RE: ACTION OF THE BOARD CONCERNING MOBILE HOME PERMIT, ZPMH #2438 -
JACK SWAYZE AND SHEILA KRUGER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board of County Commissioners of Weld County,Colorado,on the 29th day
of August, 2005, considered the request of Jack Swayze and Sheila Kruger, 18995 Weld County
Road 17, Johnstown, Colorado 80534,for a mobile home to be used as a Principal Dwelling in an
A (Agricultural) District on a parcel of land being more particularly described as follows:
LotA of Recorded Exemption#3967;being part of the
NE1/4 of Section 32, Township 4 North, Range 67
West of the 6th P.M., Weld County, Colorado
WHEREAS,on the 29th day of August,2005,the Board deemed it advisable to continue said
matter to September 7, 2005, at 9:00 a.m., to allow adequate time to receive a recommendation
from the Board of Public Health, and
WHEREAS,on September 7, 2005,the Board of County Commissioners, having heard all
of the testimony, finds that pursuant to Section 23-4-200 of the Weld County Code, said request
should be denied for the following reasons:
1. Section 23-4-200.A.1 -It is the opinion of the Board of County Commissioners that
the proposed mobile home is not compatible with the surrounding area, and is not
in harmony with the character of the neighborhood and its effects upon the
immediate area.
2. Section 23-4-200.A.4-It is the opinion of the Board of County Commissioners that
the general health,safety, and welfare of the inhabitants of the area and the County
will be jeopardized or compromised by the location of the mobile home on this site,
as one hundred percent of neighbors and surrounding property owners have
expressed opposition to the request.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request of Jack Swayze and Sheila Kruger for permission to place a
mobile home to be used as a Principal Dwelling on the above described parcel of land be, and
hereby is, denied.

REQUEST: This is a request for a Mobile Home to be used as a Principle Dwelling.

The Department of Planning Services' staff has reviewed this request and recommends that this
request be for the following reasons:
1. It is the opinion of the Department of Planning Services'staff that the applicant has shown compliance
with Section 23-4-200 of the Weld County Code, as follows:
a. Section 23-4-200.1-The proposed mobile home is compatible with the surrounding area, is in
harmony with the character of the neighborhood and its effects upon the immediate area.
The surrounding area is agricultural with some residential.
b. Section 23-4-200.2-The proposed mobile home is compatible with the Weld County
Comprehensive Plan.
The mobile home will be placed on 1 acre of Agricultural land and used as a principle
residence and will not interfere with agricultural uses.
c. Section 23-4-200.3-There is available water and sewage disposal facilities for the mobile home.
The applicant has septic permit(SE-0500022)and is proposing to use a cistern for water.
d. Section 23-4-200.4-The general health, safety and welfare of the inhabitants of the area and
the county will not be jeopardized or compromised by the location of the mobile home on this
site.

1. The applicant must obtain a building permit for a mobile home and must comply with all installation
standards of Chapter 29 of the Weld County Code applicable to mobile homes prior to locating the
mobile home on the property.
2. Prior to receiving a certificate of occupancy, the mobile home shall be connected to an approved
sewage system and a legal water supply.
3. The mobile home shall not be occupied until such time that the applicant has complied with Conditions
1 and 2 stated above.
4. Prior to the release of building permits, the applicant shall submit a recorded deed describing the Lot
upon which the building permit is requested with the building permit applications. The legal description
on such deed shall include the Lot designation and Recorded Exemption number.
5. The property is in violation of Chapter 23 of the Weld County Code(Violation#0400125).The applicant
shall schedule a final inspection with the Weld County Zoning Compliance Officer.
6. All proposed or existing structures will or do meet the minimum setback and offset requirements for
the zone district in which the property is located. Pursuant to the definition of setback in the Weld
County Code, the required setback is measured from the future right-of-way line.
7. Derelict manufactured(mobile)home:a manufactured(mobile)home that is partially or totally damaged
by fire, earthquake,wind,or other natural causes, or is in a state of general dilapidation, deterioration,
or decay resulting from improper lack of maintenance,vandalism,or infestation with vermin or rodents.
Any such derelict manufactured(mobile)home shall be returned to and maintained in the condition as
originally established on site and as inspected by the Weld County Building Inspection Department,
or it shall be removed from the site.
No building or structure as defined and limited to those occupancies listed as Groups A, B, E, F, H,
I, M and R in Section 302.1 of the 2003 International Building Code, shall be constructed within a
200-foot radius of any tank battery or within a 150-foot radius of any wellhead. Any construction within
a 200-foot radius of any tank battery or 150-foot radius of any wellhead shall require a variance from
the terms of the Section 23-3-10 of the Weld County Code.
8. Any future structures or uses on site must obtain the appropriate zoning and building permits.
9. Effective January 1, 2003, Building Permits issued on the proposed lots will be required to adhere to
the fee structure of the Weld County Road Impact Program. (Ordinance 2002-11)
10. Prior to the release of building permits, the applicant shall submit evidence to the Department of
Planning Services that Lot A has an adequate water supply of sufficient quality, quantity and
dependability.
11. The Environmental Health Division of the Weld County Department of Public Health and Enviornment
will need to approve the final attachment of the proposed mobile home to the existing septic sytem,
(SE-0500022). Alterations to this existing system that are required to enable the proposed mobile
home to utilize this existing system may require a repair permit.
12. County Road 40 is designated on the Weld County Road Classification Plan as a local gravel road,
which requires 60 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. This
road is maintained by Weld County.
13. The applicant shall utilize the existing shared residential access to this parcel.
14. Should noxious weeds exist on the property or become established as a result of the proposed
development the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant
to Section 15-1-10 of the Weld County Code.
15. The applicant shall maintain compliance with Section 23-4-200 of the Weld County Code at all times.

Dear Mr. Swayze and Ms. Kruger:
This is to inform you that on August 30, 2005 the Board of Health reviewed and
approved your application for a cistern permit for the home located at 18995 CR
17; Lot A, Johnstown, Colorado.
You may install your cistern. However, this approval is contingent upon the
following:
1. In accordance with Weld County Code, Chapter 14, Article III "Cistern
Water", upon the availability of water from a private well, the Aristocrat
Water Project, or any other community water supply, this permit will not
be valid. You must obtain water from that water supply.
2. This permit must be renewed each year on this date.
3. The cistern permit shall not be valid once water service is available
from the Water District or some other community water supply.
4. In the event a community water supply is not available one year from
the issuance of the permit, the applicant shall obtain a permit for and
install a private well.
5. The cistern must be placed a minimum of 100 feet from any portion of
the septic system.
Prior to receiving a final permit for use of the cistern, the following must occur:

1. Our Division must do a final inspection of the cistern after it has been installed
(but not yet covered with dirt) and is full of water. You must schedule this
inspection.
2. Our Division must collect a water sample for bacterial analysis. This
sample will be collected at the time of inspection. The analysis must
reveal that the water in the cistern is suitable for human consumption.
In the event the test fails, a retest must be conducted.
Please be reminded that the installation and operation of this cistern must comply
with Weld County Code, Chapter 14, Article III "Cistern Water". This Section of
the Code includes a mandatory annual renewal fee and bacteriological water
test. A copy of this Section of the Code is enclosed for your records.

Although I have been in contact with Sheila regarding the status of this mobile home,you have had 30 days
for a resolution as far as contacting Little Thompson as to obtaining a shared tap, or removal of the mobile
home. Should our office not receive confirmation from Little Thompson regarding the tap within 10 days of
receipt of this letter,we may need to proceed through the court process regarding this case. Should you not
be able to obtain the tap and are going to remove the mobile, we will need a letter of intent to do so, and a
timeline as to when this will be complete.

Dear Mr. Swayze:
In accordance with Section 23-4-200A.3, of the Weld County Code, the Department of Planning Staff has
denied your request for the zoning permit for this mobile home given the lack of evidence of the availability
of adequate water. The Department of Planning Services has also received letters in opposition to your
zoning permit for a mobile home to be used as a principle dwelling, more than 30%of surrounding property
owners are in opposition to your application. Therefore, per the County Code, you as applicant for this
zoning permit, are required to attend a public hearing with the Board of County Commissioners, for final
determination of your application request.
Should you wish to go ahead and go forward to the Board, please contact this office in writing within five
business days of receipt of this letter so that a hearing date may set. Should you not choose to go forward,
the mobile home will need to be removed from the property within thirty (30) days.

Your zoning permit for a mobile home application is being processed by our office. If it is determined that the
application meets the approval criteria of Chapter 23,Article IV, Division 3, of the Weld County Code,you will
be notified that the zoning permit is approved. If the staff determines that the application does not meet the
approval criteria, you will be notified and asked to appear before the Board of County Commissioners at a
public hearing. You will be informed of the hearing date at least a week prior to the hearing. The Board of
County Commissioners will then consider your application and make a final decision on the zoning permit for
the mobile home.
It is the policy of Weld County to refer an application of this nature to any town or municipality lying within three
miles of the property in question or if the property under consideration is located within the comprehensive
planning area of a town or municipality. Therefore,our office has forwarded a copy of the submitted materials
to the Johnstown Planning Commission for their review and comments. It is recommended that you and/or
a representative be in attendance at the Johnstown Planning Commission.meeting to answer any questions
the Commission members may have with respect to your application. Please call Johnstown at 970-587-4664,

My name is Sheila Kruger I am disabled and I live with my husband and my father
Jack Swayze at 18995 WCR 17 Johnstown Co. 80534. We have applied for a permit to
set a Mobil home on my dad's property and due to not having adequate water( ie no
separate tap) we were denied. I have spoken to Mike Cook on a few different occasions
and he let me know of an option of connecting the Mobil home to the existing tap that is
on the property under a hardship.
There would not be anyone living in the Mobil home for rent purposes. I have a
medical condition, and have blackouts and at times need someone to be here with me
when it is not possible for my husband to be here. I am not asking for anything
permanent, as I am aware if the property were sold the Mobile home would have to be
removed and the tap restored. I am requesting a 2 to 5 year time period with the
provisions that if I no longer live here the tap would have to be restored to one residence.
Please consider my request even if the time period would be different. Thank You. If you

WCR 40 is designated on the Weld County Road Classification Plan (FHU) as a local gravel
road, which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-
way. The road is maintained by Weld County. Pursuant to the definition of SETBACK in the
Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured
from the future right-of-way line.
REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
The applicant shall utilize the existing shared residential access to this parcel. (per RE-3967)
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the

Upon review of my case files and computer, an active Violation (VI-0400125)was noted. This violation
was initially issued for several reasons, including,commercial vehicles(semi's),a visible"Noncommercial
Junkyard" and a mobile home being placed on-site without any permits. Since the initial complaint,
pending completion of this application,all aspects of the violation will have been corrected. This case was
presented at a Violation hearing before the Board of County Commissioners on February 8, 2005. The
Board referred this case to the County Attorney's Office for legal action, but delayed action for 30 days.
Subsequently, this application was completed and submitted.
This application if approved,will correct the violation. This violation will be closed as soon as the building
permit(PRS-053011)has been completed. If for any reason,this application is denied,the Violation Case
will proceed accordingly. Additionally, if this case is denied, please request that the mobile home is

I have reviewed the request and OBJECT for the following reasons;
The location that this mobile home would be set, is on the very corner of roads
17 and 40. On the North side, just across the road from this lot, is the Johnstown
city limits. Road 17 in the past few years, has become a major road used by
hundreds of motorists daily. With the major housing developments that are
taking place in this area, we have seen an explosive number of cars traveling on
road 17. Setting a mobile home on this corner, would create an eye sore that
would project it's self to every passing person on these roads.
A mobile home, would defenetly not be compatible with the development that is
occuring in this immediate area.
Within 500 feet to the North of this lot, is the Wagon Wheel Estates. This area is
soon to start building Estate homes in the $400,000 to $1,000,000 plus range.
Directly to the east, across the road of where this mobile home would sit, already
exist a new home that is in the $400,000 range.
Plannes are being worked on now to possibly create a Mini Subsivision on 100
acres, just across the road to the east of where the mobile home would sit.
A half mile north from the lot and on the east side of road 17, is a 200 acre farm
that has just gone up for sale for possible development. This farm is next to the
Pioneer Ridge Subdivision of Johnstown. The Pioneer Ridge subdivision already
has several hundred homes and a new middle school.
Setting a mobile home on this corner lot, would create a negative effect for land
owners in the area, and an eye sore in this developing area.

We object to a mobile home being put on the corner of road 17
and 40. Having a mobile home put on this corner would not fit in,
and detract from the development of this area. In the past few years,
development has been moving south of Johnstown at a steady
pace. This is right in the path of this deveopment, and does not
fit in with this new development. Road 17 has become a major route
for the new home owners, and potential owners of these
developments. A mobile home on this corner would create an
eye sore for this area.

This letter is in response to your request for a water service commitment for up one tap for a
residential lot, in the location described as follows:

The District provides water service within its service area as defined by the District. The
provision of water service by extension of existing water lines of the District to the above property and
the installation of taps for lots is done under the terms of the Rules and Regulations of the District
established by the Board of the District from time to time. You may obtain a copy of the Rules and
Regulations from the District. This letter outlines the provisions of the Rules and Regulations, however
this letter does not change any provisions of the Rules and Regulations. The Board of the District may
alter and amend the Rules and Regulations at any time, and the provisions of this letter are subject to
alteration and amendment based on changes in the Rules and Regulations of the District.
We currently have an 8" diameter water line located along WCR 40 West of WCR 15 with
additional capacity available Therefore, we can commit to provide service to the above property, subject
to the limitations in this letter, for one standard residential 5/8" X 3/4" water tap per lot; and the
following additional limitations on the provision of water service are:
1. All improvements to District facilities required to provide service will be the financial
responsibility of the developer in accordance with the District Rules and Regulations. All
improvements must conform to District Specifications.
2. Little Thompson Water District requires you to transfer 1.4 shares of Colorado Big
Thompson water for each lot in the commitment and then to pay for the rest of the tap fee
as the water lines are put in service.
3. If a fire hydrant is required for the subdivision there is a $2,000 fire hydrant fee that
needs to be paid prior to installation of the fire hydrant. You will be responsible for any
improvements or upgrades needed to meet the required fire flows in your subdivision.
4. In order to provide the required flows to the subdivision you will be required to install a
minimum 6" Diameter water line from the existing 8"diameter waterline located West of
WCR 15. A rebate is due the developer that installed the new 8" line. This water line is
would be nearly a mile in length and would need to be placed in a utility easement next o
WCR 40. The enclosed map shows the proposed upgrade to extend service to your lot.
5. You will be required to provide the needed water lines in the proposed subdivision.
6. The design, installation and total cost of the project will be the responsibility of the
developer.
This commitment letter will expire two years from the date of this letter if the tap has not been
purchased, paid for and installed by that date of expiration. The current fee for the domestic 5/8" X 3/4"
tap is $25,700. YOU ARE HEREBY ADVISED THAT THE RULES, REGULATIONS AND
TARIFFS OF THE DISTRICT ARE SUBJECT TO CHANGE WITHOUT NOTICE; AND THIS
LETTER IS ISSUED WITH THE SPECIFIC LIMITATION THAT THE DISTRICT MAY

On March 29,2005,an evaluation of the existing individual septic disposal system at:
18995 County Road 17,Johnstown; (north of existing modular)
Section 32,Township 4 North,Range 67 West,
was conducted by Pam Smith, an Environmental Specialist of this department.
The existing individual septic disposal system is of sufficient size and capacity to adequately handle the
proposed load. This evaluation is based on a final treatment capacity for a 2 bedroom residence.
Be advised,neither the County of Weld nor any of its agents or employees undertake or assume any
liability to the owner of the above property,to any purchaser of the above property or to any lending
agency making a loan on the above property or in the report.
This inspection was conducted for the purpose of determining compliance with current regulations and
for detecting health hazards observable at the time of inspection. This does not constitute a warranty that
the system is without flaw or that it will continue to function in the future. Inspections requested during
periods of snow cover and high soil saturation may be of questionable value to potential buyers due to
adverse conditions. Evaluations based on Statements of Existing(S.O.E.)relies on information the
property owner provides, under oath, indicating current status of the system and representing to the best
of his/her knowledge the system is not failing to function properly.

I am sending this in concern for the zoning permit hearing scheduled for Sept. 7th. for ZPMH#3967. - ,..
I am concerened that you will over look the wishes and concerns of many residents in the area where this _
mobile home would be placed.
This area is not zoned now to allow mobile homes to be used. -In the process of getting a permit, Jack Swayze and Sheila Kruger sent out 4 notices to there surronding
neighbors to notify them of the request. Out of those, 4 neighbors sent replys to the county, all apposed to
a mobil home being used on the Cproperty. Swayze/Kruger already live in a nice home on there property. They
are trying to create another additional home.
All of us agree, that a Mobile Home would not fit into this area. This area is not a regular farming area. The
homes that are now being built in this area, all are above the$300,000 range. Some of these homes are above
the$600,000 range. These homes are not in the city of Johnstown, these homes are in the rural area
surrounding this property. This property also sits just across the road from the Johnstown city limits. This area
of Johnstowm is being developed now with higher end homes in the$300,000 to$400,000 range. Wagon
Wheel Estates, startes only about 400 feet from there property, will have homes that will reach the$800,000
area.
This mobile home would go right at the intersection of W.C.R. 17 and W.C.R. 40. When I say right at the
intersection, I mean at the intersection.
The mobile home would only set about 75 feet from both roads.As you all know, Road 17 has become a major
traveled road in this area because of all the new development. Swayze/Kruger already have the mobile home
they want to us sifting on the property. It has sat there for almost a year now, against county code,with out any
permits at all.This mobile home is an old flat roofed tin sided mobile home with 2x2 walls, built back in maybe
the late 70's. It is in very poor shape. It looks like a mobile home that would be used in a slum area. I do not
believe that it would even be allowed in a mobile home park at this time. All of the neighbors do not want a
mobile home in this area, let alone an old mobile home like this. We have all worked hard to create nice homes
in this area and do not want mobile homes detracting this quality. As you know, Road 17 has become a major
traveled road in this area because of all the new development. When you come down the road from either
direction, this mobile home just glares at you. Usually mobile homes sit discreetly away, or out of sight of a
major road. This one sits, like a festering pimple on a nose, right in plain view of everyone traveling this
area. This creates an eye sore for our area.
I believe that Swayze/Kruger did not investigate wheather they could have a mobile home on there property
before they acquired it. Now, after almost a year, they are grabing a straws try to slip a mobile home on there
lot next to there current home.
I have heard, that after exhausting every avenue they could to go against county code and there neighbors
feelings, are trying to use the hardship route to get a mobile home in. This is very Questionable after all this
time. If they needed the mobile home for a hardship, they would not have had to do a recorded exception to get
it. They created a new lot so they could maybe rent it out? A hardship is like if your home burnt down and you
need something till you get it rebuilt. A hardship is, a 80 year old person needing medical help for there every
day needs to stay alive. A hardship is not intended to be used because it would be nice to have some extra
income, or would be nice if the father-inlaw lived there.
We all hope that you as Commissioners, will respect the wishes of the people in this area, and not change the
established code and denie this zoning change. There have been pictures taken of the area that should be with
this case file. We have given many pictures to Wendy.
