RESOLUTION
RE: APPROVAL OF CONDITIONAL USE PERMIT NO. 56: 80 :4 FOR A VHF
RADIO TOWER SITE ON A TRACT OF LAND DESCRIBED AS LOT 2 ,
MINOR SUBDIVISION, WELD COUNTY, COLORADO - UNION PACIFIC
RAILROAD COMPANY.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado held a public meeting on the 14th day of May, 1980 at
the hour of 9 : 00 o' clock a.m. for the purpose of hearing the
application of the Union Pacific Railroad Company for the grant-
ing of a Conditional Use Permit for a VHF radio tower site on
the following described real estate, to-wit:
A parcel of land situate in Lot 2 of the
Minor Subdivision No. 4 in the Northwest
Quarter of Section 6, Township 4 North,
Range 64 West of the Sixth Principal
Meridian in Weld County, Colorado, more
particularly described as follows :
Commencing at the Southwest Corner of
said Lot 2, which is coincident with the
West Quarter Corner of said Section 6;
Thence North 00°00 ' 00" East along the
West line of said Lot 2, a distance of
869. 88 feet; to the Northwest Corner of
that certain parcel land conveyed by Earl
Platt and Maude Platt to Central Weld
County Water District by deed dated Sept-
ember 22, 1966, recorded October 3, 1966 ,
Reception No. 1495631 in Book 574 in the
Weld County records , and the True Point
of Beginning;
Thence North 90°00 ' 00" East along the
North line of said deeded parcel of land
and the extension thereof, a distance of
290. 0 feet;
Thence North 00°00 ' 00" East, a distance
of 200. 0 feet;
Thence North 90°00 ' 00" West, a distance
of 290. 0 feet to a point in said West line
of, Lot 2;
Thence South 00°00 ' 00" East along said West
line, a distance of 200. 0 feet to the True
Point of Beginning and containing an area
of 1. 33 acres, more or less.
WHEREAS, the petitioner was present, and
WHEREAS, evidence was presented in support of approval of
the Conditional Use Permit for a VHF radio tower site, and

WHEREAS, Section 3. 3.D. of the Weld County Zoning Resolu-
tion authorizes such a use in an Agricultural District upon ap-
proval of a Conditional Use Permit by the Board of County Com-
missioners, and
WHEREAS, the Board of County Commissioners of Weld County,
Coloradd., heard all of the testimony and statements of those
present, has studied the request of the petitioner and the re-•
commendations of the Weld County Planning Commission and all of
the exhibits and evidence presented in this matter, and having
been fully informed, is satisfied that the request for a Con-
ditional Use Permit for a VHF radio tower site on the herein-
above described real estate complies with all of the conditions
as set forth in Section 3. 3.D. (2) of the Weld County Zoning
Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the application of the
Union Pacific Railroad Company for a Conditional Use Permit for
a VHF radio tower site on the hereinabove described tract of
land be, and hereby is, granted subject to the development stan-
dards contained in the Conditional Use Permit.
BE IT FURTHER RESOLVED by the Board of County Commissioners
of Weld County, Colorado that the reasons for approval contained
in the Weld County Planning Commission recommendations dated
May 6, 1980 be, and hereby are, adopted as the findings of fact
of the Board of County Commissioners in this matter.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 14th day of
May, A.D. , 1980.

imously with Bette Kountz, Fred Otis, Bob Halleran, Don Billings
and Bob Ehrlich voting for and none against.

iCAPPEARANCE: Mike Ahern, Assistant Director of Communications for the Union
Pacific Railroad asked that this request be accepted so they
' can install a VHF Radio Station at the above location to give
them track side coverage between La Salle and Fort Morgan.
There will be fence around this compound. The applicants legal
department has read the Planning Service's Staff recommendations,
and Development Standards and they have taken no acception to
these recommendations.

MOTION: Bob Ehrlich moved this request be accepted by reference along with
the Planning Department Staff's recommendations and Development
Standards and forwarded to the Board of County Commissioners with
the Planning Commissions' recommendation for approval. Motion
seconded by Bette Kountz. Motion carried unanimously with Bette
Kountz, Fred Otis, Bob Halleran, Don Billings and Bob Ehrlich
voting for and none against.

The Planning Commission's recommendation for approval is conditional upon the

VHF RADIO TOWER SITE
1. The permitted uses on the hereon described parcel shall be a site for
a microwave tower not to exceed 200 feet in height and all uses permitted
by right in the Agricultural Zone District enumerated in the Weld County
Zoning Resolution.
2. Installation of the tower shall conform to Federal Aviation Administra7.
tion standards and/or regulations regarding air safety and lighting and
and any other applicable rules and regulations of governmental bodies
having jurisdiction on the premises.
3. The Conditional Use Permit area shall be maintained in such a manner so
as to prevent soil erosion, fugitive dust, and the growth of noxious
weeds.
4. All phases of the operation shall comply with all County and State
Health Standards and Regulations pertaining to air quality, water
quality, noise emission, and sanitary disposal systems.
5. All construction, electrical work and fabrication shall be done in ac-
cordance with the Weld County Building Code.
6. The appearance of the facility shall be maintanined in a neat and
orderly condition through periodic painting and maintenance.
7. All accesses shall have the approval of the Weld County Engineering
Department. All accesses shall be constructed in accordance with the
recommendations and/or requirements of the Weld County Engineering
Department.
8. The Conditional Use Permit shall be limited to the plans shown hereon
and governed by the Development Standards stated above and all applic-
able Weld County Regulations. Any material deviations from the plans
and/or Development Standards as shown or stated above shall require
the approval of an amendment to the Conditional Use Permit by the
Planning Commission and Board of County Commissioners before such
changes from the plans and/or Development Standards shall be permitted.
Any other changes from the plans and/or Development Standards shall be
filed in the office of the Department of Planning Services.
9. The property owner and/or operator of this operation shall be responsible
for complying with all of the above stated Development Standards. Non-
compliance with any of the above stated Development Standards may be
reason for revocation of the Conditional Use Permit by the Board of
County Commissioners.

Itlis respectfully requested that building permits be granted
in advance of conditional use permit with the understanding that should
the conditional use permit be denied, the Union Pacific Railroad Company
will dismantle and remove all improvements.

Gentlemen:
The Union Pacific Railroad Company has secured an option to
purchase a perpetual easement on a parcel of land on county highway
No. 49 approximately 3.3 miles south of U.S. Highway No. 34 in Section 6,
Township 4 North, Range 64 East, as shown on attached drawing.
Due to our lack of knowledge of the requirements of Weld County,
we have placed a building and erected a 100 ft. high guyed steel tower
on the above-mentioned parcel without permit or approval of Weld County,
authorities. ' As soon as we found that we were not in compliance with
the requirements of Weld County, construction was immediately halted.
We respectfully submit the following:
1. There was not and is not now any intent on the part of the
Union Pacific Railroad Company to circumvent, evade or ignore
any ordinance or resolution of Weld County.
2. Improvements on this site are intended to provide radio com-
muncationsfor the safe and efficient operation of railroad
trains within the range of radio transmitters to be installed
at this site.
3. We are preparing now, and it is our intention to file as soon
as possible, formal application for conditional use permit as
required by Weld County Zoning Resolution.
In order to furnish the Commissioners as much information as
possible at this time, we are attaching the following documents and
drawings:
1. Copy of "option to Purchase a Perpetual Easement" dated June 1,
1979, from Lalovee Glendale Cobb and Marta C. Cobb.

2. Copy of Chief Engineer's drawing dated August 14, 1979, show-
inglproperty upon which an easement is to be acquired from
Lalovee Glendale Cobb and Marta C. Cobb. (Exhibit B)

This is in answer to your request for soil information for a radio
communications site to be located in the SW' NW4 of Section 6, Twp. 4N,
Range 64W, Weld County, Colorado.
The site as located on your map is situated on two soil types; Terry fine
sandy loam, 3 to 9 percent slopes (60-CD) , and Renohill clay loam, 3 to 9
percent slopes (66B-CD). Both soil types are compatible and suitable for
use as radio communication sites. Moderate depth to shale or sandstone
(20 to 40 inches) is the main limiting feature of these soils. Both soils
are susceptable to erosion due to slope, therefore vegetative cover should
be maintained or reestablished as soon as possible after construction.
Standard footings and normal construction methods which meet local regula-
tion should be adequate. However, if site conditions are different than
those cited in the enclosed soil descriptions, an on-site investigation
should be made by a qualified soil engineer to determine proper construc- •
tion procedures and design.
Enclosed are a soil map and soil descriptions for the soils found on the
site.

'This is a moderately deep, well drained soil on gentle plains at
elevations of 4500 to 5000 feet. It formed in materials weathered •
- residually from sandstone.
Included in this unit -are some soils with sandstone deeper than 40
inches. Also included in mapping were some soils -with sandy clay
.loam and clay loam subsoils.
Typically the surface layer is pale brown fine sandy loam about 6
• inches thick. The subsoil is pale brown fine sandy loam about 13
inches thick. Depth to sandstone ranges from 20 to 40 inches.
• py)i Permeability is moderately rapid. Available water capacity is moderate.

�•• Effective rooting depth is 20 to 40 inches. Surface runoff is medium
to rapid and erosion hazard is moderate .
This soil is suited to limited cropping; intensive cropping is hazardous
because of erosion. The cropping system should be limited to close
grown crops such as alfalfa, wheat and barley. The soils also are

adapted to irrigated pasture. A .suitable cropping system-would be
alfalfa 3 to 4 years followed by corn and small grain for 2 years and
-alfalfa seeded with a nurse crop.
Close grown crops may be irrigated from -closely spaced contour ditches
orlsprinklers. Contour furrows or .sprinklers should be used for new
crops. Applications of nitrogen and phosphorous fertilizer will help
maintain good production.

The potential native vegetation on this site is dominated by sand

. , bluestem, sand reedgrass and blue grama. Needle-and-thread , switchgrass ,
- sideoats grama and western wheatgrass are also prominent. Potential
production ranges. from 2200 pounds per acre in favorable years to
`
1800 pounds per acre in unfavorable years. When range condition
deteriorates , sand bluestem, sand reedgrass and switchgrass decrease
and blue grama, sand dropseed and sand sage increase. Annual weeds
.and grasses invade the site as range conditon becomes poorer.
Management of vegetation on this soil should be based on taking half
and leaving half of the total annual production. Seeding is advisable
if 'iange is in poor condition. Sand bluestem, sand reedgrass , switch-
grass , sideoats grama, blue grama, pubescent wheatgrass and crested
Ka iiiit wheatgrass are suitable for seeding. The grass selected should meet
• the seasonal requirements of livestock. For successful seeding, a
clean, firm, sorghum stubble -- prepared the growing season prior to '
seeding -- or a firm, prepared seedbed and grass drill should be used.
Early spring seeding has proven most successful.
Windbreaks and environmental plantings are generally not suited to
this soil. On-site investigation is needed to determine if plantings
. are feasible.
Wildlife is an important secondary use , with these soils best suited fa:

tribution line upon all streets, roads or highways

to the Owner from the Optionee at any time within said

• This option is given with the understanding that
upon its exercise by said Optionee, the Owner will execute

easement conveying the aforesaid easement to the Optionee,
its successors and assigns, free and clear of all encumbrances,
subject, however, to all taxes which shall be levied upon or
assessed against such improvements as the Optionee shall construct
or install upon the above described premises, all of which
taxes the Optionee shall assume and agree to pay. Upon execution
and delivery to the Optionee of such perpetual easement, the
Optionee will pay to the Owner the purchase price hereinabove
specified, less the amount first above mentioned which was
paid to the Owner upon the execution of this option.
The Owner hereby grants to the Optionee the right
immediately to enter upon and use said property with the under-
standing that in the event the Optionee does not elect to acquire
easement to said property within $( X months from
the date hereof, then, and in that event, the Optionee agrees
to restore said property to its original condition. •

In the event that this option ' is exercised , the Owner
shall obtain a signed release from the tenant or tenants, if
any, of the above-described premises agreeing to surrender
immediate possession thereof and the Owner likewise agrees
to give immediate possession to the Optionee and the Optionee
may take and hold possession of said property upon the date
said option is exercised in writing as hereinabove provided
without further notice or demand upon the Owner .
If this option is not exercised, the Owner shall
retain the sum first .herein written and named as consideration
for the option herein given in full and complete satisfaction
of all damages sustained by the Owner, it being understood
that the option to purchase the perpetual easement on the
- aforesaid property rests entirely with the Optionee and that .
there is no agreement to purchase said perpetual easement
unless and until the aforesaid option is exercised as here-
