Subject: SLS Turkey Farms, Inc. - SUP #118
SLS Turkey Farms, Inc. , made inquiry about the limitation of 70, 000
turkeys to the permit as set forth in paragraph 3 of the Resolution
granting the permit, which Resolution is dated November 10, 1971.
Since this permit was granted pursuant to the prior zoning which was
faulty and subsequently corrected on December 29, 1976 , by the filing
and recordation of the Official Zoning Map and Resolution, it is my
opinion that the 70, 000 turkey limitation cannot be enforced by Weld
County.
In the event that a limitation is considered by the Board of County
Commissioners in the future, I would recommend that an amendment to
Special Use Permit #118 be considered by the Board after following
the procedures of the Zoning Ordinance concerning amendments to
Special Use Permits.
