COLORADO SUBJECT: AmUSR-1405, Aurora Dairy Corporation
The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways.
Please contact Gloria Hice-Idler at the Greeley office to verify the access permit or for any additional
requirements that may be needed to obtain or upgrade the permit. The access is from State Highway 66.
Our most current average daily traffic count (ADT) reflects 5,200 vehicles taken in a 24-hour period in 1995 on
State Highway 66 at this location.
.EQUIREMENTS:
Storm Water Drainage: The storm water drainage will be handled by two retention ponds and two settling
ponds located at the south end of the feeding facility. The retention ponds will be maintained and operated in
accordance with the Colorado Confined Animal Feeding Patrolled Regulation. I am referring the storm water
drainage and the complaint to the Department of Health and Environment, which has jurisdiction over any use
by special review that would deal with animal units.
Circulation: All feed alleys shall be surfaced with gravel and shall be graded to prevent drainage problems.
There is adequate parking and circulation throughout the milking parlor and office building.
Right-of-Way: The applicant shall indicate on the plat drawing the existing and/or future right-of-way for State
Highway 66.
I have researched the section line between Sections 29 and 30, T3N, R67W. The County is not identifying any
County rights-of-way between these parcels at this location.

The Weld County Department of Public Health and Environment has reviewed this application.
We recommend for approval of the proposed dairy and milk processing plant with the following
recommended development standards:
1) The facility shall operate in compliance with Colorado Water Quality Control
Commission(WQCC) Regulation#81. The applicant shall provide the following
information to the Weld County Department of Public Health& Environment:
a) Documentation,prepared by a Colorado Registered Professional Engineer, that
all wastewater impoundments for the confined animal feeding operation meet
seepage rate standards 30 days prior to use of the impoundment [reference
WQCC Regulation 81.5 (2)(b)].
b) Evidence that a Standard Operating Procedure for sludge and manure removal
(cleaning of impoundments to maintain capacity)has been submitted for
approval to the Colorado Water Quality Control Division, within 120 days of
placing animals in production area [reference WQCC Regulation 81.5 (3)(b)].
c) A site plan and site layout,which demonstrates impoundments meet required
setbacks to water wells and groundwater [reference WQCC 81.5 (6)].
2) The facility shall operate in compliance with Colorado Water Quality Control
Commissions (WQCC) Regulation#61. The applicant shall provide the following to
the Weld County Dept. of Public Health& Environment:
a) Evidence that a Confined Animal Feeding Operation(CAFO) Colorado
Discharge Permit application has been submitted for approval to the Colorado
Water Quality Control Division, 180 days prior to placing animals on the
operation [reference WQCC Regulation 61.17(5)(b)(iii)].
3) There shall be no discharge of manure or process wastewater into surface water from
the production area, except as provided in the facilities CAFO Colorado Discharge
Permit.
4) The facility shall operate in compliance with applicable Colorado Air Quality Control
Regulations, which include but are not limited to the following: No open burning
except"agricultural open burning" as defined by Reg. 9. Boiler operations shall
comply with the construction permit issued by the Air Pollution Control Division.
5) There shall be no permanent disposal of solid wastes,as defined in the Regulations
Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2), at this site.
6) All process wastewater and industrial wastewater from the proposed dairy barn and
milk processing plant(not meant to include stormwater), shall be discharged to the
St. Vrain Sanitation District. The facility shall comply with all pre-treatment
requirements and their industrial wastewater discharge permit.
7) With exception of the existing septic system serving the residence on the property, all
sewage shall be disposed of through the sanitary sewer to the St. Vrain Sanitation
District. The existing septic system located on the property must comply with all
provisions of the Weld County Individual Sewage Disposal System Regulations.
Should the septic system serving the existing home require replacement, the
residence shall connect to the St. Vrain Sanitation District.
8) The facility shall be operated and maintained in a manner to prevent nuisance
conditions.
9) The facility shall control fugitive dust on this site and operate in accordance with the
approved dust abatement plan,dated July 11,2004.
10) The facility shall be operated in a manner to control pests. The facility shall be
operated in accordance, at all times, with the approved pest control plan, dated July
11, 2004. Additional control measures shall be implemented at the request of the
Weld County Department of Public Health and Environment in the event that rodents
(which can be determined to be associated with the facility) are in such a number to
be considered a nuisance condition.
11) The facility shall be operated in a manner to control flies. The facility shall be
operated in accordance, at all times, with the approved fly control plan,dated July 11,
2004. Additional fly control measures shall be implemented at the request of the
Weld County Department of Public Health and Environment in the event that flies
(which can be determined to be associated with the facility) are in such a number to
be considered a nuisance condition. The plan shall also be implemented in the event
the Weld County Department of Public Health and Environment receives a
significant number of fly(associated with facility) complaints, and in the judgment of
the Weld County Health Officer,there exists a fly condition requiring abatement.

12) The facility shall be operated in accordance with the approved odor abatement plan,
dated July 11, 2004. Odors detected off site shall not equal or exceed the level of
fifteen-to-one dilution threshold, as measured pursuant to Regulation 2 of the
Colorado Air Pollution Control Regulations. Additional controls shall be
implemented at the request of the Weld County Department of Public Health and
Environment in the event odor levels detected off site of the facility meet or exceed
the level of fifteen-to-one dilution threshold, or in the judgment of the Weld County
Health Officer,there exists an odor condition requiring abatement.
13) The applicant shall remove, handle, and stockpile manure from the livestock area in a
manner that will prevent nuisance conditions. The manure piles shall not be allowed
to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests,
or pollutant runoff. The surface beneath the manure storage areas shall be of
materials which are protective of State waters. These areas shall be constructed to
minimize seepage or percolation of manure contaminated water. In no event shall the
facility impact or degrade waters of the State in violation of Colorado Water Quality
Control Commission Regulation Number 81.
14) The facility shall adhere to the maximum permissible noise levels allowed in the
Light Industrial Zone as delineated in Section 25-12-103 C.R.S, as amended.
15) Waste materials, not specifically addressed by other development standards, shall be
handled, stored, and disposed in a manner that controls fugitive dust,blowing debris,
and other potential nuisance conditions.

Site Specific Development Plan and Special Review Permit for a 28,803 square Milk Processing Facility with a
future expansion of 19,0000 square feet along with a Livestock Confinement Operation (1700 milking dairy) in
the A (agricultural zone district).
1. A building permit shall be obtained prior to the construction of any new building, addition or remodel of the
existing building. Existing building permits BCS-040176 and BCS-030560 are required to receive final inspections
and certificate of occupancy.
A plan review is required for each building for which a building permit is required. Plans shall include a floor
in. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans
are required when applying for each permit. Provide a Code Analysis Data sheet provided by the Weld County
Building Department with each Building permit application.
3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application.
Currently the following has been adopted by Weld County: 2003 International Building Code; 2003 International
Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; and the 2002 National
Electrical Code and Chapter 29 of the Weld County Code.
4. The new construction will be classified as U (21,000 square foot Milking Parlor) and 19,000 square foot
Addition to the existing B,F-1,S-1 (Milk Processing Facility) Fire resistance of walls and openings, construction
requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and
offset distances shall be determined by the Zoning Ordinance.
5. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of
determining the maximum building size and height for various uses and types of construction and to determine
compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be
measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset
and setback requirements. Offset and setback requirements are measured to the farthest projection from the
building.

Special Review for the Aurora Diary Corporation, located at 6828 Highway 66 in Weld County
(Case Number: AmUSR-1405). The Fire District does not object to the operation and expansion
provided the requirements of the District can be met. All applicable codes as they pertain to
water supply for fire protection, fire hydrant locations and fire department access must be met.
Building construction plans for any new buildings or additions to existing buildings must be
submitted to the Fire District for review and approval before building permits may be issued.
