My name is Jonathan Glover. My family and I are against the issuance of a permit for a
Recreational facility and uses including race tracks and race courses (horse racing) for
Martin & Berta Gutierrez. IA 7,,P mean no ill will towards Mr. and Mrs. Gutierrez. I feel
very strongly that this type of recreation is not suitable for our neighborhood.
We have already seen the affects first hand on several occasions. The amount of traffic
going to and from their"facility" has already placed a tremendous burden on a normally
busy section of Weld County Road 31 bordering Aristocrat Ranchettes. On one
particular occasion, there were two lanes of traffic going in each direction down Road 31
leading into their property. It looked as if it were a four lane highway traffic jam. We
couldn't get in or out of our driveway for well over an hour. One Weld County Sheriff
arrived and was completely overwhelmed. It took him quite some time to even get to the
mouth of the Gutierrez property to try and disperse of the dozens of cars and trucks. Our
biggest concern was for the health and welfare of the area. If one of our neighbors or a
member of my family were in need of emergency services, there would have been a
serious circumstance.
We have also had "spectators"park and trespass on our property and go on foot into the
Gutierrez property. We are tired of the trash from beer bottles and beer cartons strewn up
and down Road 31 and on Road 16 after the parade of vehicles comes and goes with their
loud music and noise. On many occasions, the spectators are required to wait on the
street before entering and have used our public roads as their restrooms.
This type of activity is not suitable for this primarily residential area and we would ask
the Weld County Planning Services to decline the request for a Site Specific Development
Plan and Special Review Permit for a Recreational facilities and uses including race
tracks and race courses (horse racing) in the A (Agricultural) Zone District.

Per your request and in complying with the conditions of approval and development standards for(JSR-
1483, please accept the following:
C. Traffic Control Plan: attached is our trafic control plan. We have met with the Sheriff's
department and they have a copy of this. Please fmd a copy for the planning department as well as public
works department
(department of planning services).
D. Detailed Security Plan: We have contacted several security companies with the option of armed or
unarmed security personneL MI of them are willing to write up a contract and meetings have been set to
discuss their services in detail. Following is a brief comment on our conversations with them.
Eldon Security 254 Havana Street Aurora,CO (303)343-3144 CONTACT: JAMIE
Jamie stated that they are prepared to provide both armed and unarmed security. He stated that you need 1
guard per 150 people. They are prepared to check for alcohol, traffic control(before and after event) and
patrol area throughout event His administrative staff is to call us about fees and contract direction.
E&H Professional Security 923 W.80th Avenue Westminster,CO CONTACT: Corporal Rice
They are prepared with armed and unarmed security. Corporal Rice stated that they have experience in
crowd and traffic controL They have provided security for events such as Claw de Mayo in Denver and
Teen Week. We need to meet with them to discuss post orders so that their security will know their duties,
get familiar with the facility,and discuss fees and contract.
J&J Escort 2751 Oxford Avenue Englewood,CO (303) 806-5339 CONTACT:Jim Swaen
Jim is actually a Weld County Sheriff Reserve Officer. He too stated that we needed 1 security per 100-150
people. They can provide armed and unarmed security personnel and is familiar with the South Weld
County area and says he really likes the people around here. He was on duty working an event in Windsor
when we spoke to him. We are to meet with Jim also to discuss fees and contract.
E. Lighting Plan: We have met with Commander Bauer,Weld County Sherriff's Department in
regards to the traffic control plan and addressed the lighting plan. Since these events are planned during
the daytime hours(10:00 a.m.to 6:00 p.m.and mostly during the Spring,Summer,and early Fall,we feel
that lighting is really not an issue. If there are any events during the Winter(this is only weather permitting
and not often)lighting is not necessary as events shall be done with by 6:00 P.M. We are prepared to cease
events during the winter,if any,no later than 5:00 p.m. as daylight ends by then during this season. We are
also prepared to not host any events during the Winter months.

F. Liability Insurance: We have an "umbrella policy"which covers our autos,home,land,and
boarding and training business through State Farm Insurance. Our agent is Dennis Logan(303)989-0707.
We have contacted him and he has informed us that there really is nothing to insure during these events. We
have signs and notices posted of Colorado Statute that pertains to participation in Equine Activity. Please
see attached copy of sign posted in an event area,in Weld County,that is properly stated and legal. This too
has been discussed with Commander Bauer.
"Sources of Light" please refer to lighting plan,item E. We feel that this is no longer an issue.

Staff recommends that the following conditions of Approval and Development standards be
added based on the referral from the Weld County Sheriffs Office received August 12, 2004:
The following conditions of approval shall be added to page 4 of the staff recommendation
(Prior to scheduling the Board of County Commissioners Hearing):
C The applicants shall submit a traffic control plan to the Weld County Sheriff's Office,
Department of Planning Services and Department of Public Works, (Department of

D. The applicants shall submit a plan detailing how security will be provided at the
proposed horse racing events(who will be providing security,numbers of security
peraonneL..) To the Weld County Sheriff's Office and Department of Planning Swipes.

create a traffic hazard to operators of motor vehicles on public or private streets;and no

RE: Portable Restrooms
USR-7483
Dear Chris,
At the hearing on August 17th when sanitary issues were discussed we gathered from the board members that
portable restrooms were a favorable option. We strongly feel that this would be the way to go since Commander
Bauer of the Sheriffs department also felt that these would be better since they could be better distributed
throughout the event area rather than have people gather all around one designated area for sanitary facilities.
As you can see on the plan we are submitting to you, these portable restrooms would be distributed throughout the
event area for better access to spectators. We are prepared to provide additional portable restrooms if needed and
dictated for sanitary reasons and/or compliance.
Please see attached letter from United Site Services. We have used them throughout the events and have been very
satisfied with their services. We've had nothing but favorable comments in regards to the portable restrooms being
clean at every event.

To Whom It May Concern:
Martin Gutierrez from the race track has ordered portable restrooms from our company for the last
couple of years for his events. There is also one that is left on a permanent basis that is cleaned and
pumped out each week. Because this is all done for charity,United Site Services is giving a
discounted price to Martin.
Our recommendation is 1 portable restroom for each 100 people for a one day event. Martin actually
leaves the units on site for the season and we service them on a weekly basis.They are serviced by
Friday just prior to the event for that weekend,so that they will be clean and sanitary for the public
use. The units are placed strategically through out the complex to accommodate the needs of the
public.

In complying with additional conditions set forth by the Weld County Planning Department (Mr.

see there are various signs which will be posted strategically throughout WCR 31 the day of
the events only. All signs are in English as well as Spanish. They are numbered 1, 2, & 3 and
are for the following;
1. Notice: no parking in public roads or in neighbors'driveways during events
2. No Parking: parking prohibited in this area during events
3. Notice: reduction of speed during events
Signs numbers 4 and 5 are to be posted inside event area.

porposed horse racing events (who will be providing security, numbers of security
personnel...) to the Weld County Sheriff's Office and Department of Planning Services:
We contacted three security companies. Eldon Security, Aurora, Colorado,; E&H
Professional Security, Westminster, Colorado,; and J&J Escort& Security, Inc, Englewood,
Colorado. All three secuirty companies provided armed and unarmed security personnel. All
three had vast experience in crowd control as well as traffic control All three are equipped
with marked and unmarked vehicles with radio, sirens, etc. We opted to choose J&J Escort
and Security, Inc. because of their plan of having security at the entry gate at all times,
searching for alcohol, and patrolling the area during the events, and mostly because of their
familiarity with the Weld County area.

E. the applicants shall submit a lighting plan to the Weld County Sheriff's Office

We met with Commander Bauer from you department We discussed the traffic control
plan and also lighting issues. We explained to Commander Bauer that we felt that lighting is
actually is not an issue. The proposed events are to be held during daytime hours only. The
proposed times for these events are from 10:00 a.m. to 6:00 p.m. during the early Spring,
Summer, and early Fall seasons. During the linter season events are only weather
permitting and will end by 5:00 p.m.. We are prepared to not have any events during the
Winter as well
F. evidence of liability insurance that will cover horse racing events held on the
property shall be submitted to the Weld County Sheriff's Office and Department of
Planning Services:

His office tells us that there is really nothing to insure. We ask that you refer to Section 13-
21-119, Colorado Revised Statutes which reads: WARNING: Under Colorado Law, an
equine professional is not liable for an iniury to or the death of a participant in equine
activities resulting from the inherent risks of equine activities. Several of these signs are
already posted throughout our entire property. Because we are not applying for a
"commercial permit" we feel that posting other signs such as numbers 4& 5 shown in the
traffic control plan which state that participation is at own risk and that there is no alcohol
allowed liability insurance should not be an issue. Also,please see copy of sign attached that
is currently posted at another event area in Weld County.

We feel that this item{ above eliminates itself since we have already indicated that
lighting will not be necessari due to the fact that all proposed events will occur during daytime
hours.

a Recreational Facility, including race tracks and race courses(horse racing),in the A(Agricultural)
Zone District has been recommended unfavorably to the Board of County Commissioners by the
Planning Commission. The legal description of the property involved is shown as part of Lots A
and B of Recorded Exemption #3375; being part of the E1/2 of Section 28, Township 2 North,
Range 66 West of the 6th P.M., Weld County, Colorado.
If you wish to be heard by the Board of County Commissioners, it will be necessary for you to

Please accept this letter as an expression of my extreme opposition to the request for a special
use permit
#1483 for the purpose of a racetrack and facilities above mineral interests that I own related to
this hearing.
Weld county has already closed in one well within 150 feet of the requested location for safety
reasons, the requested location also has oil storage facilities located extremely close to the area
proposed to be used for parking and spectators.
During the planning board hearing which I attended it was clear that the current surface owner
has no idea that the safety of participants,spectators and residents is a concern, he specifically
stated "he had no control over the attendees of his illegal horse racing activities. He also denied
the need for hygeinic facilities to insure the health of attendees. Incidentally one participant has
already been killed as part of this illegal activity, there was a question of whether or not adequate
staffing of health professionals might have prevented that death.There is a clear pattern of
irresponsibility and negligence associated with this illegal operation and its hosts.
Lastly is my concern for the safety and rights of the local residents , the Sheffifs Department has
already stated in the previous hearing that they do not supportthis request and in fact stated that
they felt that he permit would place residents and attendees at additional risk of harm.
Please do not permit this activity to be perpetrated against the community or expose the
proposed attendees to such dangers.
The taxes that I have Weld County over the past 40 years and will continue to pay should not be
used to support illegal and irresponsible activities indirectly such as this activity. The Sherriff, the
ambulances, the road maintenance, the Health Department, the hospitalization, the Fire
Department and all of the ancillary costs related to this activity should not be permitted in our
county.

Dear Mr. Masden:
Our letter to you today is to address the issues that were brought up at our first Planning Commission hearing on
August 17,2004 in regards to our application for a site specific permit labeled USR-1483.
At that first hearing,tempers were flaring, people were irate to the degree that the chairman of the planning
commission warned a citizen twice to refrain from shouting and being beligerant or leave the hearing. We did not
address their issues solely because of these reasons. We did not see any benefit to this. It is through this letter to
you that we wish to address those issues.
Sherriffs Deputy testifies
The sherriffs deputy that testified in regards to the complaints was given the opportunity to testify before anyone
so that he could leave and resume his duties. We did not have the opportunity to clarify that those complaints were
due to the fact that we were given direction by the sherriffs department to close the gates since we had no permit.
Mr. John M. Farrell-his e-mail sent to you November 22,2004
Since we purchased this property, no well has been closed as Mr. Farrell stated. If there is a closed well, it is due
to lack of operation. In fact,an additional gas well has been opened since we have been here. Encana Inc. and
Merrit Corporation are the management comapnies for the wells on this site. We are sure that Mr. Farrell has
signed a contract as we have to give these companies management control of such wells. Due to this particular
permitting process,both companies have written letters to the Weld County Planning Services department and
those letters are part of the original packet where they state there is no danger or problem with the wells at the
mentioned site. These wells are surrounded by pipe fencing individually for protection and the event area is quite a
distance from these wells. Incoming vehicles do pass through these wells,however,parking and the actual racing
is very far from them.
Mr. Farrell is rather confused or did not listen very well. It was stated at the first hearing that there are signs
posted throughout the event area of Colorado Law, section 13-21-119 Colorado Revised Statutes that states that an
equine professional is not liable for an injury to or the death of a participant in equine activities. Mr. Gutierrez
never stated that his activity was ilegal. There is nothing ilegal. Mr. Farrell further states that the owner has no
concern for the safety and health of spectators or attendees. As for safety,every precaution has been taken.
Beginning with not allowing any alcohol beverages in the event area,there have always been parking attendants to
properly park cars and allowing exiting at all times. There have always been sanitary facilities(port-a-jons)
throughout the event area. There is bottled water available at all times. Entire families attend these activities
including children. We find it very hard to believe that any parent would subject their children to unsafe
conditions or dangerous activities. If anyone fears for their health and well-being it is us. We have received a

threatening letter(report filed with Weld County Sherriffs Department). This letter was left in our mailbox
suggesting that we not continue with this permit or we would be sorry. According to the Sherriff that filed the
report, there was no criminal activity because they did not specify what we would be sorry for. He further stated
that citizens of Aristocrat Acres were upset and this was their way of venting. Although empathatic to these
citizens,we feel that this was a legitimate threat and definitely unnecessary. Sorry could mean ourselves,our
home,our horses. Wasn't the entire nation put on guard after 9-11 and after anthrax made it's way through some
pretty important people?. To the citizens of Aristocrat Acres their concerns are real and can be addressed and
resolved. We're not too sure about our concerns.
Obviously,Mr. Farrell has never been in the event area. Unfortunately,he was not there the day a rider was
kicked by one of the horses and eventually lost his life because of that. Had he been there, he would have
witnessed how the rider hit the horse on his behind to help him get in the gate. You see riders hit horses all the
time when they do not want to get in the gates. When this rider hit that horse,the horse reacted and kicked back.
Riders in this activity are usually short in height and light in weight. When the horse kicked,it hit the rider in the
chest,knocking to the ground. Had Mr. Farrell been there,he would have further witnessed that Mr. Gutierrez ,
certified in CPR and First Aid kept him alive and stable for transport to the nearest first aid facilitiy which was the
Ft.Lupton Fire Department. This gentleman did not die at the event area. This gentleman died in an ambulance
on the way to the hospital. Futhermore,Mr. Farrell would have witnessed that although there were several other
races scheduled,owners,spectators,and hosts of the charity that day(Ricardo Falcon Center)opted to cancel any
further activity in support of this gentleman's fate with horses that he so much loved. Ricardo Falcon Center in
fact donated some of the proceeds that they had raised that day to help with the gentleman's funeral costs.
We have always kept safety and rights of local residents at heart. We too are residents of the same community and
have the same rights. The concerns that Mr. Farrell addresses are those that occured when the access gates to the
event area were closed at the direction of the Weld County Sherrriffs Department. Prior to this incident, there had
never been any negative incidents or complaints. As for his taxes,well who doesn't pay them. We are currently in
a bracket that hits us hard with taxes. We respect the Sherriffs department,ambulance services, road
maintenance, health department, hospitalizations,fire department and the costs that come with their services.
There is a possitive side to utilizing these tax dollars. The tax dollars that are generated through the purchase of
goods such as fast food, restaurants,gas stations and miscellaneous items purchased by spectators while in the Fort
Lupton area once a week have been mentioned by local merchants as a possitive source of income for all involved

Prior to this date, events had been been hosted without any violations or problems. At one particular event there
were more spectators than usual. The Weld County Sherriffs department visited the site and notified us that we
could not have more than 350 vehicles without a proper permit. In trying to comply with the Sherriffs direction,
gates were closed once we reached 350 vehicles at the next event. Participants who were on their way,found gates
closed;however they could see events going on inside. This caused the parking along road 31 and into Aristocrat
Acres. With the traffic control plan submitted,we feel that this will no longer occur. Gates will be opened for
access and egress for continous flow.
Road 31 is not the only access road to Aristocrat Acres There are six access roads to Aristocrat Acres along road
16 and across to road 18 giving road 18 the same six access roads to Aristocrat Acres. At the last hearing, during
a break we heard a citizen say that road 31 belonged to Aristocrat Acres. We thought,road 31 belongs to anyone
who wishes to travel it. Our address is on road 31,therefore, it is the only access road to our property. Citizens of
Aristocrat Acres at least have six other roads to access their homes. Ms. Gonzales was very irate and upset about
the urination in public that her daughter unfortunately had to witness and rightfully so.. We all know that is

against the law and should have not been tolerated. In the least minimal defense to the person that did this,we
truly believe that this person was aware that there were sanitary facilities inside the event area. However,due to
the gates being closed that person could not access the facilities. Perhaps a drive back into Fort Lupton could have
prevented this. We do not know who that person is or why he chose to be so despicable.
Dust problem to a citizen on oxygen
The citizen who complained about the dust during this particular event. Again,the gates were closed under
sherriffs direction. There are no paved roads in Aristocrat Acres. We acknowledge that dust can be an issue to
this particular citizen without the additional vehicles passing through these unpaved roads and making more dust.
We are confident that the traffic control plan and the gates opened during events will aleviate this problem. With
the traffic control designed as submitted to the planning services department, spectators should have no reason to
deviate off of road 31. Road 31 is paved and planning staff stated that road 31 could easily handle 1,000 vechicles
on a daily basis. There is hardly any traffic on road 31. This additional traffic on road 31 would be once a week
and technically seasonal.
Citizen that stated that in Mexico there are guns and alcohol
This citizen stated that he has been in the events and that in Mexico people carry weapons,drink, and have fights
all the time. How convenient that he chooses our events to point out the ilegal activities in his country. We're sure
that he abides by all the laws that govern these United States. We are supporting a Mexican tradition that is part of
the Mexican culture when and if we follow the laws in this country. Why does our country and our state support
events such as"Cinco de Mayo, Juneteenth Week, Saint Patrick's Day,etc., "? Because we are a country of
cultures. In this great country we all pay taxes,being income, sales,fines, etc., only as one culture. This is why
this country allows us the many rights as individuals that no other country allows. I must remind this ciziten that
although we are very proud to have Mexican descendence,we are not in Mexico.
Citizen concerned about fire
This particular citizen stated that she feared that a fire break out and with so many people..what would happen?
If you look around Aristocrat Acres there is trash,weeds,junk,actual junk yards,dead and dry tree limbs in stack
piles over at least 5ft. tall. Dry weeds easily reach 4 to 5 ft. It is no secret that all these factors are exactly what
may cause a fire to burn out of control. We strive hard to maintain our property up to coele Mrs. Gutierrez works
closely with code enforcement in another jurisdiction and this particular jurisdiction would be raking in the money
with fines from so many violations. We are in no way critizising the citizens of Aristocrat Acres. We strongly
believe that one takes pride in his own property. Point being that if a fire were to break out,we feel that it would
be more feasable for it to break out in Aristocrat Acres than at the event area. There is nothing to catch fire in the
event area.
Lastly,the citizens at the hearing stated that they were speaking on behalf of the citizens of Aristocrat Acres. We
can assure you that they were not. Aristocrat Acres are primarilly 1, 2,and 5 acre lots. These are also"horse
properties". There are citizens in Aristocrat Acres that own horses and in fact have participated in our events both
as horse owners and spectators. There are countless citizens in that community that own horses,goats,pigs, cows,
chickens,and sheep. We are animal lovers as well. This is why we purchased this particular property. We could
have our animals;in this race horses.
That we want to conitnue our pursuit for this site specific permit is a show of commitment to our culture and a
stronger commitment to help others, We have made every effort to comply with what is dictated in your drafted
resolution and are confident that this permit will not cause harm,unsafe conditions to participants as well as
citizens of this community and be a burden to our county and those given the responsibility to protect it. We
respectfully ask that you at least give us the opportunity to show you that this can work.
We respectfully request that you approve our petition for this particular permit.
