Section 23-230-B.-1 Our proposal is consistent within Chapter 22. Although this Comprehensive Plan is rather large and detailed,we feel that we have met with requirements that apply to our petition. We have made every effort to comply with all other conditions recommended by Planning Staff. Section 23-230.B.2 Our land use is Agricultural. We own 59.9 acres of agricultural land where we grow alfalfa and grass. We have a license for boarding and training horses. The area designated for this particular site specific permit will in no way impact the use of our land to maintain the above mentioned. Section 23-230.B.3 We are surrounded by agricultural properties in all directions. Our land use allows us to have animals. There are animals in agricultural zoned properties to the North, South,and East of our property. The events to be held are in compliance with the agricultural use. Our neighbors to the North and South of our property grow alfalfa and grass. They also have cattle. Our neighbors to the East have horses as well as goats,pigs,chickens,and cattle. Section 23-230.B.4 Article 11 Land Use Categories. We arc in compliance with this section with the growth of alfalfa and grass. Section 23.2.230.B.5 Our site does not lie within any overlay districts. Section 23-230.B.6 As stated before,our primary interest is to continue to conserve our agricultural land. The area that is designated for this permit does not impact the agricultural status or productivity of our 59.9 acres. Section 23-2-230.B.7 We feel that there is adequate provision for the health,safety,and welfare of inhabitants of the neighborhood and the County. We have addressed the conditions set forth by Planning Staff to include traffic control plan,security, sanitation and water. The event area is more than LOGO feet in every direction from neighbors. Road 31 and the County will not be impacted with the additional traffic once a week as stated by Public Works/Planning Staff. EXHIBIT 1 u.srz4-14/g3 A. All plats submitted are labeled USR-1483 B. Dust Abatement Plan-n/a Access roads to event area which are roads 16, 18,and 31 are paved roads. Traffic control plan already submitted to Weld County Sherrriffs department has been approved and calls for no parking along road 31 and/or Aristocrat Acres(no paved road in this community)as well as reduction of speed while entering and exiting event area. C. Potable water system has been addressed and approved by planning staff through Public Health and Environment. D. Waste and Manure Handling(list submitted to Planning Services) 1. Wastes expected are: common trash to include,empty water bottles,soda cans,candy wrappers, foam cups,etc. Volume will vary depending on attendees. With an average of 10-14 horses participating in events once a week,manure will not be an issue. It will be promptly distributed in the agricultural land to maintain rich soil at all times. 2. There will not be an type of chemicals stored on the site. 3. Our trash collector is: Platte Valley Disposal,Inc. P.O. Box 568 Brighton, CO 80601 (303) 659-3050 trash is collected weekly or sooner if needed E. 1) n/a 2) n/a F 1. Trash cans will be placed throughout event area. These are collected and placed in a large dumpster for collection. Area as well as roads 31,parts of roads 16,and 18 are cleaned after every event as already stated in initial application. 2. Lighting already addressed. Events will be held during daylight hours only. G. There are parking attendants at all events. Cars are parked allowing proper exiting at all times. A separate area has been designated for horse trailers. There approximately 3-4 acres designated for all parking. Additional acres are available should there be more parking needed. This will not impact the other 50+acres for agricultural use. H. Per Brian Grubb, City of Fort Lupton,there is no petition at this time for annexation. This single property owner does not have the right to impose his enterprise opportunities for profit or non profit on an area that zoned to my knowledge as residential/ agricultural. He has not been supportive of the existing community in any way. Spectators of the activities show no regard or respect for the private property they trespass on and/or damage while visiting the racetrack. As far as I can tell he has been operating this racetrack illegally to date and the only reason we are even given this opportunity to voice our concerns is there has been enough complaints to get Weld County's' attention. I have not been unable to find any evidence of a 501C3 for this so called non-profit business. This gentleman has made no effort to operate his so called non-profit racetrack in accordance with the requirements of the county or state and I don't think he would ever bother to do so if it weren't for the efforts of the community that he is affecting. There are so many racetracks in this state that are already established facilities that are not operating. Weld county has already closed in one well within 150 feet of the requested location for safety reasons, the requested location also has oil storage facilities located extremely close to the area proposed to be used for parking and spectators. During the planning board hearing which I attended it was clear that the current surface owner has no idea that the safety of participants,spectators and residents is a concern, he specifically stated "he had no control over the attendees of his illegal horse racing activities. He also denied the need for hygeinic facilities to insure the health of attendees. Incidentally one participant has already been killed as part of this illegal activity, there was a question of whether or not adequate staffing of health professionals might have prevented that death.There is a clear pattern of irresponsibility and negligence associated with this illegal operation and its hosts. Lastly is my concern for the safety and rights of the local residents , the Sheffifs Department has already stated in the previous hearing that they do not supportthis request and in fact stated that they felt that he permit would place residents and attendees at additional risk of harm. Please do not permit this activity to be perpetrated against the community or expose the proposed attendees to such dangers. The taxes that I have Weld County over the past 40 years and will continue to pay should not be used to support illegal and irresponsible activities indirectly such as this activity. The Sherriff, the ambulances, the road maintenance, the Health Department, the hospitalization, the Fire Department and all of the ancillary costs related to this activity should not be permitted in our county.
