Weld County Planning Department State Engineer 918 101h Street RECEIVED Greeley, Co 80631 Re: Gold Stone Creek Minor Subdivision Case No. MZ-1081 N1/2 of the NW1/4 of Sec. 16,T8N, R66W, 6th P.M Water Division 1,Water District 1 Dear Mr. Gathman: We have reviewed additional information submitted to this office on September 12, 2005 on the above referenced proposal to subdivide a 74.11-acre parcel into 9 single-family residential lots ranging in size from 3.9 acres to 11.5 acres. The North Weld County Water District('District") is still identified as the water provider for the subdivision. Our previous letter dated July 28, 2005 indicated that we were unable to provide comments due to the fact that insufficient information was provided. Therefore, this additional information included a letter of commitment from the District dated August 27, 2004. The letter of commitment indicates that a total of 9 lots in the development are to be served by the District. The developer will be responsible for the extension of the water line to the subdivision from an existing waterline. In addition, the District can only supply 250 gallons per minute of fire flows from the existing line. Therefore, the District requests that the development dedicate and convey a tract of land to the District. This tract will serve as a future location for pumping facilities that could provide additional fire flows to the development and the surrounding areas. A copy of a draft Water Service Agreement ("Agreement")was also included. According to the information from the Agreement, the District will furnish 70% of an acre-foot (228,000 gallons)of water per tap per annual water year if the allotment for the Colorado-Big Thompson (CBT) project water, as determined by the Northern Colorado Water Conservancy District, is 50% or greater. The District will restrict the delivery as necessary when the CBT allotment is less than 50%. Based upon recent updated information (dated September 29, 2005) provided to this office by the District, the District currently has an adequate uncommitted water supply to provide the water associated with this project. Regarding the existing well permit no. 254251 that presently encumbers 40 acres of the 74.11- acre parcel proposed to be subdivided, the applicant was required to provide information if well permit no. 254251 (if constructed)will be used to supply water to any of the lots in the subdivision. Pursuant to a telephone message from Tom Honn to this office on October 3, 2005, permit no. 254251 has not been constructed and is not proposed to be constructed. The permit is not proposed to be used to supply any lots in this subdivision. Based upon this additional information and pursuant to Section 30-28-136(1)(h)(II), C.R.S., the State Engineer's office offers the opinion, that contingent upon water service being provided by the District, the proposed water supply will not cause material injury to existing water rights and the supply is expected to be adequate provided the well permit no. 254251 will not to be used for any lots in the subdivision. We recommend that the County obtain a signed copy of the Water Service Agreement from the District prior to the final approval of the subdivision. Thanks Tom EXHIBIT MEMORANDUM TO: Chris Gathman, Planner FROM: Tom Honn, AICP DATE: November 4, 2005 SUBJECT: Gold Stone Creek Minor Subdivision I have provided you with the revised Change of Zone Plat that removes all subdivision plat references for the Change of Zone submittal. I have included a revised plat, which we believe successfully addresses the concerns raised by the Planning Commission during their hearing. Although not required for the Change of Zone hearing, I agree with you that it is important to have the Board be familiar with the proposed changes that will be submitted with the final plat part of the process. The concern raised by the Planning Commission was the lack of access to two of the lots, which were east of the flood plain. The revision takes that into consideration and provides for all lots west of the flood plain and creates a common open space tract that the future homeowners can chose to use as a pasture, riding area or lease to adjacent property owners. We also believe this design has created design improvements with the plat and establishes uniformity with the lot sizes and continues to provide adequate lot areas for those looking for a rural lifestyle. We can provide a building setback buffer from the north property line to help the neighbor feel more comfortable with adjacent development activity.
