RESOLUTION
RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT #313 - EARL
ANDERSON
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,by Resolution dated September 22, 1976,the Board approved Use by Special
Review Permit#313 for a Greyhound Training Track for Earl Anderson on the following described
real estate, to-wit:
Part of the NW 1/4 of Section 13, Township 6 North,
Range 65 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from Earl Anderson, 23070 Weld County
Road 70, Eaton, Colorado 80615, to vacate said Use by Special Review Permit#313, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present,studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said vacation.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit#313 be, and hereby is, vacated.
The above and foregoing Resolution was,on motion duly made and seconded,adopted by
the following vote on the 2nd day of May, A.D., 2005.

SUBJECT: Vacation of SUP-313
The Department of Planning Services has received the attached letter from Earl
Anderson. Mr. Anderson is requesting that SUP-313 for a Greyhound training track be
vacated as a requirement of Recorded Exemptions RE-4030.
Background information:
Legal Description: Part of NW4 of Section 13, T6N, R65W of the 6th P.M., Weld
County, CO.
Location: South of and adjacent to CR 70 and approximately 1/8 mile east of
CR 47
SUP-313: SUP-313 was approved by the BOCC on September 20, 1976, for
Special Use Permit for a Greyhound training track in the A
(Agricultural) Zone District.

According to the requirements regarding Recorded Exemption No. 0803-13-2 RE-4030
paragraph 3, Item C, I am requesting that SUP-313 for greyhound kennel and training
facility be vacated from the property.
In addition to paragraph 3, Item H, I disagree with the city of Greeley's Planning staff of
their not recommending the approval of the Recorded Exemption. The reason for my
disagreement is that this parcel is located approximately 8 miles north east of the city
limits of Greeley and should have no effect on any of the city of Greeley's future
development.
Therefore I am requesting that this item be deleted from the requirements.
