HomeMy WebLinkAbout20052475.tiff HEARING CERTIFICATION DOCKET NO. 2005-60 RE: SITE SPECIFIC DEVELOPMENT PLAN AND MINOR SUBDIVISION FINAL PLAN, MF #1056, FOR FOUR (4) RESIDENTIAL LOTS, PHEASANT MEADOW- FRANCISCO GRANADOS A public hearing was conducted on August 17, 2005, at 10:00 a.m., with the following present: Commissioner William H. Jerke, Chair Commissioner M. J. Geile, Pro-Tern Commissioner David E. Long Commissioner Robert D. Masden Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Sheri Lockman Health Department representative, Pam Smith Public Works representative, Donald Carroll The following business was transacted: I hereby certify that pursuant to a notice dated July 29,2005,and duly published August 3,2005, in the Fort Lupton Press, a public hearing was conducted to consider the request of Francisco Granados fora Site Specific Development Plan and Minor Subdivision Final Plan,MF#1056,for four (4)residential lots-Pheasant Meadow Subdivision. Lee Morrison,Assistant County Attorney,made this a matter of record. Sheri Lockman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. She stated 13 referral agencies reviewed this proposal, and ten responded favorably or provided comments that have been addressed in the Conditions of Approval. She further stated the applicant has submitted a Road Maintenance Agreement,therefore,Condition of Approval #1.6 should be deleted, and she displayed photographs of the site and surrounding properties. Pam Smith, Department of Public Health and Environment, stated the minimum lot size will be 11.84 acres,and the percolation rates indicate shallow ground water levels,which may require engineered septic systems. She stated the large lot sizes should allow adequate options for locating the septic and leach fields,and she is recommending the applicant place a note on the plat notifying future residents of the confined animal feeding operation facility which is located within close proximity. Donald Carroll, Department of Public Works, stated the development will be accessed from Weld County Road 60.5, which is a base stabilized road, with an average daily traffic count of approximately 400 vehicles. He stated initially the internal road will be surfaced with gravel; however,the Improvements Agreement requires the applicant to escrow funds from the sale of each lot for potential future paving. He stated if the road is not paved within the next five years,the money will be returned. In response to Chair Jerke, Mr. Carroll stated the agreement only addresses 2005-2475 PL1757 00 6'w, /ft q�a� os- HEARING CERTIFICATION - FRANCISCO GRANADOS (MF #1056) PAGE 2 asphalt paving. ChairJerke commented Highway 37 is scheduled for chip seal upgrades this year, and Mr. Carroll stated the agreement can be modified to be consistent with that project. He further stated the Improvements Agreement will need to be reviewed and approved by the Board prior to recording the plat. Clayton Harrison, Pickett Engineering, Inc., represented the applicant and responded to Commissioner Geile by stating there are no specific architectural plans for the homes; however, placing basement foundations would be difficult due to the shallow groundwater. He stated the Covenants are in place, the stick-built homes will have a minimum footprint of 1,600 square feet, and the larger lots allow for more square footage, if desired. No public testimony was offered concerning this matter. In response to Chair Jerke, Mr. Harrison stated he and the applicant have reviewed and concur with the Conditions of Approval as proposed and modified. Commissioner Long moved to approve the request of Francisco Granados for a Site Specific Development Plan and Minor Subdivision Final Plan, MF #1056, for four (4) residential lots - Pheasant Meadow Subdivision, based on the recommendations of the Planning staff and the Planning Commission,with the Conditions of Approval as entered into the record. His motion also included the deletion of Condition of Approval #1.6 and to reletter subsequent paragraphs accordingly. The motion was seconded by Commissioner Masden, and it carried unanimously. There being no further discussion, the hearing was completed at 2:15 p.m. This Certification was approved on the 22nd day of August 2005.
