utility service providers concur that required infrastructure can be reasonably obtained to service the site. • The uses proposed will be compatible with the future development of the surrounding area as permitted by the existing zone and with future development as projected by Chapter 22 of this Code and any other applicable code provisions or ordinances in effect, or the adopted Master Plans of affected municipalities. o The property is not located within the I-25 Mixed Use Development area or within an Intergovernmental Agreement Boundary. The Town of Windsor's "State Highway 257 North Corridor Plan"was consulted in preparing this application. o An open house was held for surrounding property owners within 1,500 feet on November 3, 2004. Neighbors attending the meeting, and others who could not attend, have expressed positive remarks. Evidence of such meeting and written comments are included herein. • The Right to Farm Statement as found in the Weld County Code shall be observed. 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located. • This application has been filed in accordance with Article 2, Division 4, Chapter 23 of the Weld County Code, starting with Section 23-2-200. • The application materials submitted comply with Article V of Chapter 23 of the Weld County Code (Overlay Districts). o The property is not located within the I-25 Mixed Use Development area or within an Intergovernmental Agreement Boundary. Use by Special Review Design Standards found in Section 23-2-240 of the Weld County Code,along with those of the Town of Windsor's`State Highway 257 North Corridor Plan"were consulted in preparing this application. o The site is not in an Overlay District,verified by documentation supported by and/or created by the Department of Planning Services. • The use is proposed to be located in the Agricultural Zone District. A diligent effort has been made to conserve Prime Farmland in improvements location selection. o A portion of the site will have the ability to be in agricultural use such as a pasture. o Continued agricultural production on site is not economically conducive due to the shape and size of the parcel. • Adequate provision has been made to protect the health, safety and welfare of the inhabitants of the neighborhood and the County. 3 o Lighting will be designed to retain light within the property boundaries and not spill onto adjacent properties o CDOT has reviewed information regarding a safe access. o The Larimer& Weld Irrigation Company and the Chalgren Lateral have been contacted to discuss this proposal. o Operation Standards as found in Section 23-2-260 of the Weld County Code were consulted in preparing this application. • Conditions of Approval and Development Standards ensure the development upholds the purpose and intent of the Weld County Code, Chapter 23 as listed in Section 23-1-40. o Conditions of Approval and Development Standards as found in the Weld County Code, Referral Agency responses and Staff Comments shall be considered and appropriately incorporated into the final use of the site. • A noise report, as stipulated in Section 23-2-260.E.A is not applicable. Based upon the proposed uses,the applicants believe the proposed uses will not necessitate such report and are thereby requesting a waiver from this requirement. 4. What type of uses surround the site? Explain how the proposed use is consistent and compatible with surrounding land uses. Surrounding land uses include agricultural, rural residential, urban residential, and commercial. • Section 23-3-40.E.1 lists Public and Quasi-Public Buildings including Churches in Agricultural Zone District as an appropriate use allowed by special review. The same use is listed as a Use allowed by Special Review in the R-1 and Estate Zone Districts. This proposal is consistent with the current zone district and zone districts surrounding the site. 5. Describe,in detail, the following: a. How many people will use this site? Currently,the Windsor Assembly of God Church has 100 parishioners. The Assembly area depicted on attached plans has seating capacity of 296. b. How many employees are proposed to be employed at this site? 1 full time and 4 part- time employees will be employed on site on a regular basis. c. What are the hours of operation? The church building will be open from 7 a.m.to 9p.m. Seven days a week. The use of the Church on Sundays will be for Church Worship. Uses of the Church Monday through Saturday will be for funerals,weddings, small group meetings, and the business function of a Church Congregation. Occasional outdoor activities from sunrise to 10 p.m. will occur on a seasonal basis. Such activities include picnics, Easter Sunrise Services, "pick-up" recreational games, etc. d. What type and how many structures will be erected(built)on this site?A storage shed is shown on the site plan. The shed is to provide storage for the lawn and snow removal equipment. e. What type and how many animals, if any,will be on this site? The site would have the ability to have animals units based on the existing agricultural zoning. Currently there are no animal units located on the site. It is not the intent to have animals in the future,however this application doesn't preclude the ability to graze some animals on the site. f. What kind(type,size,weight)of vehicles will access this site and how often? Passenger vehicles will use the site on a regular basis. An occasional delivery vehicle will access the site. Funeral Flower Delivery, Wedding Item Delivery, Special Events, etc. Trash trucks may also access the site for trash pick-up. 4 g. Who will provide fire protection to the site? The Windsor Severance Fire Protection District will provide fire protection to the site. h. What is the water source on the property? The Church currently owns 4 shares of CBT, 1 share of Lake Lee Lateral Company and 1 share of the Larimer and Weld Irrigation Company. i. What is the sewage disposal system on the property? Septic. The applicant has been in contact with the Weld County Health Department as part of the application preparation process. j. If storage or warehousing is proposed,what type of items will be stored? Garbage areas will be screened from view as depicted on the attached site map. A storage shed has been depicted on the site map. The shed will house the lawn and snow removal equipment. A potential future path or drive may be constructed to the storage shed if site conditions warrant such. 6. Explain the proposed landscaping for the site. The landscaping shall be separately submitted as a landscape plan map as part of the application submittal. A separate landscaping plan has been submitted as part of the application materials. Landscaping is primarily located at the entrance of the site from WCR 72 and around the church building. Landscaping is proposed to be irrigated by an installed irrigation system. Do to the nature of this proposal,it is the intent that the site have the ability to add landscape elements on a donation basis to honor loved ones. The State Highway 257 Corridor plan developed by the Town of Windsor was consulted in preparing this document. It is the applicant's belief that this application meets the intent of the Town's State Highway 257 Corridor Plan. 7. Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs. Reclamation procedures are not applicable to this particular Use by Special Review application. 8. Explain how the storm water drainage will be handled on the site. Engineering documents are attached to this application explaining how storm water drainage will be handled on the site. 9. Explain how long it will take to construct this site and when construction and landscaping is scheduled to begin. Upon approval of this application,and the recording of this Use by Special Review plat,construction and landscaping will commence. SUBJECT: WINDSOR ASSEMBLY OF GOD PRELIMINARY DRAINAGE INFORMATION DATE: 12/16/2004 CC: TODD HODGES Windsor Assembly of God,Weld County,Colorado is located in the northeast corner of SH 257 and Weld County Road 72. The church currently owns 14.92 acres but will only be disturbing 6.33 acres. This proposed development includes constructing a new church,parking lot and access. The access point shall be located off of WCR 72. The site currently drains from north to south and this drainage pattern will be maintained with this development. The soils report from Ground Engineering and Weld County Soil Survey indicates that this is a sandy loam soil. The official classification is Kim Loam which is a type B soil. Per the PUD Sketch Plan Comments,this site is required complete a drainage report and detention. Detention is required to be for the 5 & 100 year events and will release at a 5 year event pre-developed flow rate. This site has utilized the UD&FCD FAA Detention method in conjunction with the Town of Greeley Rainfall data as was previously agreed to,please see attached e-mail. The rational method Q=CIA will be utilized in the routing, Q and Tc calculations. A weighted impervious factor has been calculated for the 6.33 acres disturbed at this time. The impervious factor calculated is 24%, please refer to attached calculations. The detention calculations are also attached. These calculations reflect the UD&FCD requirements but the allowable release rate unit has been adjusted to reflect Weld County's requirement of a 5 year pre-developed release rate for the 100 year event. The Q for undeveloped conditions has been calculated to be 2.07 cfs. The on-site pond will also include water quality volume per UD&FCD. Please see attached calculations. The front half of the building,parking lot and access drive will be routed to the pond. The parking lot has been graded to discharge at the southwest corner of it into the pond. The areas along the south and east of the building that will be graded but landscaped will continue to follow the existing drainage course.
